    Oscar, thanks for our support and this amazing video. All information was crystal clear. However, you should mention that the USICS takes time to send you the acceptance of your application called notice of action. I am applying from Australia, and I have not received it yet (2 weeks).

      Yes, but the notice of action you are referring to is for the I-140 petition, not the consular processing part. That notification does take time unless you have filed a request for electronic notification (form G-1145). It can take anywhere from 2 weeks if you are in the US and they are fast to many weeks if you are abroad. A good way to check if they accepted your petition is to see if the cashed out your check, money order, or credit card. Cheers

    I have a question about the Interview. Should we prepare for follow up questions about our application? It's that a time and place to defend why we are of national interest or at that stage the application was already approved by the officer that did the I-140 package review?

      Hi Daniel, thanks for your words of encouragement. Regarding the interview, I would not spend a whole lot of time preparing to defend your national interest. You will be asked more questions related to your family (if they are coming with you too), may be asked to show originals of the civil documents. They may ask questions about your plans but mostly to double check consistency, it will not be a super detail exam or anything like that. They may ask you again a few of those crazy questions like "have you engaged in terrorism in the past?" and so on...even if you had to answer them online before going there.

      Hi! Theoretically no, as EB2 NIW petitioner you are self petitioner and you should not need it, but once you get into the Consular Processing part of the process you will get direct requests from the Consulate as to what exactly you have to provide.

    Thank you Oscar. Please the main applicant did not attend to the NVC Invitation after one year does that make the approved I-140 invalid? The clear question is can approved i140 expire?

      Probably, but nothing stops you from trying . Yes, and I-140 can "expire" , it's not an expiration but they can consider your case abandoned

What would you advise someone who will not be staying permanently in the US after the green card has been collected but will be coming in once or twice a year till he or she makes up is mind to stay permanently?

      I don't give that kind of advice, consult a lawyer if you have these type of specific questions about your case. The green card is to stay *permanently*, which means you have to mantain residence in the US for at least 180 days a year and show you are indeed residing @@obasanjobolarinwa6904

    Dear Oscar, thank you very much for your informative videos. I have been watching your videos from last few months. It has been helpful for me. I am currently outside US and plan to file petition from here. Could you kindly infom me where do we mail our petition to? The USCIS website has listed out two USCIS addresses, Dallas Lockboxes, Dallas, TX for using USPS and Lewisville, TX for FedEx, UPS and DHL deliveries. However, USCIS mentions these addresses to use to file I-130 forms. It does not categorically mentions where to mail I -140 petitions if they are mailed from outside US.

    Congratulations on your excellent work in explaining the E2B-NIW application process with great clarity for "DIY". I have a question that may have already been answered, but it's not entirely clear to me: Once you complete Consular Processing, get the visa approved and hear "welcome to the USA," my understanding is that you have 6 months to enter the U.S.. So, is it possible to enter for only 48 hours and return to my home country (in this case, Argentina) and wait for the Green Card at my home? in other words, is it an entry for formalities to complete the process? kind regards!

      Hi Carlos, thanks for your words. No, that's not possible because you won't get your green card in 48 hours, you will need to wait until they mail it to you in your new residence in the US. Also, keep in mind from that point onwards you will need to maintain residence in the US and there is a definitition for that you can google , among which is spending at least 180 days a year in the country.

      Hi Oscar! Thank you for your response. I understood from one of your videos that the green card is sent to the address provided in the DS-260 form. In this case, it would be Buenos Aires, as I am going through Consular Processing from outside the USA. According to your reply, do they ask for an address to send the Green Card when you enter first time into the USA? This is crucial as it affects the ability to pursue certain jobs until obtaining the card. Thanks again!@@OscarsGreenCard

How long will it take to get greencard. And how would we be able to travel outside usa while greencard is in process?

      Hi, thanks for your kind words. If you pay the USCIS immigrant fee as soon as you get stamped it should take a few days to a couple of weeks after you enter the US, if circumstances are normal .

    Oscar, it’s me again. I hope you remember me. My mom got her I-140 approved but she already left the US. We thought that the result will come out before her visa will expire. So we put on the I-140 form Part 4. Processing Information that she is in the US and do the adjustment status in the US. But she already left the US because she doesn’t want to overstay since her visa has ended. What do we do since she already left? How can she do the Consular Processing in her home country?

    Can I submit my EB-2 NIW petition while I am here in the US on J-1 visa and opt for Consular process (instead of adjustment of status) from the home country? As you mentioned the Consular process can be done in an year's time. Thanks.

