Officer, you had been trespassed from the property. You were there unlawfully. You then attacked a man who warmed you that he would defend himself if attacked. Who is the criminal?
The police officer did not have a search warrant. The officer must leave the property when the citizen told him to leave his property. There was no immediate emergency which would give the officer probably cause to remain on the property. The officer should have left the property and come back with a legal search warrant.
And the police wonder why people dont respect them. There's no reason to arrest the man.. just get the hell off his property. If he wanted things to be de-escalated, he should have left the man's property.

Qualified Immunity does not protect police if they are in the wrong. It ONLY protects police if they are acting within the law and if they are acting in good faith. This means if a cop acts within his scope of duty, within the law, and with good faith the cop has immunity from lawsuits for damages unless the plaintiff shows that the official violated "clearly established statutory or constitutional rights. It does not mean the cop can do whatever he wants and get away with it. Like most think.

Lawsuit are all good and all, but isn't it well past time that officers stop getting free passes from criminal prosecution. I sure feel criminal charges are deserved for an awful lot of interactions shown.

The police officer did not have a search warrant. The officer must leave the property when the citizen told him to leave his property. There was no immediate emergency which would give the officer probably cause to remain on the property.
The officer should have left the property and come back with a legal search warrant.

The Cop is just a human following rules. If someone had just said they going to knock your head off, would you turn your back on them? I wouldn't. Cops are trained to pay attention to threats, as they should. If you don't like the system, i would advise criticizing the system, instead of the individual cops, just like if you don't like a war going on, you should criticize the leaders/generals, not just the soldiers.

Qualified Immunity does not protect police if they are in the wrong. It ONLY protects police if they are acting within the law and if they are acting in good faith.
This means if a cop acts within his scope of duty, within the law, and with good faith the cop has immunity from lawsuits for damages unless the plaintiff shows that the official violated "clearly established statutory or constitutional rights.
It does not mean the cop can do whatever he wants and get away with it. Like most think.
