  • During the defamation trial on Monday, Intellectual Property Consultant Doug Bania took the stand. Bania testified that the Google search results for Johnny Depp dramatically changed after Amber Heard's Op-Ed in 2018. Bania utilized Google analytics and trends to determine what Google users were seeing before and after the Op-Ed. He also spoke about changes in Depp's Q score, which is an industry-standard for measuring consumer appeal.

    Aside from the trial, this is a great lesson in how to handle manipulation. Pause and think before answer, don't give into their pushiness in answering yes or no, keep your answers short and concise, and reword their question in your answer

    If they want an answer let the people speak. They ask people to explain their method, then cut them off repeatedly. Her team are rude and agressive. I hope the jury sees how manipulative they are being.

      @@Kevschwa It's called badgering the witness, if they present a question the person has the right to respond. Just because the answer doesn't come out to be favorable for their client doesn't mean they have to be disrespectful.

    Many incidents were harassment in nature, interrupting witnesses, reflecting impatience, aggression, and a whole host of defensive behaviors. This team will need their own PR team to rebuild their reputation after this case.

      I would have a really hard time if I was on this jury. AH lawyers are so rude and argumentative with witnesses and act like petulant little children when things don't go their way.

      Not just that, but the way the lawyer asked the questions i.e. worded weirdly , vague like "separate out" which I still don't know what that really means with the context it was being used, not to mention very lengthy so that the witness has to ask him to repeat it multiple times just to understand what was being asked, is a cheap trick to make the witness look unintelligent and therefore anything he/she has to say can't be trusted. Very cheap trick.

      @@YWFilmProductions even if they didn't watch the trial when choosing a lawyer you'll do some background search and the internet already has a rather negative opinion about them which would be easily visible in a search.

    These two teams of lawyers are a good example of how the truth is easy to say (JD lawyers ask one question, let the truth easily spill out) and lies are difficult to frame as the truth (AH lawyers are constantly taking things out of context and trying to manipulate information and understanding). Real stark example.

      It seems that way because, so far, the case has been Johnny's case in chief. All the witnesses were called by JD's lawyers on direct examination so they ask open ended, non-leading questions and AH's lawyers have been doing cross examination, where you ask leading questions and try to discredit JD's witnesses. I'm a lawyer and I think It's interesting to hear all these comments from non-lawyers who are really put off by AH's lawyers. They're doing what we are all taught do on cross, and sometimes, they do a really good job. Sometimes, JD's witnesses are being evasive and not answering the questions asked of them on cross, so the attorneys are totally right in directing the witnesses to answer yes or no. At this point, it seems like the lawyers are sick of the witnesses not answering questions so they're getting tougher on them when they give evasive or non-responsive answers.

      @@markvillalobos2355 ah's attorneys have used the same intimidating & manipulating strategy since day one. ah's attorneys finally stopped interrupting witnesses testimony while JD"s attorneys questioned witnesses. The interrupting behavior started with remarks like, "lack of foundation", "leading the witness" and "irrelevance" at every question. All the ah's attorneys were allowed to bagger, harrass and demean professional and expert witnesses. Because ah's attorneys do not have evidence to support ah's allegations, all her team has "in their pockets" is to use smear tactics towards JD and JD's witnesses.

      @@markvillalobos2355 not sure - I agree it tends to be the way that it SHOULD happen, both sides interviewing witnesses, but it still seems stark today watching AH psychologists opinions - they let her tell long winded "truths" about how she's qualified and where she works. Which is obviously true. Then they jump about trying to make it seem she's corroborating their opinion, taking stuff out of context and manipulating understanding (like repeatedly mentioning another doctors opinion). There's always an untouchable, unquestionable middle man in their testimony.
      Whereas the actual truth is simply explained with - all the doctors reports were based on what AH personally said/reported. She could have lied and invented the entire psychological trauma from JD, and acted all the accompanying reports surrupticiously that apparently describe IPV without openly reporting it. Easy to explain the truth.

    One thing I can say about these witnesses when they’re being cross examined is they have great discipline. It would be extremely hard not to set them straight when they try that fast, slick talk. They’re very condescending, pushy, and at times downright disrespectful. 😤

      I could easily be set off telling them anything. Most witnesses are mature and seasoned professionals, poised and measured, just like JD. Would be interesting to see what witnesses the Heard team will call on. They may just be similar to the rest of their own team lol.

    To me this is one of the most important witnesses. It's what this trial is about. And his research proves that Johnny's public image was severely damaged after the allegations. Also, let it be known that he did his job in a professional way, letting the facts speak for themselves.

      Right? Did you notice how they didn't lead with questions like...what is your hourly rate? how much are you getting paid to be here? etc. or really question his certifications or qualifications. They know. They pushed hard on his analysis and tried to box in his answers/analysis, but I don't think it really worked. The spikes after the op-ed only show that it further damaged his reputation. Searches kept going down and the spikes that did occur were negative.

