  • A California couple says they can’t move into their new home because the previous owner refuses to leave and can’t be kicked out because of the state’s ongoing freeze on evictions during the pandemic. Tracie and Myles Albert used their savings to buy a four-bedroom home in Riverside 14 months ago. They’ve been paying the mortgage every month, but haven’t been able to move in. "He just said he wasn't leaving, that was it. Wasn't going to leave the house, barricaded himself in the house,” Myles said. #InsideEdition

    This is absolutely unacceptable. He needs to be evicted. I don't blame her for being so upset. Imagine paying a mortgage for a property you can't live in.

    It’s not his house, he’s not paying rent, so he’s not being evicted. He’s trespassing. This is disgusting.

    This is ridiculous! How can the property owners have no rights to their own property? Why is this law allowed to continue?

    That man no longer owns the house and is simply trespassing on that couple’s property. He should be evicted because he’s the one trespassing, not the couple who owns the house.

    Imagine making payments to the house and having squatters there with laws to protect them. That would drive most people crazy.

    This SHOULDN’T EVEN be a legal battle. Imagine paying this expensive house off, then being forced to surrender it to a thief manipulating the law.

    This is real estate fraud. At this point, I would declare the house sale a loss. Instead of trying to move in, I would take him and his real estate agent to court for real estate fraud to get back the amount of the down payment and the mortgage you paid for. This is ridiculous that California doesn’t give victims of squatters any rights to their own house.

    There's gonna come a time when we will have to take matters into our own hands bcuz the justice system isn't there. These people paid for their new home with their hard earned money and this is what they have to put up with. Very very unfair!!. SMH.

    This has to be a joke. How in the world does the squatter have more rights then the home owner whom is PAYING THE MORTGAGE?!?!?!?!?! I cannot comprehend this.

    The government would evict someone living under the bridge, but won’t do anything if they live under your roof. Their priority is in their best interest.

    I actually feared this. I bought a home in Texas and the pervious owners had not communicated with me at all about their move out or wanting to do a lease back. I arrived at the home Friday night before our closing Monday. They had not packed a single box. My realtor said they legally still owned the home and they technically did have to be out of the home. The home was still packed with their stuff. I grew concerned and told my realtor I would not sign the closing documents without a final walkthrough the day of ensuring they were out. The previous owners were livid at me. They had to pack an entire home by themselves in two days. There realtor would help them pack, and I would later learn they did not have money for movers nor truck. They literally took the light bulbs out of every light. Left me trash, broken furniture and a weight set....Parts of their RV septic system. They did remove the bulk of their stuff. I signed the documents, as it was bad enough to notice but my lease was ending on my home. I fully believe they were not planning on leaving either out of a necessity or simply didn't care about my needs.
