She was never told she was detained. She had the right to walk away. He violated her 4th amendment 1st admenment. Also his grabbing here was an assault with battery as he had no authority to touch her.
That’s the same thing I was thinking that some missed. He never ever told her she was detained. He just said stay right here. Then went to your under arrest. She knew she didn’t do anything wrong or committed a crime. The officer just screwed up plain and simple. Also, something to think about. The cop had the ex-husband there. He could have easily went to the ex-husband took a report, if a crime had been committed a warrant could have been issued for her arrest. Keeping in mind the ex was there her address and name could have been received from him.
@@bchill757 you are 100% right, all the aggression and trying to give her directives whithout detainment it was just abuse of power . we should make sure we have him shipped to Alcatras,
The worst part is, the cop clearly sees things are fine but needs to invent an argument out of no reason. And since when are people talking about “potential crime”?
As it turns out she had been "defensive" with the landlord. So obviously the cop was within his rights to break her jaw and charge her for his pants. Nothing to talk about here
Every day, the police believe they can prevent crimes by believing that every person are armed and dangerous and we the people are GULTY before proven innocent.
There’s no situation that the cops can’t make worse. This is a perfect example. Two adults are having a conversation - no screaming, fighting or hitting - and two minutes later the cop breaks the jaw of a 64 year old female. Congratulations Officer. Another violent dunce with a badge and a gun. This guy should never, ever be allowed to work as a cop again. In fact, he should be in jail for aggravated assault.
Keep in mind that the average training for a police cadet to get his license to kill (badge and gun) is about 500 hours of training. In most states a licensed hair dresser needs 1200 hours of training to get her license to hold a blow dryer and a pair of scissors.
It seems to be a common tactic by cops to agitate someone then assault them and then call it resisting arrest when they try to defend themselves. This is police brutality and a form of entrapment.

it actually could be if she's not allowed on the property it could be harassment, and probably was, but he should have gone through the right channels to make that happen first so it didn't end up like this.
He could have said she was detained and she still had the right to walk away. He had no RAS, so the detention would have had no legal justification and her constitutional rights would entitle her to free movement.
He commands a calm woman to calm down, tells her to be still when she isn't moving, threatens to handcuff her then ultimately assaults her and breaks her jaw. Bouncing an elderly woman's head off the pavement and punching her in the face. This is sickening

What made him think he had the authority to arrest her in on domestic violence charge, first of all law enforcement officers needs to be trained on the fact that they cannot compell anyone to give testimony against themselves in the investigation of a crime, concerning them. Most attorneys recommend that one exert the Fifth Amendment right to remain silent during any questioning.
How is it domestic violence? He could have given her a warning and sent her on her way.Nobody was touched there was no crime until the officer committed one.
As Noel said... a warning for what??? You arent allowed to have an argument with your ex? Not allowed to the occassional yell when you meet someone you havent seen in a long time? Not allowed to have a discussion in public?... what exactly? 128 people voted you up, thinking that it would have been better if he gave her a warning and it sure would have been, but even that is too much. Her talking over her ex and not allowing him to speak while saying "everything is fine we were just having a calm conversation" is a textbook sign of domestic violence.

@@NoFreedoms-f1d You seem to have some real problems understanding the law. Maybe it is your hate of women. Or, maybe you are just a troll.
We arent "allowed" to raise a voice or argue? This world is circling the drain
Nothing was preventing the guy from driving away.
They do this all the time in Minnesota. It's all about shaking people down for 5th degree domestic assault.

Hey it's ALL FOR OUR SAFETY. Thank your closest demoRAT
“Disorderly conduct” is a stupid ass charge. I understand sometimes it’s accurate but it’s just a charge for cops to arrest you whenever they want or when you disagree with them
If the cop is investigating, shouldn’t have talked to this individual first, instead of starting shit with a suspect
Well, then he wouldn't get to Beat and Abuse an older Woman.
I agree the cops are going to suspect first because they are automatically guilty in their minds no matter what. Even though this guy says he doesn’t know if she was yelling he just heard her.
