    As a fairly new PA resident(formerly CA then MD, now PA), I'm actually pretty plesantly surprised at this audit. Not a single mention of the firearm, not a single mention about not filming, just the one mention of the "restricted" area which is semi-reasonable.

      Why is this idiot insisting taxpayer money be wasted on signage? It's only lot lizards like him that want to hang out on parking lots. BTW dimwit, the PA Trespassing law allows for verbal notice to be enough. If you don't leave after that, you're trespassing.

    This police manager. S. R. Eachus, wonders at [22:53] why you don't "comply' with his reason and purpose for you leaving. However, the people wonder why they don't 'comply' with our reason and purpose for staying, a reason and purpose that is based upon, and protected by, the 1st Amendment to the Constitution they swore to uphold.

    what really irked me was the snarky comment the supervisor made towards the end of the interaction where he said to the cameraman, "especially CHILDREN". it was so laughably ironic when it came from the supervisor who was the one acting like a CHILD the entire time. the things he said, and the way he justified his behavior was NOT how adults behave, speak, or reason. that passive aggressive comment, on top of all the ridiculous comments he made, were exactly how CHILDREN act. adults of sound mind do NOT behave like that. what a silly goose!

    • @lancpacivilrights
      @lancpacivilrights  Год назад

      To be able to be trespassed on public property, unless it is properly posted as a restricted area or its enclosed or fenced in, a law is required to be broken. Otherwise, they could just say any area is restricted and ask you to leave on a whim. This is only subject to time place and manner restrictions. Private property is different.

    • @brucegordon4992
      @brucegordon4992 Год назад

      @@lancpacivilrights Do you by chance have the statute or case that requires there to be a fence or signs or enclosure unless a law is broken please? Just curious because in s 3503 I have read about purple stripes however I see nothing requiring signs if there is actual communication and nothing regarding another criminal offense. Out of curiosity are you familiar with Commonwealth v Bradley?

    • @lancpacivilrights
      @lancpacivilrights  Год назад

      law.justia.com/cases/pennsylvania/supreme-court/1985/342-pa-super-1-0.html
      I am not a lawyer, but the defense would be that it was public property that was not properly posted or enclosed. You must be disorderly to be asked to leave unrestricted access to public property. On private property, when asked to do so, you have to leave or it's defiant trespass.
      The statutory defense in section 3503(c)(2) provides a defendant with an affirmative defense. An affirmative defense is defined as one where the defendant admits his commission of the act charged, but seeks to justify or excuse it. Commonwealth v. Rose, 457 Pa. 380, 387, 321 A.2d 880 (1974). When evidence is introduced which raises an issue relating to an affirmative defense, the burden of proof falls on the Commonwealth to disprove the defense. 2 Pa. Criminal Practice § 26.10 (Wasserby, Ed. 1981). See Commonwealth v. Cartagena, 482 Pa. 6, 23, 393 A.2d 350, 359 (1978).[2] This is because the truth of all affirmative defenses goes to the final analysis of the guilt and the rightness of punishing the accused. Therefore, at the close of the evidence, the jury must be told that if they have a reasonable doubt of the element thus raised they must acquit.
      In this case, the defendant did present sufficient evidence to show that the gate area, where the events occurred, was open to the public for the specific purposes for which the defendant was in that area. The Commonwealth presented no evidence that the defendant failed to comply with any lawful condition imposed on his access to those premises or in any other way "breached the peace". *8 The mere fact that his invitation to be on the premises was revoked is not sufficient to remove the defendant from the protection of subsection (c)(2). To find otherwise would render that subsection meaningless.
      To permit the use of the criminal process to effectuate what is basically a civil cause of action for relief would be unjust. Although the facts in this case and the $40.00 fine involved may seem insignificant, the principle is elemental to maintaining a proper perspective on the distinction between criminal and civil trespass actions. The purpose of the criminal trespass statute is to prevent unlawful intrusion onto real property or remainder thereon or to prevent unlawful breaches of the peace relating to realty. Because appellant had complied with all "lawful conditions" for access to the premises, 18 Pa.C.S.A. § 3503(c)(2), his conviction may not stand.

    • @lancpacivilrights
      @lancpacivilrights  Год назад

      The purple stripes are generally meant to be used to keep hunters, fisherman and trappers off of private land. I believe that was the original intent. They have to paint a purple stripe every so many feet. I mean, I suppose it could be used on public property to restrict access.

    • @brucegordon4992
      @brucegordon4992 Год назад +1

    I live close by to this location. I’ve definitely had less than pleasant interactions with Local Law Enforcement, Different Township’s , PSP and other close By State’s. (as far as officer abuse of power and rights violations)These agencies Need Checked, and audited. But this agency did a great Job at deescalating rather than over stepping. The auditor definitely seemed like he was trying to “Trigger” the staff of the agency. When good conduct and respect is given from one side it really should be returned, From Either side. The Patrol car area is open to the Public yes. But they do have a good cause for concern when transporting/escorting Arrestee’s in and out of cars, or, in and out of the building, From “Possible” obstruction, or attempts to free a suspect by a Person from the general public That is in that area. Good Video All together Though to show That Not every Pig is A bad one. Audits are Working, and Not Every Audit or Police encounter needs to result in an Arrest and/or rights violations.

    He is the person to disregard the Law by telling you it doesn't matter if there are signs to keep Pedestrians out! That is directly following the Law, a fence or adequate signs would allow them to ask/tell you to leave the area!

      Precisely. If they would enclose it or put up no trespassing signs, I couldn’t be there.

      I’ve edited like 8 videos in my lifetime. 5 or 6 were done in Adobe Premiere. I don’t really see much of an issue to be honest. What would you like to see done? I plan on using better transitions and an end screen and stuff in the future. I’m just lazy.

      @@lancpacivilrights well the long walk could have been shorter, edited out completely. The voice over was lengthy and there wasn't much content to the point you were trying to get across.
