I keep thinking about Trump's "digital bill of rights" comment and hoping it will be broad enough to stamp out not just the intended goal of banning and suppressing legal speech online, but also enough to stop this shit, and CC companies dictating other companies "morality" or else they'll stop processing legal purchases. I know I'm dreaming, it'll probably only be limited enough in scope to protect users on Twitter.
I think hackers/cheaters should get their own servers/lobbies that is just other hackers amd cheaters. They will be essentially be shadow banned from playing with folks that aren't cheating. The only time they should get ban ban. Is if they keep trying to gointo normal player lobbies, or doing something like DDOSing the server/lobby or what not.
I really hope so too, used to be if you didn’t want to hear the trash talk you hit mute. COD lobbies were known for their trash talk, but most people didn’t care and for those people that did the mute button was an option. Now we have AI nannies recording our speech and banning people for simple insults or jokes. One person was simply saying an Apex character was gay, which according to lore they were.
When you can't handle even the most minor of jokes. At this point, EA, why even have any option for voice chat/any communication if you're going to take offense to something as minor as that?
This isn't even new btw; EA will ban accounts for most in game chat, for names an ai randomly decided was bad (which for an example a lot of Chinese words sound like the gamer word if a cheap ai tool translates it, so yeah), some accounts will be randomly banned for no reason and even if people make a stink about it EA will double down and say they deserve it for disparagement, but on the bright side apex hasn't been culturally relevant since the tournament hacking and EA sabotages apex and Titanfall so this doesn't affect many people at this point; this will be a continuous problem for games that require third party software to launch like EA, Ubisoft, Rockstar, Epic and PlayStation, best to avoid those games and if you really want to play something like helldivers best to spend no money as you will likely lose all those items eventually, but really steam should ban those games and games that require malware like denuvo as it is harmful to the customer and steam does try to protect the customer, good luck selling malware games off steam.

same here, my last game from them was Need for Speed: Rivals back in 2014 so it has been almost 11 years for me as that was all the way back in February of 2014 and I am not looking to buy another game from them, no matter how good it is. The loot boxes (In which they are basically slot machines and not "SuRpRiSe MeChAnIcS" like that one lady from EA foolishly claimed) and all the stories of the emptied bank accounts and overpriced macro-transactions are what made my mind up for me.
I remember the golden age of online gaming. When going on the internet to play was a privilege. The genuine excitement to hear the voice on the end of the Bluetooth was a welcoming delight. A time when publishers released games that never required months of updates and the menu screens weren’t crammed with BS micro transactions. Merry Christmas

Even public / private companies have to abide by the law. If the law prohibits somebody to be punished then the companies cannot do it. But they are creating the TOS specifically to prevent gamers to go to court. Nevertheless some countries and their courts ignore the TOS if they are considered onesided bad for customers.
You want to be technical, a TOS can not go above or beyond the law, and most TOS are entirely unenforceable garbage. The problem is arbitration is legal (That should be changed), and virtually no one wants to go to arbitration with a billion dollar company over a few thousand dollars at most, so despite nearly criminally unenforceable shit you can't actually get it changed because the one part of it that IS legal and enforceable is what keeps you from doing it. What it would take is a top down bust up, creating new consumer protection laws, and basically forcibly invalidating all current and active TOS/EULA agreements. I think it's fair to say, that part of modern consumer protections is that an individual user can not be forced to sign any kind of TOS/EULA; I think it'd be fine for a business to business transaction, but entirely unenforceable for business to consumer transactions. Along the lines of how some free software has a license that says "Free to use for personal use" "required license for commercial use" - That's about how all video games should be, I buy the game code, not a perpetual licenses that might be revokable.

The 1A only refers to the citizen-government relationship. As much as we would want, the 1A does nothing to the relationships between private entities like citizens and companies. I have one and still no clue why, I was learning to play TF 2 n facing many hackers n criminals on trade servers, I reported everyone and one day I got VAC banned for no reason at all, but I feel like they thought I was a hacker, I always have a lot of programs in my PC, probably something at that time triggered Steam