      It IS what this trial is about. Not easy to remember that with all the other nasty stuff coming up. I wonder if AH even thought about the consequences that may occur when she wrote the op-ed. Details on mental health, drugs, alcohol, other disgusting behaviors all out there for the world to see. Is this how she wanted to be known across the universe? yikes.

    I love how annoyed her lawyer seems to be about having to do his actual job. The huff and the slight eye roll when he had to publish some evidence was so incredibly childish. The way they’ve handled this thing is so poorly done, I hope they know their reputations will likely never recover from this.

      I was impressed at how well the witness kept calm. He and Isaac are the only witnesses I can remember who kept asking for the question to be repeated. Smart!

      It's always smart to be very clear what the question is so you can answer the question asked. A lot of times in life people will answer a question thinking they know what is being asked, but don't end up answering the question asked. This becomes a problem in court because the answer you give can ruin your credibility. As we saw here, the witness was allegedly asked the same question as he was in the deposition. The lawyer believed the witness didn't give the same answer and confronted him about it. The witness was on the ball and pointed out the question he was asked on the stand was not the same question he was asked back in March. By doing that, the witness maintained his credibility.

      It’s intentional, in my opinion, because the witness having to repeatedly ask for the lawyer to repeat the question and the lawyer repeating it with an air of annoyance will effectively undermine the witness’s credibility. They’re incredibly aggressive and almost hostile to the witness, and the witness is doing an outstanding job maintaining his composure and professionalism.

      You just have to believe the holy bible is the true word of God. Believe Jesus is the Savior of the world and that he suffered for your sins. Forgive your enemies. Do not be ashamed of the gospel and stand up for your belief. When you end up sinning at some point get back up on your feet and ask Jesus to forgive you. Humble yourself to learn more about Jesus and to do better as a Christian. Do your best to live by his commandments. Even when things get tough or don't go your way, keep striving for Jesus and you will be accepted into heaven.

Any lawyer/barrister who doesn’t carefully word questions to gain a response that’s favourable to their arguments, or try and fluster the opponent’s witness would be completely useless in a courtroom. They’re all masters at manipulating meaning and context.

    the defense really embodies the term defensive. their level of unprofessionalism has reached comical levels atp. i find myself laughing at how easily shaken up amber's lawyers get when witnesses don't answer their questions the way they want. not to mention the constant snapping at witnesses, pouting, whining. they really should have more composure than that

    it's better for them if it's a simple yes or no answer they can twist it in their favour more easily, a more detailed answer to the question can damage their case and their defence, the irony is they are doing it too much, while they try and protect their defence they make it look like they are hiding things and not wanting information against them coming to light, in turn it makes them look guilty and the Jury will notice this at least when I was in a Jury I noticed when lawyers were losing....

      haha I just commented on his remarks at 10:02. No tact/manners/professionalism. It's either just extreme nerves or they never picked these skills up while interning or early on in his career. Attorney's that behave like this often get a bad reputation when working with other firms, insurance providers, judicial assistants, court reporting firms, etc.

    Also another thing I've noticed about these clown lawyers is that they ask loads of questions that lead no where. Surely their task is to get the jury to rethink what they've been presented by Johnny's lawyers? To get the jury to swing more to their side? They ask a long string of questions and you'd expect them to lead up to something that will make you think, "oh wow, didn't think of that. " Their questions lead to no where. They have no point to them. It's bizarre AF. Absolutely moronic.

    These lawyers are nothing but defensive at every turn. It’s quite telling that they’re just trying to claw any semblance of continuity but all they’re accomplishing is diminishing ambers defense. In my opinion she never had a defense.

    As someone who works in statistics, a 2 point movement in a Q score is absolutely statistically relevant. Also, why are they harrassing the poor guy? He is just providing his objective professional opinion.

    I love how they are ignoring the fact that she admits to therapist she did drugs at Coachella...😂 Mushrooms, MDMA, etc... Just glazed right over it 🤦‍♀️ I hope the jury was able to read it before it was removed from the screen. Ugh.

      In the nurses notes at 40:51 it stated that AH admitted she has an addiction to cocaine and liquor. Her lawyers keep bringing up JDs drug use but their own client has the same usage lol

      I remember when they were being mean to that witness and they claimed AH did not do drugs and was not the one who was sick/throwing up. He claimed it was her pregnant sister that needed the medication from the pharmacy and water

This is a defamation trial adn jd's team needs to prove ah's op ed led to jd losing jobs and money, ah's team needs to instill serious doubt in that allegation.

    I really dislike how rude and abrupt Amber's team are towards witnesses / experts even if the witness is talking too much or misunderstanding the question could they not at least have some common decency to politely cut them off or ask them again ?       She's letting the lawyers handle the opposing team, if they display rude behavior with no inject from the [plaintiff's] team, it's intentional and allowing them to do the work for them. Ie, their behavior speaks louder than consistent injects from the lawyers team or the judge. The defendents behavior is doing damage to their own case, the jury will likely see it as its more obvious than objecting.

      it's better for them if it's a simple yes or no answer they can twist it in their favour more easily, a more detailed answer to the question can damage their case and their defence, the irony is they are doing it too much, while they try and protect their defence they make it look like they are hiding things and not wanting information against them coming to light, in turn it makes them look guilty and the Jury will notice this at least when I was in a Jury I noticed when lawyers were losing....

