- On April 22nd, 2023, an officer pulled over a vehicle for speeding and an expired registration in Elgin, Illinois. The officer noticed an odor of alcohol coming from inside the car and empty shooters in plain sight on the passenger side floor.

Truth. What you speak to is this new victim culture the left has been brewing for the past decade or so. It's a peculiar place in time when we as Americans don't compare the good work we do with one another. Instead we see how many reasons we have why we shouldn't do what's right, work hard and follow the law because of a skewed view of entitlement. It's nearly spoken out loud "I can't do [this - that - these - those] because I'm disadvantaged in some way and the world owes ME just by me being here!" So many opportunities are squandered by young people these days because they give up on life and resort to influential idiots who will just lead them down the wrong path. Not paying insurance because they get away with it for so long, not paying registration, breaking traffic laws and ultimately causing trouble when it's time to pay the piper is a sad reality that multiple generations are being taught as the way to be.

@@parafraceren It's a question based on circumstantial evidence and is part of their investigation you can choose not to answer questions at that point. Once they have been placed under arrest they have to be given miranda if they are going to be asked questions IN ADDITION to what the police have already witnessed as crimes (open containers in the vehicle for example or the smell of alcohol and glazed eyes)

I'm a lawyer though studied in the UK. I have thought about this. One obvious solution would be making false / baseless / reckless claims of racism explicitly actionable under defamation law. In fact, such claims should be considered "defamatory per se" which means that you do not need to prove actual damages. This would make such suits easier faster and cheaper.
A separate issue is the epidemic of suspects/citizens racially abusing cops. This is actually explicitly illegal in many countries. Eg in Belgium where I am now, hurling racial abuse at cops is an arrestable offense and subject to a EUR 3,000 fine.

Not American, but have heard miranda rights on tv enough times to know that: why wouldn't a cop want themselves speaking them on bodycam from the moment that they start the arrest? I'd have thought 'You are under arrest...' would happen before 'get out of the vehicle'.

1. an officer can ask you to step out of the vehicle for "officer safety" assuming it's a lawful stop (in this case is was, she was speeding and expired reg) and it's not a violation of your 4th amendment rights according to the supreme court Pennsylvania v. Mimms, 434 U.S. 106 (1977)
2. miranda rights only have to be read if the cops intend to question you and then use that against you in a court of law. Since they were not questioning her they had no reason to "miranda" her. It is a common for folks to think that the cops have to read you your miranda rights before or upon arrest. This is simply not true. Many people get arrested and are never read their miranda rights. Miranda v. Arizona, 384 U.S. 436

I use to dislike the police but I've been watching these body cam videos for a while and now I have respect for the police officers they deal with so much
I'm somewhat of a lefty and felt the same for a while... but when you start watching a ton of these vids you realize the cops are actually *far too patient* the majority of the time and they deal with so much insanity. I've seen just a few vids that definitely display some corruption and profiling, but the vast majority of the time, cops are patient af with psychos who don't deserve it, and other times I've seen some super professional de-escalation and genuine passion on full display.
In short, seeing so many body cam vids definitely gave me a new respect for the police...

No doubt, but damn they make me look so good when I get pulled over! I've gotten out of beaucoup tickets by just being cool, honest, respectful and having my documents ready when they walk up to the window. People like this suck, and I'm sorry they have to deal with that shit, but they've certainly helped me get out of many a citation!

In TX, it’s not exactly an extra class or anything, but there is a required curriculum that all students must watch a video on proper police-citizen expectations during a traffic stop before they can graduate. It includes 1) duties of officers, 2) citizen rights, 3) proper behavior during interaction, and 4) filing a complaint/compliment.
