The concept of the veto had always seemed unfair to me. Then what is the point of having these organizations if only the word of five countries matters?
don't keep on complaining, but work your way up to the top position and see for yourself if you still can maintain your integrity or join the others to be corrupted
Over 75% of the countries in the UN have acknowledged the State of Palestine as a country. The US's veto alone has stopped the State of Palestine from being approved as a full member state of the UN. If a US president vetoes a law passed by Congress, a 2/3's vote - 66% - of both Houses of Congress is enough to override their veto. Seems there should be more than enough votes to override Israel's ... I mean the US governments... veto in the UN. The US government has turned into Israel's lapdog. The majority of them seem to be racist enough that they are more than willing to support the Zionists - Jewish Supremacists. Racism has no place in America ... especially in the US Government. - United Nations General Assembly Resolution 3379, adopted on 10 November 1975, "Determines that Zionism is a form of racism and racial discrimination"
There should be right? But those big five wouldn't allowed it, I think. I mean, the decision is their's to make. Anything that would put their dominance in jeopardy will vetoed out in seconds.
there is a way - calling an Emergency Special Session of the General Assembly, which overrides the Security Council, where if a majority of all nations vote on something it gets implemented. It has happened about a dozen times in the past and resulted in many concrete steps including the formation of the UN Police Force (peacekeepers), the UN Command, and direct peacekeeping force action in the Suez crisis of '56, economic & diplomatic sanctions on South Africa in '81. Currently, the ESS on Palestine-Israel and Ukraine-Russia are active but nothing concrete has been proposed yet even though the UNGA is well within its rights to send in a UN peacekeeping force to ensure ceasefire compliance in Palestine/Ukraine.
Isn't there a saying that goes, 'Justice delayed is justice denied'? Given that it can take an indeterminate number of years for a court to render a sentence or order, can we truly consider these courts as entities of justice? 🤔
They said about the veto, which is used by countries. But in this case there was direct threat to the members of ICC by US of personal sanctions. Unfortunately they didn't say anything about that.
The system is inherently flawed when it is made to have a few coutries that are above the law. And then these few countries are responsible for the majority of international law violations, but go unpunished...
Abba Eban (former Israeli foreign minister and and the first Permanent Representative of Israel to the United Nation) once said that: “International law is the law which the wicked do not obey and the righteous do not enforce” This is the international law.
It is an attempt for a change. An attempt that is failing at this point because the world's largest governments don't want to abide by it, won't enforce it, ... and they all have veto power at the UN.
The era of application the international law only for African, Asian, Latin American has ended now. Europe, west defacto, and their allies enjoy exemption over the ages. It couldn’t be run as it is now.
A lot of resource persons you've interviewed that international law has been critical in the persecution of criminals, especially for persecuting Nazis since WW2. But even then, the Japanese on the other side of the globe got away with it. Some were persecuted in the Tokyo Trials, but most were granted amnseties. Their minister of commerce and munitions even became Prime Minister, Nobusuke Kishi, while his counterpart in Germany, Albert Speer, was imprisoned.
Thank you for this. This is a clear depiction of the structures and current constraints on international law in a very concise presentation. Very much appreciated.
i love Start Here -Al Jazeera (Sandra is so good at this) i feel, as many have already pointed out, that giving countries the veto right is actually counterproductive seen from ICJ perspective. it is time the veto power of privileged nations is revoked.
When veto powers exist in a system like this, the criminals can get away with any crime and there's nothing anyone else can do about it through those courts. Which means that the law is meaningless and doesn't apply to countries that those with veto power don't want it to apply to.
The ICJ judge saying that countries ignoring judgements is very rare is wild. Then using an African conflict as an example of the efficacy of the ICJ is really insulting the intelligence of viewers.
Try applying International law judgements on a Third World/African country and see how quickly it is successful. Case in point, the Uganda versus DRC ruling.
Customary Law amounts to agreeable unwritten standards governing international status quo -- hence, customs (the culture) to which international trading partners adhere.
I would have liked to hear more about the US and potentially other western countries flouting ICJ and ICC rulings or otherwise interfere with the process. I was really surprised when I checked afterwards and saw that this video was done by Al Jazeera.
No. You have to join the ICC. Countries like the US and Israel did not join the ICC. - "On 17 July 1998, the international community reached an historic milestone when 120 States adopted the Rome Statute, the legal basis for establishing the permanent International Criminal Court. The Rome Statute entered into force on 1 July 2002 after ratification by 60 countries." - an ICC website - 9/11 was 9/11/2001 - "The Bush administration told the CIA in 2002 that its interrogators working abroad would not violate US prohibitions against torture unless they "have the specific intent to inflict severe pain or suffering", according to a previously secret US Justice Department memo released on July 24, 2008." - wiki - The claim is that the US couldn't join the ICC because it would violate the US Constitution, but this seems to be a flimsy excuse to avoid the President and high ranking officials having to appear before the ICC for committing crimes against humanity.
ICJ verdicts are valid when its in between DRC and Uganda But not in between an influencial state and other. Now , what is the point of its existence if law can not save the oppresed .
in Kenya we say "Sheria ni ya wanyonge/maskini"...."the rules are for the weak/poor".. so the rich and powerful just buy their freedom.. all in all, the police is a tool for the govt
ICJ and ICC have done a good job already. It's like you have a good law system but dont have any law enforcement situation right now. Nobody are willing are has the power to go to the conflict zone and make those comply.
Once you stop thinking from a fairness perspective and realise everything runs off power, it all starts to make sense. I used to wonder why the US is allowed to get away with such and such international crimes and thought naively that they should be punished, until somebody plainly put it - "who's gonna stop them?"
Just like in the case of Chile no one wanted to touch Pinochet because of the US. It had to be a spanish court independently and the ICC never did a thing.
But they should be. And, in the case of the State of Palestine: - "The ICC accepted “The State of Palestine” as a member in 2015, a year after the Palestinians accepted the court's jurisdiction. The court's chief prosecutor at the time announced in 2021 that she was opening an investigation into possible crimes on Palestinian territory." - pbs org - The ICC doesn't have jurisdiction over crimes committed in Israel or the US, but they do have jurisdiction over the crimes that these countries commit outside of their countries .... like inside the State of Palestine for example.
So ICC arrest warrant is very much like a lucky packet, it all depends on circumstances changing in order to enforce the warrent. Do these people even listen to themselves?
Why is there no application to the ICC court for arrest warrants for Netanyahu, Biden, Olaf Scholz and Rishi Sunak for committing genocide and aiding genocide ?
A law is made possible by the ability of the law maker to forcibly compel someone to follow the law. If that's not possible, then the law is meaningless.
My opinion - Int. Law and the UNSC veto power rule are simply nonsense as there are more countries in the UNSC than 5. I hope to see a UNSC with no veto power but equal rights of countries to vote in resolutions of issues as it relates to the international community.

