Evening Flight around Stonehenge, Silbury Hill & Avebury Stone Circle, (within CAA rules)

  • All done within CAA rules.... A late evening, 360 degree flight around the iconic Stonehenge, with some additional amazing shots of the enormous Avebury Stone Circle, West Kennet Avenue and Silbury Hill, the largest manmade mound in the world, estimated to have taken 500 men a full 15 years to construct, providing a direct line of sight to Stonehenge and Avebury.
    The CAA confirm that landowners cannot impose their own airspace regulations any more than you can impose a speed limit outside your own house. The CAA regulates airspace, no one else. This means the landowner can prohibit you taking off, operating and landing but cannot prohibit you flying over, anymore they could a paraglider or hot air balloon.
    That said, respecting English Heritage's wish, I waited until around closing time to ensure visitors weren't bothered in any way. Remember to always fly with the greatest consideration for others who won't be enjoying the amazing views you get!

    Under CAA rules and regs, this is a perfectly permitted flight; it's the CAA who control airspace, not the landowner. But considerate flying is just as important, so waiting until around closing time so visitors aren't impacted in any way was key for me here.

    I have high regard for English Heritage but remember many people sadly find drones more annoying than shouting children or the cars and trucks thundering past Stonehenge so always fly with care and consideration, and you'll definitely get the nicest pictures after closing time without the masses of people.

      Regards the CAA controlling airspace Ian, can that fact be applied to the NT prohibiting drones on their properties/area's, I'm not advocating flying over Tatton Gardens and the like but place's such as NT areas in the Lakes etc.

      Hi Ian. Love this footage. I wa t to fly over a much smaller circle of stones very near to me as part of a video iam making of this lovely valley where I live and all its villages. But I was Th old no drones. Its just out side Bristol airspace. So I kind of think If I'm taking off from land outside the stones either very early in The morning or evening when no one will be there. Its a very quite site. What harm can it do. But reading English heritage rules. Would I get into troble. Failing this. I will just have to walk the drone around them and film by hand as a normal video and that's fine by them. Very strange thst a few feet in the air and they say no

      NT do not own the air space - the stop tkeing off and landing on thier property . Best find a public footpath near-by .@@gedheaton1415

    A good example of responsible drone flying. You’ve flown over sparsely populated areas at a reasonable height and at a time when you are not going to interfere with anyone’s enjoyment of the sites. Great work!

    Hi Folks. It's not illegal, as some seem to think. Landowners can 'enjoy' the airspace above their land up to a dizzy height of ten feet, above that it's a matter for the Air Navigation Order by The Queen in Council (ANO), CAA and NATS. Landowners can prohibit take offs, that's within their rights, but not overflights, or for that matter filming as long as a 50 metre clearance is maintained. If the airspace is not restricted then you can fly a drone in it up to 400 feet above ground level - see UK ANO 2016, amended 2017 and 2018 and the supporting CAA documents. For example, if the site was crowded with people (more than 1,500) then the flight would be illegal, but it clearly it was not. I do agree that our National Trust is missing out on some very valuable world wide free publicity with its approach, but obviously they have concerns about insurance cover. I think they should consider granting reasonably priced permits to take off and land subject to specific, well thought out conditions - Membership of BMFA with its superb insurance cover and perhaps fence off an operating area for pilots with restricted flying times, for example. The land is legally held in trust for everyone's enjoyment, not just those on foot! Kudos, Ian, for raising the subject. BobUK

      Cheers Bob, and thanks for the excellent write up of the relevant codes and restrictions in place. I researched and made sure everything was okay for this flight. As you said, I made sure it was outside of opening hours to ensure no crowds and stayed above 50 metres and below 400 feet, staying in VLOS. Had double checked the controlled airspace and that's about it as far as I can see.

      This is my view too so I fly outside of opening hours because I realise there's always a risk of a bird strike and the drone falling out the sky and I don't want it hitting anyone so, in summer, I go places for sunrise, normally done by 7. Can do sundown now as many places are closed by 8 and I think they should be selling permits to film at certain times. Mind you I've seen an amusing sign post from Sedona Arizona banning food, drink, smoking, pets, drones and pictured is a cell phone from the 1990s, which were once also frowned upon lol.

    So just to be clear, this is flight within all CAA rules, flown in unrestricted airspace, just south of Larkhill Controlled Airspace. Immediately to the north of the Stones is Larkhill Airspace; , NATS recommend you do not fly your drone in that airspace unless with great care and abiding by the CAA Drone Code. As it is, I didn't fly into the controlled airspace at all anyway.
    English Heritage and the National Trust don't allow you to fly from within their land, but don't control the airspace above. In saying that, I didn't want to annoy the tourists so waited until around closing time to ensure no crowds. Cheers, Ian

      That's my understanding as long as you don't take off or land on NT land you can fly and nothing they can do.
      I only wanted to know as I want to go and do the same.

