Apple River stabbing trial: Miu's 'best friend' testifies

  • Ernesto Torres Chaguez testified in the Apple River stabbing trial of Nicolae Miu.
    Ernesto was tubing with the Miu group on July 30, 2022, and has known Miu for over 10 years, calling Miu his best friend. He considers Miu a handyman, noting he has used a pocket knife to fix things. He called Miu the day they went tubing to bring his pocket knife so they could cut the ropes that tie the tubes together once they got done tubing. Ernesto said he didn't have one, so he asked Miu to bring one because he knew he had one.

    GOOD GRIEF!! As an avid, life-long river runner, who often ran some river somewhere for up to 20 weekends a year for over 35 years so far, and did it in every craft imaginable from innertubes to 8-man rafts, and who owns 4 river tubes, 6 kayaks, and a small flat bottomed boat right now, I can tell you that serious river runners would NEVER go down a river without a knife. I have 4 river running life jackets right now that were made with a tab specifically for attaching a knife just like the one Mr. Miu possessed. CAN WE PLEASE GET OVER THE BENIGN FACT THAT HE WAS IN POSSESSION OF A RIVER KNIFE WHILE ON THE RIVER??

      Having the knife is so irrelevant it's not funny! I don't know many who go out of doors with a knife, etc! It's what he chose to do with his knife that is the problem! He was the aggressor from start to finish!

      As an EXPERIENCED river runner you would have a knife yes. He wasn’t an EXPERIENCED river runner. I’m a white water kayaker for thirty years. I’ve never seen a tourist on the river who needed a knife for any other purpose than lunch.

      Although i can say ,once upon a time i was asked if i had any weapons.

      He pats me down, and says, whats this?

      To which, he said.

      Then i said.
      Thats not a weapon, as a boy scout ,it is the best tool in the world. I had a knife on me since i was 5 or 6 years old. As a matter of fact, i really told you the truth. Im not looking too use my knife on a anything living.....
      Every mexican i know can speak english a little bit. But i know they understand english. And he is nick best friend. Working in that state for over a year. Niks attourney. Sounds really weird, talking to buddy like he is speaking to a five year old. And all the knife questions seemed rehearsed. That one question, were he answers and then remembers, and says," and he uses his knife to fix things,
      Id say self defense. But he couldve gotten out of that, without having to gut them. But when you F' around, you always gonna find out. 100% of the time! Choices seem to hide ,or rather step aside once your mind is made. Its funny what happens to people in groups. Creepy is a better word. Yeah..

    It is hard to believe not one person in snorkel guys group didn’t ask what was happening. That is not normal human behavior, especially amongst friends. There is always curiosity.

    Adults on a river tubing and drinking is disturbing and add to that parents drinking on the river with minors and young adults. One family (busy body-family) had had issues on another river. I feel bad for Miu that he had to encounter these animals and he had every reason to fear for his safety. Rabid pack animals is how the teens were acting.

      @@themartdog Absolutely - a monstrous, disproportionate and calculated act. The only slight (non-legal) ‘mitigation’ could be that he was drunk.
      If he did say ‘something about little girls’, which I don’t disbelieve, he was probably irritated by being questioned about what he was doing in the shallows with a snorkel. Such a response would also be passive aggressive.

There also isn’t strong evidence she was even punched. She had no fucking clue what was going on and she walks up and joins in the ridicule and gets in the man’s face. The teens should have just let the man walk away, but they didn’t do that and it got their friend killed.

    Some of these people attacking this man were in their twenties. Gangs are allowed to run wild in this country today and attack people. They started it. He was in the river looking for a cell phone that had been dropped. They came up and started calling him names and then attacked him . They were holding his head under water, punching and kicking him while screeching like the drunken mob they were. He has a right to defend himself.

      You're wrong. The testimony and the frame-by-frame video corroborate the witnesses. He punched the blonde girl with the sunglasses first, that's what started the fight. He has no claim to self-defense, he's guilty.

He didn’t have to wait for them to throw the first punch and it’s still not even 100% confirmed he punched the woman.       Privileged kids aren’t charged in the crime that they committed. The kids and mom assaulted Miu, kicked him, choked him, held him underneath the water. The mob got away with several crimes and because Miu defended himself he is charged.?He easily could have been drowned by these drunken thugs who always get away with the crap they start. The lovely kids harassed others on the River that day. Would Miu be charged if they stabbed him? Fighting isn’t fair.

