  • My brief presentation to the Austin City Council regarding their oversight of the Austin Police Department.
    In February, 2016 a unanimous federal jury awarded my client, Pete Hernandez, $877,000 (the largest civil rights verdict in Texas for 2016). We addressed the Council in late 2016 to ask for improvements to the complaint and oversight process for APD.
    The City Council has failed to improve these processes despite requests from the Federal government dating back to 2008.

    I wonder if people of a city/town could collect signatures to force a citywide vote as to whether or not police can be held personally liable for this nonsense.

      filoIII there no longer is a reason a police officer can not be held financially eesponsible after Turner vs Driver decision in the US Court of Appeals. That decision removed an officer's immunity when they violate a person's civil rights. That decision was handed down in January of 2017. In that decision if an officer of the law violates your civil rights then you can personally sue that officer and take whatever you and the court decides upon.

      @@RalphERo824 Your statement is overbroad. The Turner vs Driver decision was about filming police officer and police building from public property. The rights violated in that case were 1st and 4th amendments.

      @@leef_me8112 what is the 1st amendment nimrod? Taking his ID is violating the 4th amendment and Turner vs Driver quantifies the first. Meaning it made it known that videoing public officials in public is perfectly legal.

      But your statement is not true. T v D has nothing to do with 2nd Amendment rights, or 3rd, or 6th, or 8th (...)

      @@leef_me8112 sorry but it actually does. It made the civil right of photography known in 4 states. Now when a cop says they didn't know the judge will tell them ignorance is not an excuse. So maybe you should go to the horse's mouth, Mr.Turner and ask.

      Ranco Law Recommended by RUclips. I watch a lot of First Amendment auditors/cop watchers like the Battousai of Austin (of Turner vs Driver fame), News Now Houston, etc. You should get with them to increase your RUclips subscribers (their recommendations will get you thousands). They are active all over TX, and now Louisiana, fighting police and FBI abuse, false arrest, illegal detention, and lack of accountability. They need good lawyers who are interested in this fight.

    I had an issue with Laredo Police department disarming me, ripping my phone while recording officer, searching me and tearing a ligament on my shoulder... ALL INSIDE MY PROPERTY

    So, to put the timeline and actionable items into perspective, the council had from February 2016 all the way (almost a full year) up until January of 2017 and nothing on the agenda. In the first place, they really shouldn't have a 3-minute time limit to fully express the issues before the council. Honestly, I feel like the ONLY reason she mentioned there would be follow-up communication to Mr. Ranko's testimony is because now it's much more visible and in the records, so to speak. Sounds like they simply tried to sweep it all under the rug. Shocker...

    I think Austin needs to require each and every police officer regardless of where they work to carry malpractice insurance equal 1/4 of their check. citizens and taxpayers should not have to pay this when cops can do whatever they want and cause fear and chaos

      to make a point clear, damages and awards to a person winning a lawsuit our settlement should not come out of taxpayers money but rather the police department and each and every police officers malpractice insurance

    If they refuse to pay then go back to court for summary judgement. When the required time has passed, go get a deputy sheriff and go into the chief of police office and start to collect. Take everything in his office, to include the carpet. That will get the ball rolling.

    I love how these çity councils always put a two or three minute time limit on expressing your grievances toward them! It's just another way to blow the public off and have no accountability ! There should never be a time limit!!

    No respect or concern for what this man has been through.
    Not one word yet scurries a man standing up for injustice.
    How spit in the face obvious this panel of individuals value injustice over honorable law enforcement.
    This is on every level if it passes through the syphoning of DA’s desegregation. It’s BS.

    Is this about typical politics? We've ignored the problem and your particular claims for years and years, but if you would have just been patient we'll have an answer for you by tomorrow.