    Hi Ian. Just read your article on Grey Arrows. Great video by the way and not breaking the law in anyway. I get fed up of these so called experts who do nothing other than complain, I think the drone owners themselves are the worse. Nothing illegal about your flight so well done...... people are so negative.

    Flying after closing time, within CAA rules, and observing the restricted fly zone to the north.
    As a hobbyist without PFCO, I am permitted to fly over private land as long as I stay more than 50 metres away from structures or people, keep in VLOS and am not in a no fly zone.
    English Heritage (wrongly) state you cannot fly over their properties unless you pay them a hefty approval fee and have a PFCO.
    English Heritage don't control airspace! The CAA does and the CAA have confirmed this to me this week (14 June 2018).
    In this case, I wasn't on their land; I checked with National Air Traffic Control and confirmed there is indeed a restricted airspace immediately north of the Stones, but even that is only restricted and the guidance from NATS is Fly With Caution and obey the CAA Drone Code. However I did not fly into that airspace anyway.
    By waiting for closing time, I've A, not annoyed the tourists, and more importantly B, avoided falling foul of the 'crowded areas' rule.
    So as I see it, this was a perfectly valid flight.

      Thanks for clearing that up Ian. Did you get any grief from the security on site or were they unaware? I think the drone code could be a little more informative as to take off / landing zone and who actually controls airspace over private land etc.

      Cheers Andy. I took off from some common land adjacent to the main site, so there was no security. Even if there was, as long as you're not breaking any CAA rules, there's not much they can do if you're not controlling the drone from their land. All about common sense though; trying to respect the visitors, irrespective of the technicalities of the rules. Hence I waited until closing time. Ian

    Just found this one (after being a subscriber for a couple of years). Lovely video. I found it linked from your post about the CAA email, as I'm planning a trip to Thornborough Henges with the Mavic Mini. I read on the English Heritage site that they don't permit flying over the site and thought "that can't be right, there's no restriction shown". Thanks for sharing that clarification email and this video!

    I would fly tourist spots at first light.
    A) its golden hour
    B) no tourists
    You could get closer then too, and English Heritage are just a landlord, its not about the heritage, its about making money.

    Words can't really describe Stonehenge , visually more than beautiful and emotionally more than magical. It grabs you in the chest. I always woundered what this magnificent place was used for ? no speculations but, the exact use. Great footage Sir. Thanks for uploading, This is as close as most will every get to Stonehenge .....

      Ian in London you're correct on your regs mate. Not law until July 😉. As for NT and EH their rules are their rules. Don't make them law.
      Ignore the naysayers, you will always get them. Partially down to them being jealous or lack of actual knowledge on the regs.

    I flew over a Cadw site in Wales. States on their website it’s allowed when no public around ie when it’s closed. I flew after 5pm a Sunday after it shut. Still had these prats on Facebook moaning and spouting off ! If your not taking off from Private land and don’t fly too close then nothing wrong. These organisations I’m sure are pleased for the coverage, it’s a fantastic advert for the sites we have in this country

    I enjoyed this, I think it’s clear from the footage that you were being respectful. As for the rules, one site says this, another states that. 🤷‍♀️ I was going to film Caerphilly Castle but held off because of the confusion that was being served to me 🤦‍♀️
    Don’t know why it’s warranted this much dislikes, and I hope you keep uploading, I’ve learnt about drone settings from you

      Cadw sites are fine when they are closed. States this on their own website. Don’t be put off by other flyers lack of knowledge.

      I think some people initialliy thought I was being a drone-hooligan buzzing tourists. I've now made it clear that wasn't the case and was sticking to the rules, but I have a bit of thumbs up catchng up to do now :) :)

    beautiful video, excellent flying.. love your reasoning about the legalities of this and why this flight should have no issues .. only thing is i wished you would have posted a video of such beauty in 4k :-) but that might just be whining since i just got a 4k screen and wanting to see some gorgeous content on it (such as yours)

    Great places to fly. Just up the road from Silbury is Cherhill. Take a look at the video I've done of the White Horse and Monument if you get the chance. Great man-made and natural features for drone shots.

    I posted this on Mavicpilots but interested in others opinion. In no way meant as a dig at you Ian - genuinely interested to get to the bottom of the situation.