      He never thought he was in fear for his life. He didn’t like how a bunch of loud mouth teenagers talked to him and he wanted to teach them a lesson. He came back toward them and grabbed their tubes trying to flip it over. He didn’t have to go back towards them. He chose to be down there and was hoping for confrontation

For the rest of us men, there is the silent agreement even between strangers that things should be kept as mellow as possible because if things escalate, they can get violent, and if things get violent, people can die. So yeah, of course your opinion on self defense if flawed, because your idea of self defense is calling another man to come help you. They rest of us are on our own, so it’s best to keep things cordial.

    The translation has a some inaccuracy, particularly at 13:29 where Ernesto’s final words to Nick were not “No, don’t go”. At 13:14, what Ernesto actually said to Nick was “forget about the phone”. While this may seem like a minor detail, the phrase “No, don’t go” conveys a strong command, whereas “forget about the phone” comes across as a casual suggestion.
    Teens were high on drugs and alcohol, with lots of energy to spare, bullying got them quickly involved with verbal and physical. To me it was legitimate case of a self defense action driven by frustration, embarrassment and above all fear.

    My personal experience with shock is unbelievable
    I worked for a propane company halling bottled gas
    I was rearended by a police officer on a blood run to another hospital omplete white out
    I was sent 100 yards into a cornfield
    I broke my back
    I crawled out of mytruck and stood up all the tanks tipped over and leaking
    I then strapped the leaking tanls back to the bed of my truck
    I got back in my destroyed vehicle and put my seat belt back on
    With a broken back
    It took 6 emts and firefighters to get me oit and to the ambulamce
    My point is shock will make you do things you cant even explain
    To saythat everyone in shock responds normal or the same is not true
    Medically there are signs tjst can be observed every thing being witnesses are sayimg is shock

    As a Mexican who speaks spanish and english I'm very dissapointed with the translators... the woman is giving the answers and completing the questions and the man didn't translate everything, so the lawyer had to modify the questions or ask again to get the full answer.. that's why I think the jury can't get the whole story he's trying to convey

    Approximately 40 years ago on the Apple River, as a 18 year old with 3 other friends, we confronted a guy and did actually antagonize him for maybe 2 minutes. We had no plans on attacking the guy - just verbal. He pulled out a knife - maybe 5" - 6" inches. We backed off and incident stopped. I think if we would have kept at it, we probably would have took the knife and stabbed him. Either way, it would have been an incident that would have affected our lives forever by death or prison. Thank god we backed off. It's a no win situation.

      Very wise. I have a close friend who got involved in a fight to protect another friend inside an amusement park . One of his opponents stabbed him in the back with a knife. He actually was military man. He got no prison punishment because he's a military man and was waiting for a newborn daughter coming. My friend was taught a lesson and luckily got out alive.

      When I first started looking into this story, I was guilty of thinking right off the bat that this older man was a creep and a pedophile because of the nonsense and lies Cockfield made up and had everyone else believing just because the guy had goggles. Now as I watch the trial, the only thing the older guy was guilty of was looking for his phone while carrying goggles walking through or past a group of immature ego maniac dumb teenagers. If Cockfield would have had some sense of control over his football brain ego, his best friend would still be alive. That's where it started. The older guy was outnumbered 12 to 1 by drunk teenagers and he could see the situation was escalating. I'm sure he thought in his mind which was consumed with fear, that next he was going to be drowned. How else was he to protect himself. Where were the other adults who would hopefully have half a brain and see what was going on and stop it. People, especially young drunk teenagers, will always follow and join in to which they might think as fun at first but turns into a mob, a gang up on, a group of bullies, where one individual will try and one up the other idiot. The outcome is usually deadly. What a sad sad situation. If the older man doesn't speak or understand English very good, then that can throw more gas on the fire because there is a communication gap and therefore misunderstandings. I'll bet when the older man ran up to the tubes and put his hand on Cockfields leg, that was his way of trying to diffuse the situation in his mind. It's like when playing with 5-10 year olds, you chase them or rush up. And maybe he's a grandfather and that's how he plays with his grand kids. Could be a cultural thing where that was his way of joking and break the ice. I think it was self defense and he shouldn't be punished and those kids learned a mighty hard lesson, unfortunately, for the rest of their lives!!

