He bought it from a guy named Dennis Montgomery, who'd previously sold fake data to both the DOD and the loony Arizona Sheriff Joe Arpaio. Lindell bought him a $500,000 house in Naples Fl., where he supposedly immediately had a stroke, and therefore was unable to appear at his symposium to defend his data nor to answer any questions about it. Montgomery's own lawyer referred to him as "a con man".

I'd love to know how Lindell can bring this to court. The whole purpose of arbitration, the explicit reason companies put arbitration requirements in contracts, is to avoid court. It's called "binding arbitration", not "accept it if you like it arbitration".
You have the right to bring anything to court. Unless Lindell has something really big--like proof that the arbitrator was corrupt--the court will probably toss his case out on a motion to dismiss.

If he had agreed to binding arbitration, then a court will most likely point to that agreement and tell him to pay up. If it wasn't binding, he might be allowed to proceed, but he will just be delaying the inevitable.