    Nice video. I have a few landmarks I want to image.
    I am interested in your interpretation of the regs though. Having read your post initially I agreed and was about to let loose in the Peak Districts.
    But, having done some research (including the reading the relevant sections of the Civil Aviation Act 1982) it would seem that private land owners do ‘own’ the airspace up to somewhere between 500-1000’ and can certainly prohibit people using it.
    It falls under trespass and nuisance though so is strictly tort law and a civil offence so no powers of arrest etc but they could sue you through the civil courts.
    To investigate further I asked my friend who works for the Peak National Park who also prohibit drones over their land and again he suggested they do have rights up to a certain height and again this height, whilst fluid, is greater than the 400’ we are now allowed.
    Again though it is very much a civil matter but that said with the greater powers the police will have under the new regs there is a greater risk of arrest perhaps.
    Note also that the National Trust and English Heritage have both successfully sued people who have sold images of their properties for commercial gain without permission.
    It is somewhat a grey area but I do not agree that control of airspace is solely a CAA matter. Landowners do absolutely have legal rights and it the enforcement of these rights where there is room for interpretation.
    That said my take is fly sensibly, be polite and generally ask forgiveness rather than permission but always be prepared to apologise, pack up and move on if asked.

      I should add I agree you are 100% within drone regs, CAA guidelines etc but I do also think English Heritage can prohibit you flying over their land under other laws (such as trespass).
      Our legal system is very archaic in parts particularly when it comes to the difference between regulations, criminal law, tort law, civil law etc. Becomes a bloody nightmare at times :£

      Really appreciate the detailed and considered view here. As I said on here, and the video, I'm really interested in all points of view here as I am increasingly annoyed by the groundless prohibition of flying by landowners and managers, whilst at the same time, fully understand the need to not annoy or harras people.
      Given the grey area of the law, I think people on either side of this will find information backing up their point of view. However, I did read this highly relevant article from the CLA (the Country Land and Business Association) which actually has a dedicated and highly detailed document on the rights of landowners versus the rights of people to fly over it.
      In that, they quote various legal cases but summarise with the basis that whilst there is a general acceptance of the requirement of being at least 50 metres above private property, this could possibly be challenged. Quoting a previous judgement: "But if the circumstances were such that a plaintiff was subjected to the harassment of constant surveillance of his house from the air, accompanied by the photographing of his every activity, I am far from saying that the court would not regard such a monstrous invasion of his privacy as an actionable nuisance for which they would give relief."
      A grey area indeed.
      I would argue I am not constantly surveying the area. I flew high enough to ensure no privacy concerns. I waited until around closing time to ensure visitors weren't in any way annoyed by the flight (leaving aside the main road some 50 metres away with trucks and cars roaring past all day) and, of course, I complied with all relevant CAA and Air Traffic Control instructions.
      So perhaps a test case is needed. I'm defo not volunteering to be that test case :) and thankfully I'm far from the first person to post a RUclips video circling the stones. That said, if English Heritage, the National Trust or the CAA come knocking, I would hope the points and regulations I've abided by would put an end to the matter.
      On a final note, I am intrigued by the idea of prosecution of an image. When I think of all the landmarks around the country, often managed (as opposed to owned) by English Heritage or the National Trust, being photographed by thousands of visitors each month, I wonder how that would actually stand up in court? Every situation is different and I guess it boils down to whether you're taking images for commercial gain or private use. That said, the CAA view RUclips as non commercial, even when the channel is monetised and shows adverts. Either way, for now, I'll put my future best selling book "Stonehenge from the air" on hold for a bit :)
      Thanks again for the input. At this point in time, I'm still happy with my video and its legitimacy... Hoping that doesn't change....

      The first video I ever shot was of the Apple HDQ. (the spaceship) early on New Years Day 2017. It was under construction, not occupied, nobody was around (likely in bed with hangovers from New Years Eve) and I did my homework...perfectly legal. But...as I was bringing the drone in I was 'harassed' by a security guard driving a Prius with rotating lights. Lets just say he wasn't too intimidating!     Ballsy to upload this as Stone Henge is a no fly area ( unless you got permission somehow). Great shots though, and this is why the NT need to allow filming at certain times... There missing out on so much free publicity. I,m a NT member and still I'm not allowed...