    It isn’t uncommon at all to see individuals snorkeling or doing their own thing along these float trips. It’s also very common to have groups of drunk people come along and start a conversation and ask you what you’re doing, if you’re catching any fish, offer you a beer, etc. Most people are very friendly. Nik was looking for a lost phone. If he grabbed one of their tubes, it was to answer their questions before the current carried them downstream. The water can be loud and swift.
    Nik has no previous record of violence or predatory behavior. These young people taunted and scared him. He was outnumbered. This was self-defense, IMO. Mob mentality. It’s sad and I don’t think anyone deserved to die over it. But they scared him and he happened to have had a knife in his pocket. Everyone needs to watch the videos. These kids (young adults) were way out of line.

Basically, they are just trying to point out that Miu didn't see the kids on the river, run to the store really quick, and buy a knife JUST to intentionally filet a few kids that are talking mean to him.

      BTW... in addition to my first comment.... To be more serious, the Defense is just trying to show that Miu did not have the knife with the INTENT to kill/injure someone. Considering the charges against him are INTENTIONAL Homicide and INTENTIONAL Attempted Homicide... their making a point that he always carried that knife for myriad reasons is a good point to make. I'm not saying that the way he USED the knife on both Issac and Antonio (AJ) wasn't pretty clearly trying to kill them, but it IS effective in showing he didn't TAKE the knife with the intent to kill/injure. Hope that makes sense.

      The Jury are meant to pretend that they don't know anything other than what is established by evidence and presented in the court. The defense is trying to establish that it was normal for the defendant to have a pocket knife, and he didn't have it because he wanted to go stabbing people. The defense lawyer isn't allowed to testify or lead the witness so he can't just say "It's a completely normal tool to have in this circumstance isn't it?"
      Have you mistaken the defense for the prosecutor, because this is a really strange question?

    The way he used the knife on that drunk young man looked like murder, not self defense. He gave zero warning, just slipped it out of his pocket, held it low while maintaining eye contact before striking viciously. He looked like he's had a lot of practice, knew exactly how to kill, and I don't think he ever showed one scintilla of remorse. He also stabbed the young woman, why? There was nothing to prevent him from removing himself from the situation if he felt threatened. He could have reported them to law enforcement. I think he just wanted revenge and the upper hand.

      He had the knife in his hands when the drunk disgusting woman screamed in his face. The lady that got stabbed first, also drunk at the time, said she might have hit him, when she joined her drunk friend screaming in Nic's face. The first drunk woman probably slapped/hit Nic that's why the second lady joined in hitting/slapping. Too bad the part before Nic slapped the blond was not caught in the recording.
      I would also probably try to in fear run and hide after such a traumatic event. Nic's other friend said he looked pale and scared.
      This was self defence, period.

One of the group started filming and called Mr. Miu a perv and that he was looking for little girls. His drugged and drunk friends joined in. Miu was trying to leave and the name calling and taunting got worse. He went back and got the snorkle from the guy filming. He was trying to leave again, and got surrounded by the six young adults. He dropped his phone in the water. He was scared to bend down to pick it up. He went to the other side of the tubes in hopes of getting it, and they followed him. The group of six were taunting him. Then a group of four men from another group joined in with the first group. They were lunging at him, hitting him, pushing him down in the water. At one point they pushed his head into the water.

      Because Nick never asked for help when he was in front of Maddie and pulled his blade out for the very first time, you can see him smile and look up River and wave at his group. He was never in fear he was never uncomfortable that was his second time going down to the teens when you see the video of him with a snorkel in his mouth running towards a teenagers that was the second time he came because before that he was down there and that's when they asked him what he was doing, and that's when they started heckling him as he walked away back to his group. Then he came back down towards them and that's when you see the video of him running towards him and dropping his snorkel on purpose. He planned the whole thing out go watch the video, he purposely drops the snorkel and it starts jumping around the tubes acting weird because he was trying to make it look like there's an altercation going on because when Maddie walks up he says they took my snorkel. So he was going to use that as a reason to attack the teens and then claimed they attacked him and took his snorkel. Because everybody's wondering why he was acting weird when he walked over and was jumping around and grabbing their tubes and after I thought about it yesterday I realized he dropped a snorkel on purpose and then says they took the snorkel and then him jumping around the tubes was him trying to make it look like from far away from people standing from far away make it look like there was an altercation going on with him being attacked and then taking a snorkel. He knows the self-defense laws cuz he's a second amendment advocate so he knew exactly what he was doing

What we do have is her standing right in front of maddy who supposedly got hit but is still standing upright and turned to the right yelling, and in that frame rhiley is leaning toward miu, and miu is falling backwards in the water, which tells me SHE was the aggressor first.