      Hi Sumera. Thanks for your words and support. You can always opt for consular processing even if you are in the US, however note that you will need to go abroad to the Consulate of choice once you need to start that part of the process.
      Two things about the J visa: check if you are subject to the 2 year rule because if you are, applying for green card is problematic. Two, if you are not subject to that rule you can do what you propose but you will not be able to re-enter the US until you have completed the Consular Processing.
      I don't think I said it can be completed in one year time. The processing time for consular process may vary depending on which country you are applying from, and these times are not very transparent, but you could check with you US Consulate/Embassy to see if they disclose the expected processing time. As usual, this is not legal advice! Please seek the advice of a lawyer for specific questions. Thanks

      You have to refer to the official website and read carefully. It depends if you do premium processing or not, and for applying from abroad you always use the address for UPS/Fedex

      @@khans3502 i can't agree with that . There's so many professions and profiles that can claim national importance. Let's say you are an engineer working in infrastructure related to renewable energy. It's quite easy to make the connection between your contributions and the US climate objectives. You don't need to publish research at all to be able to write a good petition

    But in case of the Consular Processing EB 2 NIW approved you don't need the affidavit of support (where actually the button for uploadng should be)... and so there is no buttons to upload Civil Docs when you applying DS 260. NVC publishes on their web site that they won't begin to review the DS 260 if you do not upload civil docs... So how civil docs should be uploaded?

      You do not need affidavit support for EB2 NIW. Also, right now for EB2 NIW they are requesting mailing the civil documents, NOT uploading them. Please follow the instructions from the welcome letter. Only the DS-260 is submitted electronically. In my course I explain that.

    Hello Oscar, just one more question about consular processing. Is it possible to hire a law firm for the first part of the process, which is preparing and sending the I-140, and then, "do-it-yourself" style for the second phase. I'd apply from abroad, so I guess I don't need I-485. Thanks again for all your help!

    Hi Oscar, I have a question. I have an approved I-140 from EB2-NIW with a priority date of October 1, 2023, and I received a notification from NVC because I applied outside of the U.S. Due to delays in getting my priority date current, I applied for EB1A and recently got it approved. Since the EB1A priority date is current, will I receive another notification from NVC? My EB1A priority date is also October 1, 2023, and it is current, but I have not received any notification from NVC, and it has been more than 3 weeks since my EB1A was approved. Will I receive another notification from NVC, or is it one notification for EB1/EB2?

      If you are asking for I-140, there is no difference between filing from abroad and from the US. They all go to USCIS. I explain this in detail in my course payhip.com/b/gfuRU

I wanted to ask two questions: 1) how much money do we have to show in our bank accounts if we are going through NIW EB2? 2) do you think it is necessary to apply for consular processing through a lawyer? I have travelled to other countries before so I am confident that I can complete everything myself. Do you think it is worth to spend about 4500 USD in lawyer fee after getting I-140 approval just for filing the visa application? Thansk alot.

    I contacted the embassy to check on the EB2-NIW and they told me you cannot petition yourself. I even cited the USCIS website which clearly states that you can self petition and they still said no.

    Thank you for very informative video. I regularly followed your video and guideline for EB2 NIW. I filed by myself and approved in 3 months on February 5,2024. Online status showing that approval notice sent to NVC..you will get responce from NVC till March 6,2024. No any responce yet from NVC.     Thanks for the clear explanation. However, I have 2 questions.
    1. Can I apply for myself(principal applicant) now and attend the consular process alone then after 6 months ,pay for my 4 dependants.
    2. In my welcome letter from NVC, I was told to submit affidavit of support. Is this because of the dependants on my petition? Or is it a new criteria. Kindly advise

    Hi Oscar! I hope you are doing well! My I-140 NIW has been approved, and I received a letter from the NVC stating that my case is currently not eligible for further processing due to the limited number of visas, and I should wait until my priority date is lower than that in the bulletin. The letter does not contain any instructions regarding document submission and fee payment. In your opinion, is this the expected situation? I am applying abroad (consular processing). Thank you very much.

      1-Yes, always country of birth, doesn't matter where you are or what's your citizenship.
      2-No, you can choose any consulate

      Hello Oscar, the Affidavit of Support is a bit confusing. For a self-petitioning EB2-NIW who has never resided/worked in the US and relocating with family, how should one go about the Affidavit of Support especially when NVC sent a letter asking to include an Affidavit of Support. The income of the self petitioner may never meet up and may not meet up the poverty bench mark. Also, as one that was exempted from paying the Affidavit of support fees, should form I-864W be filled out instead? Kindly advise.

      You'll have access to the CEAC portal online , that's the first step in consular processing , to open the online profile

    Hi Oscar, need to confirm one thing. Adjustment of status means that you already have a US visa for instance B1-B2 visit visa and now u are applying for NIW EB2 then you need to tick ✔️ the adjustment of status on form? Is there any form which is called adjustment if status form?

      Hi Wardah, both are correct. In the I-140 form you need to indicate if you will later file an adjustment of status. Then, when your priority date is current, you will need to file an actual adjustment of status form (I-485).
      Alternatively to all of this, you may indicate you are abroad and will receive the final approval through consular processing.

      @@mylifeisinhishandsamen4167 it's called visa but it's not a nonimmigrant visa, it's the visa associated to EB2 that is valid to enter the US to then receive the green card. Embassies do not publish processing times for immigrant visas
