BREAKING: Alex Murdaugh Judge Reaches Decision on New Trial for Double Murder of Wife, Son

  • Judge Jean Hoefer Toal reached a decision on Alex Murdaugh's appeal for a new trial for the murders of his wife, Maggie, and son, Paul. In March of 2023, a jury convicted Murdaugh of the double murders. Maggie and Paul Murdaugh were gunned down outside their Colleton County home in June 2021.

      She gave her legal opinion on that.. she said there are issues that are not before her AND in her review of the records (she read the whole transcript) the evidence is overwhelming & the jurors would have come to that conclusion. Legal opinions are important because any future judge would read them before their ruling.

      This judge was lazy and just passed the buck to someone else. The court made the mistake, and they should fix it. This judge obviously didn't want to make an unpopular decision. She failed her duty.

      He may do, but what matters is that he has the right to a fair trial and he may not have received one. It doesn't matter how despicable a person you or I may think he is, that right is fundamental and must be protected. That was the purpose of this proceeding.

      Clerk of Court is elected position. BH is up for re election in November 2024.
      There doesn’t seem to be anything in SC law to remove an elected official at county level from office.

She hasn't been removed from the job and unfortunately it looks like South Carolina doesn't have a process to recall elected officials. But I heard that there will be another election for those positions this year anyways.

The people of that county don't want any more of their money going to the public funded court system cleaning up her messes that could have been so easily avoided if she had just done her job and not talked to the jury like she's supposed to. Imagine if this ordeal actually gets Murdaugh a re-trial on appeal, which is entirely possible! That's a whole new trial for someone everybody already knows to be guilty that takes 6 weeks worth of everyone's time, energy and money and it's exclusively Ms. Becky Boo's fault.

      Jean Toal would resent this comment as a back-handed compliment in my opinion. She shattered the glass ceiling in SC only for you to refer to her as a “lady judge.” She’s earned her praise to be free of qualifications based on her gender. Just say she’s a great judge! And, unless you refer to male judges as fathers and grandfathers when praising their rulings as well, why is her status as a mother and grandmother relevant or notable here?

    I think one of the biggest deciding factors was the affidavit stating pressured by jurors then in testimony she said she was persuaded by Becky's comments. Then, after getting back into the jury room she wants to come back out and change her testimony. Like the judge said......that isn't going to happen. I think that alone was the deciding factor in this decision. Go serve your rest of days in a cell Alex....where you belong !

      He is not getting a new trial he is guilty and we will not let this become another OJ case that goes unsolved. He is guilty and I will not rest until he is strapped to Old Sparky and turned to ash thats where Murdaugh is going appeal denied he has a date with Old Sparky when the judge is through with him.

The judges rational that said juror was “wishy washy” doesn’t discount the fact that the law was broken and it’s more than reasonable to believe her decision in this case was swayed. He’s a scumbag, but this this sets a bad precedent.

      Hardly frivolous. The judge agreed with the defence on the facts and just disagreed on what the right legal test was. That question will, as she said, ultimately be determined at the appellate level. The defence got what they needed from this judge - a finding of fact that the clerk did make inappropriate comments to the jury. How this judge ruled on the legal question is pretty much irrelevant, since it was always going to be appealed whichever way she ruled on it.

      It really wasn’t. Many appeals are, but usually those appeals don’t involve significant misconduct from a court clerk. This was certainly headed down the path to become a mistrial, but of course did not go far enough. It was definitely on it’s way there though. So frivolous? No, I disagree. Everyone deserves a fair trial and this is why we have this system in place to make sure that is happening.

    What a brilliant Judge. It’s as if she was there at the trial and heard it all. Wow. I think her decision is spot on. No doubt the clerks words were so small as it compares to the overwhelming evidence presented in the case.

    Great verdict from this judge. She is right that the clerk seeked fame and money from her book. But the guilty verdict must stand due to the fact he killed his family and stole money. The jury did the right decision

      You got that wrong!!! This judges decision was based on if Becky influenced the overall jury decision and with 11 jurors saying NO and the last 1 lying today, that was easy decision!!!
      and Alex’s corrupt lawyers got embarrassed again right out of there! Today’s decision had nothing to do with original verdict except only if it was coerced!! Had nothing to do with Alex guilt or innocence at all! You missed the whole point of this hearing! 🤣 🤦‍♀️

    This judge made the defense feel and think they were winning in the way she conducted the trial to reading the judgment until the last minute when she said she was denying the motion for a new trial.

    Harpootian’s method of attack was nothing short of a disgrace.He was continually brought into line by the judge for his unrelated comments about the clerk.The Judge reminded Harpootlian over and over regarding these comments and I believe made it harder for his client.
    Yes miss Hill was wrong and she no doubt be held accountable for her actions.
    Murdaugh’s contemptuous grin was disgraceful.
    Time for Mr Harpootlian to retire.