They came to him and told him to leave....it's no on him only to deescalate, it's on both sides of an altercation. they NEVER stopped calling him names, surrounding him, and they were laughing the entire time so not a single one of them was afraid of him. They were so scared of him that they allowed two women and again pointing out the fact that nic was bigger than either woman..well so was jowahn the instigator MUCH bigger than either woman, but he allowed them to get in the mans face....doesn't sound like he was scared of nic at all. it sounds like they were bullying, and intimidating...I mean they did say "you have ten seconds"...no I'm sorry common sense and the video tells us that they picked a guy that was older and out of shape to bully, caused even more to come over and bully him, but that guy was the wrong guy to pick, and they found out the hard way.

    Miu acted just like you would expect someone would act when trying to get away with a crime: he didn't tell anyone else in his group (even as they floated by the people he'd knifed, wondering what was happening and why people were screaming, Miu acted like he was just as clueless as everyone else), he chucked his knife into the woods, and he told lie after lie after lie to the police. He said he "heard that someone got stabbed" and the cops were "looking for someone that fits his description". He said that the teens had taken his knife, then he said that he left his knife in his car, and then he said one of the teens had pulled a knife on him, he grabbed the teen's knife and "poked" him with it. And on and on.
    Miu's defense depends on his state of mind when he was swinging his knife. If he honestly (and reasonably) thought he was in grave danger and had no other choice, then he's not guilty. But if he just got pissed off and lost his cool, he's guilty. He's trying to argue that he was in shock afterwards, because he had just gone through some massive trauma and had been afraid that he was about to die, which he says explains why he took so many strange actions. He'll be lucky if the jury believes him, because every single thing he did afterwards looks exactly like what someone would do who got fed up at some kids being mean to him, lost his cool, shut them up with his knife, and tried to sneak away.

    I think, Nick looked pale ….not “in shock” but, because he realized the magnitude of damages he had just inflicted upon the group of teens… he saw all the blood in the river..as he meandered back to his group…he just killed a child! And injured several people….he ditched his kill knife along the way onto the river shore…This wasn’t just a shaving knick… Nick! This was an unjustified desecration of teenagers at knifepoint … if I just killed someone and stabbed many others, I would be scared too! I probably would have pooped myself too! In Shock? Nick said he had diarrhea and evacuated his bowels in the river water…to say the least!…He was scared and worried about getting caught! Then he was quiet, he didn’t want to involve the other people in his crime ….if he didn’t tell them what he just did.. maybe no one noticed….; )
    because he was thinking to himself…what the heck did I just do?… jeez …How am I going to get out of this situation? That’s why he put on his hat and heavy camo jacket and sunglasses…in 90° weather…to try to change his physical appearance to not match the description of wanted perp, who was “the older guy in black shorts with graying beard and goatee… the person who stabbed the boys and killed Isaac.” He may well have had those pieces of clothing on in the morning, when it was cooler, maybe 50° upon entering the river, but this was afternoon, and it was very hot outside 90° mid afternoon. He was trying to disguise himself and get away before law enforcement caught up to him! Why else would he offer up a statement, in the back of the patrol car, to the sheriff…that “I heard there was a stabbing and I fit the description”… 🤔 like, I hope you find “ that guy” he didn’t say at that time, that it was HE who had the verbal and deadly altercation with the teens. And it got out of hand, someone died by his hands! He was distancing himself from the killing/stabbing once again…It doesn’t make sense because he knew what he had just done , he knew if caught, he’d be in big trouble..yet he was still trying to remove himself from what happened on the river to the kids. He needs to go bye bye for a very long time…IMO

    im a farmer and i got pulled over once the cop asked if i had any weapons i said NO!! he searched me and found my pocket knife and got really really pissed at me and got the other cop who showed up to get pissed at me. as a farmer i do NOT consider my knife as a weapon to me. my dad gave me a knife at 10 years old i was pulled over at 53 i have NEVER used my knife as a weapon BUT a very very handy farm tool

      While I agree with you about knives, particularly, pocket knives, being for utility and not necessarily a weapon, Nicolae Miu checked to see that he had the knife before approaching the young intoxicated group. Knowing that he had a knife should have made him decide to avoid getting close to them period, especially without first establishing some kind of repore from a distance.

