How I removed squatters in less than a day.

  • In 2019 A family of Squatters broke in the back door and moved into my mom's vacant house in Northern California and the Sheriffs wouldn’t do anything about it since the house had furniture and they made themselves at home and I had heard horror stories about how the legal system gives the squatter more rights than the homeowner, so I decided to come up with a way on my own to get them out in less than a day. Here is my story. I don’t suggest that everyone take a chance like I did on their own. It’s worth noting that I have had special training, a license to carry and was prepared for whatever situation was to arise. The men and women I had to deal with remained peaceful and that may not always be the case. If you ever have a situation like this, it is best to expect the worst and you will be prepared. One of my in-laws was telling me about some squatters in Denver that were moving into the house of a Marine veteran bound to a wheelchair when he came back from a vacation. He made a few phone calls, not one of them to the police. It's rather hard to argue with 25 ex-Marines as they move your things back into the truck you're trying to unload. The laws squatters are trying to say they can have rights under is the old homesteaders rights, which allow a person to claim private land in public trust after having lived on it for a predetermined time period, usually years which would grandfather them into the ownership status, especially if they have done anything to make the land useful.
      Problem is, homesteading laws require years and public lands, not private lands and existing domiciles. The eviction laws also only cover legal documents that have been through a notary public's signatory. A falsified document, including lease agreements which have to be legally signed and notorized, is a felony offense. Plain and simple, it's breaking and entering. And it should be treated as such.
      As far as anime goes... Demon Slayer's pretty damn good. I watch it with my 21 year old daughter. Ain't half bad.

    • @JeantheSecond-ip7qm

      There are reasons for squatter’s rights laws. “They prevent the abandonment of properties and enable the productive usage of land. By permitting squatters to ascertain a claim, what the law states is designed to discourage homeowners from leaving their land or buildings unused for longer durations. This will in addition help alleviate problems with the deterioration of properties and advertise community development.” They also prevent landlords from forcing people out of homes before it can be determined if they have a right to stay or not. Sometimes landlords attempt to remove tenants who have a legal right to be there because they have a proper lease. They need to be reworked to prevent the abuses we’ve been seeing, but without throwing the baby out with the bath water.

    • @SL-es5kb
      @SL-es5kb 4 дня назад

      There is no such thing as squatters rights they don’t have legal rights but get away with this because of difficulty enforcing the owners legal rights. Historically at common law, several years of open use and maintainenance of a property could ground a claim to title. Of an owner asserted title at any point the clock would stop. It never has and does not apply to people breaking into a property and staying there for a few months. You are seeing more of this now because legal system failing. The legal system moves slow and lots of people lie or forge a lease and this prevents the sheriff from evicting people until it moves through the courts.

      I'm not defending these criminals but I can explain. Squatters are usually going into unoccupied homes like this one. A while back, liberal politicians were able to convince enough people that an unoccupied building housing someone who would otherwise be homeless is only a loss of some time. Time that isn't as valuable as the human life in the building or the potential trauma that potentially homeless person will face. Secondly, law enforcement won't treat them that way because of liberal settlements that cost the department millions. If the US wasn't so litigious, they might be willing to treat them as burglars from the get go.

We aren’t getting the whole story here but the cops could definitely help him if he or his mother could have shown up with proof they owned it. If those squatters were not receiving mail there the owner could give the police permission to enter and make them leave.

If she gives you any "trouble" again, contact CDCR in Sacramento, ask to speak to their legal department (I think they have an "attorney of the day" for calls) and tell them what is going on. She is a PEACE OFFICER in CA. She should be fired. This is a clear violation of CA Penal Code section 602 (criminal trespass). Law enforcement should have gone out there and make her provide proof that she had a right to be on the property; that is the legal standard. You handled it like a gentleman with a lot of grace. We did that in Chicago at an apartment building gave all the tenants the notice of course they didn't gave 2 shts but when started swinging them sledgehammers at 8 am sharp and the debri started falling on top of their heads also they all scoot in 20 mints, I've to admit that my uncle was a terrible SOB when he got angry, and i don't operate that way, when he crossed the line was when he doused some dude in gasoline at a gas station for asking him for a cigarette, right at that spot i stepped off the truck and left never saw him again, that's what I like about this guy, that woman tried to do an adverse possession which is legal in the USA, if a property is not been occupied for certain amount if time, and somebody like her takes over and 5 years pass by, and she pays the taxes the house is transferred to her name, the way I avoided that was by leaving some belongings and keeping the power and water running under my name, and cable, with that nobody claim an adverse possession.

    There should be no rights for squatters. Should be criminal trespass. This needs to change across the entire country.