      Aha... remember they don't control airpace! It's like you saying no on can fly over your house and garden! So I took off from the adjacent field that's not their land, and stayed more than 50m high from them.... :) And used the NATS Drone assist app to confirm CAA airspace regs there. Cheers, Ian

      Actually for all of these clips, I took off from public pathways. Remember it's only the take off point that is controlled by the landowner. They don't own the airspace, so by taking off from public land I was fine to fly around all 4 spots without further permission required.
      I would add, as a hobbyist, I take the approach that unless there are clear signs or known rules like that for English Heritage and the National Trust, then I believe in flying and stopping if asked by the landowner. That's never happened.... Much easier.

    Great video Ian . I went past Stonehenge last year and thought about flying the mavic over it , but there were so many people there I decided not to .Can I ask , what altitude do you normally fly for shots like that, and how far is your range .? I’m still not comfortable with it being too far away from me, and in some skies it’s easy to lose sight of it . Thanks mate .

      For the flight over Stonehenge, I took off from a pathway just the other side of the main road going alongside it, so I had to fly around 300-400 metres away from me. Height wise I just stuck to around 300 feet. I waited until closing time so I wasn't buzzing all the tourists... But yes, you need to keep an eye on the small map and the FPV view to keep track of its position. That's why it's useful to have a friend alongside being the physical spotter for you at the same time. Cheers, Ian

      @@IaninLondon I found the English Heritage no-drone policy on their web page for Maiden Hill. It's literally a hill, with big earthen walls on it. A drone impacting it at high speed would do less damage than the sheep have done.

    Hi Ian, apologies if you’ve covered this question elsewhere. But as a total novice, potential drone owner, could you tell me what sort of heights you were flying in this video? I have no idea how to visualise what the 400 feet ceiling looks like versus other ‘high enough’ altitudes (ie that don’t annoy people or take any risks). Many thanks, Tom

      The Stonehenge clip was shot around 100 metres or 300 feet. I then cropped the 4K video to make it look closer.
      Your remote display will always tell you your altitude as you fly, so you'll always know what you're doing. Once your drone is around 100 metres high, it's barely noticeable as a sound. The ironic bit about this location is the proximity to a main road with trucks and cars roaring past.... Cheers, Ian

      Ian in London Thanks Ian, yes I noted the drone app tells you the altitude. I was rather thinking about visualising beforehand when you plan shots, but I guess this comes with practice! Good to know that the drone sound disappears at 100m. The drones that buzzed me on the beach and river were literally 15 or 20m, which is very antisocial!

      Check on the NATS app to ensure there are no airspace restrictions and as long as you're not on their land then you should be permitted to fly.

      Just read English heritage I was right in thinking they want to charge to allow drone flights. I can understand the safety aspect if it's busy then don't fly but to charge for us film our heritage?

      Steve Golding forgot to mention that English Heritage already permit you to fly if you apply to them, have a pfco, pay their permit fee, pay to meet up in advance to discuss the flight plan and return to film when the grounds are closed. But as mentioned, they don't control airspace so in fact, all they can do is forbid you from controlling the drone from their land. That's why I made this flight from adjacent common land...... But agree it's probably nicer for everyone if you wait until closing time. Golden hour of light and no visitors....

    Can I ask please I flew around a NT house that was closed as 07:30 in the morning sunrise and I never took off from their land and I stuck to CAA Rules as my hight and between 250ft-301ft A local newspaper did a story online about the house and used my photo (No money was paid for the photos) the NT have sent me an email asking me to remove my footage and ask the newspaper to do the same. Can I ask please where do I stand I myself don’t feel I have done anything wrong. Tony

      You could ask them if they would ask the same if the photo was taken with a telephoto lens from a helicopter or paraglider.... If you were flying legally but were not on their land, it's your picture and you can do whatever you like with it... commercial or free...

      Hi there- I had the same recently whereby NT emailed me about photographing one of their hills from above. I have since had an apology from them as a) they had used my images, b) I wasn't over their land (though I would have been within my right to) and c) I let 40,000 people know on social media, many of them probably NT customers. I also met one other photographer, quite prominent, and he had the same email, but never heard from them since and continues to feature their land. I work in management at Heathrow and know the CAA laws, particularly CAP722, and from my perspective I plan to keep photographing our historic countryside for my followers and customers, and will be utilising my "spam" folder for any unwanted emails. That said Ian makes an incredibly good point about our duty of care as pilots and flying outside of visiting hours, within VLOS and away from people is crucially important. instagram.com/hedley_thorne

    Took a lot of advice from your videos but unfortunately got too ambitious and ended up sticking the drone 23m up a tree. It fell down after 26 hours (almost to the minute) but miraculous still works, despite being caught in typhoon rains overnight. I suppose we learn from our mistakes! In any case, here’s video of the day which includes the offending tree before my ambition grew beyond my skill level.
