IRONY: Citizen Arrested for Calling Mayor "Fascist" at Council Meeting

  • The right to criticize the government is a pillar of our constitutional republic-embodied in the text and history of the First Amendment. And yet, across the country that right continues to be violated by unaccountable government agents. One particularly blatant example of this abuse happened recently in the small town of Newton, Iowa, where a resident named Noah Petersen was arrested for criticizing his mayor and police department.

    Petersen, frustrated by the behavior of a local police officer and the police department’s treatment of residents, chose to express his concerns at city council meetings during the public comment period. However, instead of being heard-as was his right-he was arrested twice for “disrupting a lawful assembly.” When the city brought these charges to trial, a judge ruled in Petersen’s favor and confirmed that Petersen had a constitutional right to voice his concerns at the meeting.
    Petersen, who has partnered with the Institute for Justice, has now filed a lawsuit against the mayor, the police chief, and the City of Newton. The lawsuit claims violations of his First, Fourth, and Fourteenth Amendment rights, arguing that his arrest was without probable cause and that he was unfairly singled out for his public comments.
    Petersen’s case also challenges the city’s rules against criticizing government officials, asserting that they infringe upon the First Amendment. His fight forms part of IJ’s mission to protect free speech against government retaliation. The lawsuit is also part of IJ’s Project on Immunity and Accountability, which aims to ensure that government officials are not above the Constitution.

    When you arrest someone for something that is protected by the constitution, you have committed the CRIME OF KIDNAPPING and WRONGFUL IMPRISONMENT. If you do it you need to be prosecuted for it.

      Every civil rights violation is a criminal act in violation of our most sacred laws in the constitution.
      Every written warning, disciplinary action, termination, unfavorable ruling in a civil rights lawsuit and video recording are prima facie evidence that a criminal act occurred.
      Ignorance of the law is not a defense.
      Every criminal act (a civil right violation) by an agent of the state, must be met with mandatory jail sentencing.
      Those that are selected, trained -- and have sworn an oath to uphold the very laws that they violate MUST NOT GET A PASS.
      The foundation of our trust in government requires it.

      It happens all over America. It's truly crazy.
      There's a town called Otter Creek that tried doing it to a couple of RUclipsrs, but thankfully the sheriff refused. Of course they were on camera then, and the mayor was hated throughout the county, but still he tried.
      There's another guy who simply visited a town to make a complaint to the mayor about the police chief, and she interrupted him incessantly, then had him thrown out.
      These people are brazen about it because nothing, and no one of higher authority, stops them.

      ​@shelbynamels973 241 is Conspiracy Against Rights. 242 is Deprivation of Rights Under Color of Law. These are both felony criminal offenses that carry penalties upto, and including the death penalty, depending on the severity of the offense. But they need to be federally prosecuted (fat chance).
      The civil option would be under 42 US.C. 1983.

      Happens every day. I saw an 87 year old woman get arrested for being two minutes late to jury duty because she got caught up at the metal detectors downstairs (metal hip). Not a single person, except me (and I was asked to leave and dismissed as a jury, on the spot for it, and threatened with arrest if I continued to "cause a scene".) said a gd word.

    Judges need to start having DAs that bring false charges like this. Put in handcuffs and arrested for contempt of court. It's a willful negligence of duty for a DA to bring such charges forward and they need to be arrested for it when they do

I haven't a clue what it says and I'll say if you're not a Australian constitutional lawyer, neither does the majority of Australians.       Reminds me of the woman in England arrested for thinking about God. They asked her if she was praying in public and she said “yes , but just to myself in my head.” They cuffed her on the spot. She was the only one with no signs and no chants standing across the street from a building full of people that were doing something her religion considered evil. I guess she was just standing there trying to pray it away. But to get arrested for what’s going on in your head is even more ridiculous than this.

      The court system can and does remove Mayors from office for willful misconduct like this
      And before ya latch on to the impeachment part... Again, look up Iowa law:
      "An impeachment is a written accusation against the governor, or a judicial officer, or other state officer, by the house of representatives before the senate, of a misdemeanor or malfeasance in office."
      Not Mayor, so yeah; a mayor is generally removed by the court system or in some localities that allow it; the city council may vote as a council to remove the mayor from office (tho thats still got the check of a court will afterwards rule on whether or not the removal was just and lawful; and may reverse it as has happened before)

If discussing corruption, abuse of power, and fascism, and the people's efforts against these evils was 'pointless', then the citizen would not have been wrongfully arrested, the case would not have been dismissed, and you would not be here trying to discourage engagement. All of these 'actions' prove that citizens speaking out, organizing, and spreading the word when people in authority abuse their power, are, in fact, meaningful and effective.

    Why are other council members not standing up and saying NO ! THIS WILL NOT STAND IN AMERICA !! They need to be held to account as well as the police . Their job is to represent the people who voted for them NOT to stand up for a MAYOR who illegally calls on the police to commit the illegal arrest . When a Mayor becomes a dictator and the police enforce his dictatorship without regard to the constitution we , America are in serious trouble.

      Fascism comes in different shapes and sizes. You don’t have to exterminate Jews to be a fascist. Here’s a hypothetical; a man runs for president, loses in a landslide election, then gins up fear and doubt in the election to the point that his followers are moved to violence. Then he proposes locking up and killing his political opponents and never relinquishing power. This is fascism, and it’s not a hypothetical, the man is Donald Trump.

    Abolish qualified immunity for all government employees. They should carry personal liability insurance so taxpayers don’t pay for their crime. Teach the Constitution to all government employees. Monthly Constitution tests. Maturity and I.Q. tests. Citizen review boards instead of “we investigated ourselves and found no wrongdoing “. Criminal charges instead of resigning with pensions. Sentences for government employees should be double that of the average citizen. General Population while incarcerated.

      I could get behind a lot of that. But monthly seems too often. I'd suggest closer to yearly, but make it random. That way they have to keep up on it.
      Definitely support citizen oversight and ending qualified immunity. So tired of us tax payers picking up the bill for their wrong doing, in the very few cases they are held accountable.

    It should never happen in America, but sadly it is happening more and more. City Council meetings used to be boring things that only a few people attended, but now more people are attending these meetings to voice their concerns, and the city councils are acting more and more despotic if they don't like what they're being told.
