That was a fun, enjoyable audit. Scary that I am so ancient that I can remember the police driving around in Austin 1100 and 1800's if you were lucky. @Daniel Weston No, when I am in my car or in my house I am not playing music that can be heard by any member of the public who happens to be passing by. If I, as did the security officer, decide to play my music via a loud speaker whereby any member of the public can hear it then that should constitute a public performance. Of course, I'm happy for you to correct me with cited case law on this issue and not just opinion.
@@MSM101Whilst each case, if taken to court, would be considered on its own merit, there’s virtually no chance that this would be considered a public performance. If I had to money on the table, I would bet ‘definitely no chance’. The ‘public broadcast’ argument would most likely fail immediately for 1, 2 and 4. It could be argued that point 3 applies here, but even if it was successfully argued the intention was for it to be heard by a wider audience, this doesn’t make it a public broadcast for commercial purposes. For example, if I saw the BBC recording a radio talk-show in public, and I walked past deliberately playing music loudly on a portable speaker, with the intention of the public and the BBC broadcast hearing the music, that would not be a public performance by me, even though my intention was for it to broadcast widely via the BBC radio programme, therefore a public broadcast license would not be required by me. As far as the broadcaster is concerned (the BBC in my example, and AB in the case of this video), the playing of the music is incidental and would come under “Fair dealing” in relation to copyright.