    • @furripupau
      @furripupau 9 месяцев назад +39

      There really aren't "squatter's rights" in the way people think. Believe it or not, simply posting "no trespassing" signs on a property is usually enough, in most states, to override any squatter's rights. The main thing that the law relies on is that the squatters are *notified* that they are on somebody else's property. If they are notified that they are on somebody else's property and made aware they are trespassing, then poof, "squatter's rights" are gone in most states. Squatter's rights only really kicks in when somebody has been occupying property for a certain amount of the time, and the owner of that property has not protested their occupation. This usually occurs in fairly innocuous ways, such as somebody builds a fence a few feet over their property line and into a neighbor's property, and the neighbor doesn't care, or doesn't notice, until say four or five years later - at that point it's too late to simply say "hey your fence is on my land". That's when squatter's rights actually kicks in. It's the lack of protest by the actual owner that gives the squatter rights to the property after a long enough time has passed (in most states this means several years have passed without the owner raising the issue).

What a great example for her grandchildren...she should be reported & lose her job...she knows better than to pull criminal behavior like this. Unfortunately, in the state where I live, squatters have more rights than the owners & it's nearly impossible to legally get rid of them, particularly, if they have children, it's cold outside & if those children are in school--the owner must wait until school is out. When criminals continually go unpunished, law abiding civilians are legally helpless to stop them, then, LE officers will decide to become criminals as well.

My Grandpa was a master carpenter who also knew quite a bit about painting, plumbing, electrical, landscaping, & general maintenance for home, business, property/land, & vehicles from cars to tractors & combines. He was blessed with 4 girls who collectively gave him 2 female & 11 male grandchildren. He taught all 17 of us, as well as the few great-grandchildren that were old enough before he passed away, the same exact things, which was pretty much everything he knew. My 2 year old son knew the difference between a flathead & Phillips screwdrivers, as well as a crescent, plumber's, or lug wrench & what a hammer was & successfully would fetch those tools for us at that young age (not to mention covered cups of coffee or cold drinks as appropriate). All of us use those skills on a regular basis, some of us professionally as carpenters, mechanics, & handymen/handy ma'ams, & all of us personally. Problem is bad landlords in the past have claimed that (soon to be) former tenants were squatters.
      In my lifetime I remember rent being paid in cash by hand and rarely a receipt, much has changed and laws are quite slow to adapt.

    • @TheEvox81
      @TheEvox81 Год назад +30

      The problem is how to define a legitimate squatter. Don't get me wrong, I completely agree with you. But the "squatter's rights" laws that currently exist were basically put in place to protect legitimate tenants at the hands of shady landlords. If anyone could say "they're squatting/trespassing, arrest them" and that happened with no questions asked, there is a lot of potential for abuse.
      What really needs to happen is a reform of how squatters are dealt with once they are determined to be squatters. Going through an official eviction for months is ridiculous. It should be a 1- or 2-day process maximum, after which their property is forfeited, and further trespassing is immediately actionable by the police.

    • @Siggy4844
      @Siggy4844 Год назад

      @@TheEvox81 If a person is a legitimate occupant, they will have the paperwork to show for it. A rental agreement in writing should be proof enough that a resident is not a squatter. Bills or ID in their name is not proof of legal residency and should never be accepted as such. I can have my mail sent to another address, doesn't mean I actually live there. If someone doesn't have a rental/lease agreement, how did they even get into the house or apartment? They would have had to have broken in, which is considered breaking and entering or could even be burglary.
      And never ever pay rent without getting a receipt. I've seen this issue at an apartment complex where I used to live. Many tenants were very trusting and gave cash rent payments to the on-site manager. The managers usually made excuses like saying they didn't have a receipt pad at the moment and would give them a receipt later, which usually they did, building trust. Except that one day they didn't. That time, the managers packed up their truck in the middle of the night and disappeared, leaving those tenants who had just paid their rent without getting a receipt without proof that they ever paid it. When the new managers took over, all those people (most of them low income families) who were showing rent due ended up having to either pay it again or move out. Always, always get things in writing and get a receipt for any funds paid.

    Friend had same problem. A bunch of her friends-we all got together. About 15 of us. We talked to every neighbor on the block, and got verbal permission (some even joined us) to hold a impromptu 24/7 block party. We played loud music, barbecue, illegal fireworks now and then…..all in front of her house. The squatters were meth users. They do not like loud music, very bright strobe lights , barking dogs…all day and all night. We camped in shifts on neighbors yards. Potlucks. You name it… when the last squatter left for her fix, we went in, removed what crap they had. Changed all locks, posted no trespassing notices and installed alarms and cameras. It was hard work, but fun. It took us 72 hours- and they were gone.
    We need to change the laws. Legal homeowners should not be the victims.
