Hi Alice! Thanks for your comments. The last prong should really be a culmination of the first 2 and be a natural way of finish your case off. People struggle to understand it but if you have an endeavor of national importance and you are well positioned, this is just summarizing and presenting the case. A good one to use is to remind them that labor certification looks for minimum qualifications and you are way more qualified. I may make another video in the future but I am currently busy with other things!

No, it's separate
In my partner’s case, she already works as postdoc on a J1 in US and has a corporate job offer. We see EB-2 as a way to be able to stay (and work) long-term and independent of employer (also for me, the spouse)
Having said that - is this ‘Matter of Dhanasar’ still relevant in our situation, or does it apply only for individuals who are not yet in the US?
Hi Maximilian. The answer is yes, the Matter of Dhanasar applies to candidates from both abroad and from the US. It is the way you are going to be judged by USCIS if requesting the NIW so you can self petition. It is independent of where you are. In your specific cade either your or your spouse would be the petitioner and then if approved the other person can also adjust their status . Of course, this is not legal advice,only my personal opinion with the info provided

En general no tiene sentido que el endeavor no esté relacionado con la experiencia pero todo depende del caso y yo no te puedo dar asesoramiento. Saludos!

I have a question: For a person applying outside of the US, when EB2-NIW is approved, an immigrant visa is needed to enter the US.
I have heard that when a person applies for an immigrant visa at the US Embassy, It is often asked to provide an offer of employment in the US. (even though NIW waive off the employment requirement). Could you share your experience regarding this? thanks
An offer is not needed for EB2 NIW. If there is an offer you can certainly use it as evidence for being well positioned ,but it's not required. When the approval comes you get a card that can be used to enter the US and then you get the final green card after paying the necessary fees. Thanks

Hello, I have an email from my current employer that says as per company practice they don’t go directly to green card directly without H1B lottery which itself isn’t guaranteed , can I use that as an example or the officer can argue why don’t he apply to another company ?

Hi there, I do not fully understand your message. However, traveling depends on what status you are in. It is best to consult with a lawyer, and in case of doubt, do not travel.
@@OscarsGreenCard I received deny for my case. I’m gonna appeal it, and during appeal go abroad for 1 month. And come back start new case 2nd. My lawyer said I can go abroad during appeal. But I wanna make sure that it’s not dangerous
@@DannaBeautyInc I would listen to my lawyer! I am not super familiar with appeals. What I do know is that they generally take a long time. It is typically advisable to rework the petition and resubmit.