The concept of the veto had always seemed unfair to me. Then what is the point of having these organizations if only the word of five countries matters?
Because money talks
A rigged system to maintain their (the big five) dominance.
It was part of the deal to form the UN after WW2. The US was big dog after rushing in toward the end of ww2 to help, and wouldn't join without it.
At this point the only thing they can agree on is in defense of an alien invasion 😂
Especially when those five are corrupt. Like the one which is run by AIPAC
Justice is whatever the people at the top says it is. We people at the bottom suffer from it.
don't keep on complaining, but work your way up to the top position and see for yourself if you still can maintain your integrity or join the others to be corrupted
As a student of law, I commend this presentation by Al Jazeera. Very comprehensive and balanced.
Way more balanced than I expected
Agreed as a fellow law student
I initially read it as condemn 😂
Why is the country being investigated allowed to veto in the first place!?!?
Because they have (not cash) nukes
International law ,only when is applying to US interests
Not just US, but other 4 veto power too
Apparently international law is like putting a Please Wash Your Hands sign in public restrooms. Makes you aware of a situation but does little else..
Like always
There should be a way to override a veto.
And countries named in a dispute shouldn't be allowed a vote; it's a legal conflict of interest!
Over 75% of the countries in the UN have acknowledged the State of Palestine as a country.

Ah yes, because just because the un passes some kind of resolution the us or China or Russia would comply with it

As always . . .an excellent analysis of reported facts. Much gratitude!
The level of disrespect has reached a point where some view international laws as disposable as toilet paper 🧻.
because they pretty much are, for big powerful imperialist states at least
Abba Eban (former Israeli foreign minister and and the first Permanent Representative of Israel to the United Nation) once said that: “International law is the law which the wicked do not obey and the righteous do not enforce”

An attempt that is failing at this point because the world's largest governments don't want to abide by it, won't enforce it, ... and they all have veto power at the UN.
A myth perpetuated by imperialist powers to legitimize themselves and enforce their standing
