    Do the Police in Wales have a dislike of people legally owning firearms? I remember back in the ‘80s my application for a firearms permit being rejected by the Police in South Glamorgan on the grounds that they did not believe I had any place to securely store the rifle I wanted to purchase, even though I was a serving member of the Royal Air Force and the rifle was to be stored in the station armoury along with several hundred military rifles.

    So do you refuse a voluntary interview? how does one get around the caution catch 22 ?

    • @kt5661
      @kt5661 Месяц назад +2

      You don't have to accept a voluntary interview or a caution. Say no to both? A voluntary interview will be to get you to say something that implicates yourself and a caution is designed to get you to accept responsibility without them having to prove anything. The problem i see in this case is its difficult to understand how one could shoot oneself with a rifle? Although the burden of proof is on the Police to show that the shooter is a 'danger to the public' i can't see how a reasonable person could conclude anything other than some sort of negligent act by the shooter and hence the Police accusation that he is unfit to hold a certificate.

      Hi there. No, they’ve misunderstood the caution thing. If someone’s interviewed by police, they are cautions, a bit like the United States Miranda rights, but obviously slightly more restrictive than the USA. This is not a simple adult caution and having been cautioned in a voluntary interview Would not count as a police caution on police system. It’s not a catch 22, they’ve just not understood it.

    07:49 is incorrect. You are "cautioned" about what you say during an interview being used as evidence or not saying anything being an inference at court. This is different to being given a criminal caution which is a low level criminal case disposal method like an official warning.

    Funny when in 2013 Christopher Parry, of Cwmbrân, shot and killed his ex-wife in Newport then turned the gun on himself.
    It was said that it was a pre-meditated event at trial.
    Mr Parry legally owned x3 firearms.
    Prior to the shooting dated 07/08/13, Police had been called to the martial home of Mr & Mrs Parry, upon numerous occasions.
    Family, friends and neighbours have confirmed that they called police over concerns to Mrs Parry’s safety through domestic abuse.
    However, police failed to correctly log the incidents and treated them as hoax calls or noise complaints.
    Therefore, in the instance where his guns should have been seized, they were not.
    Seems like Gwent Police can’t get it together here, they just ruin lives with their poor handling.

    Hi there, thank you for making the interesting video. I think you’ve misunderstood the caution in relation to a voluntary police Senn or any interview. Being cautioned in an interview just means that you do not have to say anything but it may have to defence if you fail to mention when questions something with you later, you do say we take an evidence. This is not a police caution is in a sense of a formal police adult caution. The latter relates to someone admitting a criminal offence and accepting a formal caution that is recorded on the Police national computer and other systems as an out of court disposal. You don’t accept a police caution just by turning up for an interview. Not sure if that’s helpful but you can Google the police and criminal evidence at 1984 and you might want to have a look at a caution +3.

      I wouldn't go that far as it really depends on the nature of the ND or serious Malfunction and in the USA known as an AD (accidental discharge) stupid if you ask me as objects can't have accidents they are mechanical and malfunction and people are negligent.
      There have been a few cases of the new sig pistol having serious malfunctions with American police and you can't blame the officer's weapon handling in these cases as they won lawsuits against Sig.
      But If he had a history of NDs and serious malfunctions resulting in death injury or property damage I would speculate he can't keep his shit in a safe direction and mark and avoid for sure.