      @@zowezel2002 when you are on a Jury you have no Bias so the people on this Jury will have no strong feelings in favour of either of them I remember it took me about a week to warm up to one side in this case it won't be any different the Jury members will be people that don't hate or love these celebrities so their decision will be based completely on what evidence they are given so the outcome is actually incredibly difficult to predict so far depps witnesses have been in his favour but this case still has weeks to go and amber's team could pull a curveball it could really go either way not to mention that this is an American court and I am from Scotland so there are differences some large some small but easy enough to work out

      Questions that are designed to get a yes or no answer are called closed questions, a technique taught to sales staff to help them lead a prospect into the position of agreeing to buy whatever they're selling. The "you'd agree that....correct"? that the team is using is another sales technique to box someone in to agreeing with the salesperson's point of view. Both limit elaboration by the witness and can be abusive. See the difference when JD's lawyer asks open ended questions.

    I think it's wrong to allow the attorney to end each question aggressively with 'CORRECT?' I think it gives a psychological advantage, as the witness may go on to say, no that's not correct...but the aggressively spoken 'correct' could influence the jury members thinking. Also, it's not giving the witness time to think properly, pressures them to answer quickly. I'm happy to see witnesses coping well and not being rushed, but not everyone could cope with this aggressive form of questioning without getting flustered. I'm really surprised it's allowed...the 'correct' bit I mean.

      One of the first things they teach you when you begin to involve questionnaires in your research is framing questions correctly so that there’s less possibility of bias in someone’s answer - e.g. “How much did you enjoy using the website?” would be incorrect, and you should frame it more like, “How did you feel using the website?”. The fact that manipulative framing is being allowed here (in an arguably more serious situation) is completely shameful.

      This is how you cross examine witnesses. I don't like ending cross questions with "correct?" or "right?" as I prefer just making a statement that the witness has to affirm or deny but sometimes, they don't answer because they're not sure the question is done or that an answer is necessary because you say it as a statement. Normally, when lawyers do cross, they walk up to the witness and can use body language and other cues to get the witness to answer a question, but these guys are standing at the podium and need a definitive cue to tell the witness that it's time to answer. This has been especially hard during the pandemic when doing trials on Zoom because witnesses have a nice little buffer of space they can hide in and don't feel that physical pressure while testifying. They don't feel the tension in front of them and are more detached. They can just sit there and ignore you on the screen. Badgering is when you have gone beyond making your point and ask the same question to try to harass the witness. This is a high bar and I've never seen anyone make this objection. I've yelled at witnesses during trials, including a Chicago detective in a murder trial, and it's all been proper (and sometimes effective) cross. I've also seen other lawyers yell at witnesses and it completely backfires in front of a jury, so it isn't always a good idea.

    Being hostile towards a witness to make a point is one thing, but having small cynical laughs at the end of every repeated question or remarks is pure rude and unprofessional. You can feel that the defense layer was extremely nervous and tried to intimidate the witness, which made me to believe that they literally had nothing on him (but knew how damaging are the long and coherent explanations) and felt the need to bully the witness and the jury into confusion.
    The more I listen from day to day, the more I'm realizing that Amber's defense has literally NOTHING to fight against the Johnny's well prepared team. A lot of wasted court time and continuous admissions and proves that Amber Heard is an extremely mentally ill woman who has used everything and anything to satisfy selfish and disturbing urges. Hope there's someone in her life left who will help her to seek a much needed help.

Do not be ashamed of the gospel and stand up for your belief. When you end up sinning at some point get back up on your feet and ask Jesus to forgive you.     AH lawyer’s aggression has got to be intentional because the witness having to repeatedly ask for the lawyer to repeat the question and the lawyer repeating it with an air of annoyance will effectively undermine the witness’s credibility. They’re hostile to the witness, and the witness is doing an outstanding job maintaining his composure and professionalism.

    Wow Johnny’s list of medications needs to be massively reviewed. Too many different antipsychotics all being taken together, the lithium is especially causing increased risk of dangerous side effects with the other meds on there. Plus interactions from illicit drugs and alcohol. He must feel absolutely rubbish. He probably doesn’t remember to take these every single day so levels dropping out would make him feel so sick. I hope someone reaches out to him to do a huge medication review and overhaul.

    Man I thought Elaine Bredehoft and Ben Rottenborn were awful but Adam Nadelhaft is by far the most aggravating attorney she has. His voice is loud but trembling at the same time. And hes so snippy. I don't think he became an attorney to help people it sounds like he has alot of past trauma and is trying to prove how successful he has become.

    Seeing his facial expressions throughout all this just breaks my heart, I can see all the things running through is mind. All the fun memories of going to the children's hospitals dressed up as Jack Sparrow, all the fun and positive things he did with his family and friends, and then thinking about how he was ostracized and his kids were getting all this harassing information and all the terrible losses he endured during those years.
