    Hi 👋 I have a question,
    I updated my new address with Uscis and immigration court online. The question is do I have to include the change of address again when filing for motion to change venue?

    • @asylumadvocacy
      @asylumadvocacy  Месяц назад

      Thank you for your question and for being part of ASAP’s community! If you already updated your address with both USCIS and also with your immigration court, then it is not necessary to include the change of address again when filing a motion to change venue. However, if you can print a copy of the change of address that you did for the immigration court, that is helpful evidence to include with your motion to change venue.
      You can find more information about how to file a motion to change venue (to request to transfer your case to a new immigration court) here: help.asylumadvocacy.org/faqs-moving-traveling/#how-to-file-motion-to-change-venue

    Hello, thanks for a helpful video.
    Quick question. If you have spouse who is included in the case. Do I just need to file one motion to change venue form for both main applicant and his/her spouse or each need a separate motion?
    I understand that each one needs to file form EOIR-33, but what about the rest. Could you break it down please
    Thank you!

      Thank you for your question and for being part of ASAP’s community! For family members in a joined case in immigration court, one Motion to Change Venue listing the names and A numbers of all family members is sufficient to request moving the case to a different immigration court. You are correct, however, that each person should submit an individual EOIR-33 to update their address.
      You can find more information about changes of venue here: help.asylumadvocacy.org/faqs-moving-traveling/#how-to-file-motion-to-change-venue. You can also find legal help here: help.asylumadvocacy.org/find-help/. If you have more questions, you are welcome to email us at .

    Hi! Related question - what do you do if the name that immigration court has is incorrect. For example, they list an individuals middle name as their first name and their first name as their last name?

    • @asylumadvocacy
      @asylumadvocacy  Год назад

      Thank you for your question and for being part of ASAP’s community! Usually the simplest way is to inform the judge of the mistake at your next immigration court hearing. You can also send a simple written letter to the court that includes your A-number (the identification number used for your case in immigration court), your correct name, and the incorrect name as they had it listed. But then you should also confirm the correction at your next hearing. In the meantime, be sure to list your correct name on any forms or applications that you file with the court or send to USCIS. They will be connected with your case because your A-number will not change.

      Thank you for your question and for being part of ASAP’s community! To the best of our knowledge, it is not possible to delete documents and photos that you uploaded to your USCIS account once you submit an application. However, you can upload a letter to USCIS (include your name, address, and A number on the letter) explaining what happened and listing the specific documents that you request not be considered as part of the application. You can upload that by going to your USCIS account, opening the I-130 application that you submitted, and clicking "Add Unsolicited Evidence". At that same tab, you can upload other documents or photos if useful for your case, like to replace the ones that you uploaded by mistake.

      Thank you for your question and for being part of ASAP’s community! Even if you have an upcoming court hearing, it is possible to request to move your case from one immigration court to a different one in a different state. This process is called a Change of Venue. You can learn more about that here: help.asylumadvocacy.org/faqs-moving-traveling/#how-to-file-motion-to-change-venue.
      However, it is very important to remember that UNLESS you file a motion to change venue with the immigration court in Illinois and the immigration court approves it, you must attend any scheduled hearing in Illinois even if you have already moved to Pennsylvania. You may want to search now for legal assistance in Pennsylvania. The following webpage will help you to locate possible options, including free or low-cost legal office, near you: help.asylumadvocacy.org/find-help/. Thank you for your follow-up question. It is best to update your address as soon as possible rather than waiting for the hearing. You can do so immediately online, or by printing and sending a form through the mail. Please see instructions for both options here: help.asylumadvocacy.org/faqs-moving-traveling/#change-address-immigration-court
      But yes, you can also tell the immigration court about the address change, and make your request to move your case (called Change of Venue) in person at your upcoming master calendar hearing. Bring proof of your new address in your new state and be ready to explain to the judge why it would be difficult to continue having court in Virginia (example, the expense of travel). You can learn more about master hearings in immigration court here: help.asylumadvocacy.org/faqs-immigration-court/#first-hearing.

      Thank you so much. The EOIR-33 brings space for just one address. That's why I was asking because I didn't know which of both was supposed to be put there. There's no need for a chance of venue, because it remains under the same jurisdiction.

      @@gregorymyrtil8857 Thank you for your question and for being part of ASAP’s community! The answer depends on whether you are updating your address with ICE attorney’s office as part of updating your address with your immigration court, OR if you are updating your address with an ICE field office because you have a supervision program with them.
      If you are updating your address with ICE attorney’s office, you can find the contact information here: www.ice.gov/contact/field-offices?state=All&office=12&keyword=south+dakota. If you are updating your address with ICE field office, you can call the office. You can find the phone number here: www.ice.gov/check-in#Locations.