    The more I watch, the more I think miu snapped. Interesting comments about his service in the Romanian military. That glazed over look he had in his eyes during the incident. Regardless, the response he had does not commiserate with them using words. Maybe like a PTSD response? It’ll be Murder 2, or manslaughter at the very least.There has to be something odd about the dynamic within that friend group, or at least how they vibe when Miu is around. It’s very strange, their response to the incident.

      My dad carried a pocket knife with him. He used it when he would eat an apple or orange, etc. He would even use the back of it as a small screw driver sometimes.

    I can see we’re all split just about 50/50 on this incident from these comments. There’s a chance the state may have overcharged this case, but here’s my take -
    These boys were underage drinking and drugging - terrible.
    They were creeped out by an old man they thought was high or trippin, and acted like a bunch of mean girls - terrible.
    Others came around to their defense and escalated things - terrible.
    That being said, this man acted like a total creep that day, and if you’ve ever had teen brothers, or raised teen boys, you know that they act like idiots a lot of the time, whether drunk or not. This man ran over to them, stuck his hands in their stuff, touched one of their legs, stayed there after being asked to leave, and refused to just walk away, which he EASILY could have done over and over again. He got physical first, and then it was on. No one pulled weapons, no one threatened to kill him, no one trapped him. He gutted and stabbed several people, and walked away like nothing happened. The most damning thing for me is that he took no action - he should have called 911 himself, should have looked for or approached police himself, tossed the knife, acted like he had no clue what happened, lied to detectives, and played dumb. That is total consciousness of guilt! And that’s why I believe they charged him the way they did. Personally I believe he’s guilty af, but we’ll see what the jury says.

      He walked away from the teen’s who came after him. People who float on the River and go into nature use a knife at times.       You need to learn the facts because that video shows the defendant coming towards them and dropping his snorkel on purpose to make it look like the kids took his snorkel. When Maddie walks up he even tells her they took my snorkel when the whole time he purposely dropped it himself so he was trying to make it look like they attacked him and took his snorkel he was planning this the whole time because this was his second time coming back down to the teens. Prior to that they had the first altercation when the teens asked him what he was doing snorkeling in two feet of water. That's when they started making fun of him and he walked back to his group. Then the second time he comes back to the teens is when the video starts. So when everyone sees him over there on video that was the second time he was around them he literally went back to his group most likely grabbed his knife and came back with the snorkel, then he drops his snorkel near the tubes and starts rummaging around the tubes making it look like there's some altercation going on because he was going to probably start stabbing the teens and then claim they took his snorkel and attacked him but he didn't plan on Maddie and the Carlson group walking over. And then when he was talking to Maddie he pulls his knife out and opens it up and is holding it with that weird smile as of now he's trying to plan on what he's going to do next and how he's going to carry out or follow through with his plan he definitely wasn't in fear and he definitely wasn't defending himself. It was never 13 versus 1 because most of the people there were just standing and watching they weren't involved or participating after he punches Maddie and Dante punches him nobody jumps on him and was beating him up, he got pushed by AJ and he stabbed AJ Tony tries to break it up and he stabs Tony twice and then Tony's friend comes to save him and pushes him by the neck and get stabbed Danny walks over to Dante and the girl and stabs them both never in the video do you see more than one person rat packing them or ganging up on him. Did they push him in the water once or twice yeah but no one punched them with their fists except Dante and that was because he was defending the girl, which by law is self-defense on Dante's part, you're allowed to go to the defense of another person if you feel they're in danger so when Dante punches him that's absolutely legal. And like I said after that and no one ever really lays a hand on him as far as hitting him. He got pushed back two different times and pushed in the water once. And when you land and water you don't get hurt maybe your ego gets hurt, but it's not like someone pushed and face first into the concrete know he landed in nice soft shallow water. Even his wife said he wasn't hurt at all SMH so everyone claiming he's defending himself needs to get a grip and be real with themselves Perry were the teens obnoxious and rude yeah but that's not illegal. If you see rude teens being loud get away from them

    Translator is horrible, he missed a few details the first time the question was answered about seeing the group of people shouting and one of them hitting him (first time he did not translate the "hitting him" part) good thing the layer asked again and Ernesto was able to repeat the statement and the translator actually said it the second time.
