It’s pretty weird how the judge just skimmed over the whole carbon monoxide leak issue. That shit is a silent killer. People die from carbon monoxide leaks. That alone is enough to leave.
CA rents are very high, especially in Los Angeles and SF, but the landlord must provide heat. That's the law. AC is on the tenant. If a place is uninhabitable (which no heat in CA means yes) you shouldn't rent it. Also, in CA you have the right to withhold rent if a problem occurs and is not dealt with timely. Example: I have no hot water ... notice is given to landlord .... 2 days go by .... you can start withholding rent per diem until it is repaired.

That's ridiculous--after all the aggravation--no heat in November and December--electrical issues, gas and carbon monoxide issues, the plaintiff should have received two months rent at the least. The defendant had no right to rent the rooms in such deplorable condition. Hope the City fined her.

I don’t know how I feel about this one, I believe that the plaintiff was, or at least should have been, entitled to get more of her rent back. The landlord was shady and blatantly slinking around the rules of renting out living spaces to people, and from the sound of it has been from years. She rented such a high priced apartment knowing all the problems it had and when someone complained she would behave just like she did in court, “well they could have just done this.” There is a major health and safety issue here I feel and if her property was inspected I wouldn’t be surprised if they told her that she wasn’t allowed to even rent out that space until it was properly fixed up.

That's the longest sentence without any punctuation I've read in a long time. It would be beneficial for the reader to be able to decipher where exactly there should be a comma, period, exclamation mark and whatnot.

I think the judge made a mistake by not giving her back 90% of her rent to send a message to landlords to keep their rental units livable, in many cities if you don't have an occupancy certificate you can get all your money back.
Every landlord is required to have these things installed and working by law. Stove , Fridge , Toilet , Shower or Tube , Kitchen sink , Bathroom sink , Heat , working electric , working water , working gas , a smoke detector and a window that is emergency acceptable incase of fire. If any of these things stop working and landlord won’t fix it you can withhold rent.
By law it has to go into an escrow account if you are withholding it & a certified letter stating why to the landlord. However, you still have to have one or two complaints before you can withhold if they don’t fix it.
A grounding issue isn't just a fire issue, the heck! It's a you will die issue if you become the path to ground! Electricity is looking to go to the easiest path to ground. If it's not grounded, and it finds you to be the best and easiest path to ground, it's gonna go through you!

That way the landlord will have to show proof of repair before they can collect the money but knows the money will be available following repairs. Use an escrow account. Needing repairs doesn’t give a tenant the right to stop paying, therefore, pay into an escrow account.
It's illegal to not have working AC/Heat in a unit you are renting. It's seen as unethical. If you don't have money to operate a renting business, you shouldn't be doing it!

I'm from California and now i live in Alaska I rented a home for 3 1/2 years and the heat went out something is not legal to happen if it does it has to be handled RIGHT AWAY! Me and my children were without heat in the middle of Alaska for months and they told us to buy fire wood. Bull shit 😤
Harvey asking people of someone can withhold rent for lack of heat (he's done this with other cases about other issues) - it's a question that has a state specific answer as laws vary from state to state on that score. For instance, in Alabama you can NOT withhold rent, unless you want to be legally served with eviction papers, for anything wrong in the place you rent. You are allowed, by law, with the landlords written permission to contract and pay for the repair and take that amount (with receipt) out of the rent - but if the landlord doesn't give you written permission to do so you're SOL and you have to eat the repair cost and pay rent. In some states like Alabama, the law and the attitude is "if you don't like where you live - move". Unfortunately landlords will use this to their advantage when they want someone out. So Harvey the Lawyer - you oughta know better than to ask a general question that does not have a blanket, accurate answer - oh wait ... he was a lawyer so asking such questions is exactly what they do!
The defendant is one of the reasons why we have such pro-tenant laws. I own and rent homes and it's getting difficult every year because I keep losing rights. It's renters like the defendant who is the reason why it will take two years to evict a tenant for nonpayment of rent. As a youth we lived and a home owned by a slum lord and he did horrible things to us if my mom was late on the rent. He would shut the water off, turn the power off, and he shut off the heat. Just for being a month behind. I understand and agree with a majority of the laws in place to protect renters. By now the pendulum has swung way to one side.
Harvey's questions are funny, yes, you can withhold rent for heat, and not only that but if it's not fixed it can be considered a constructive eviction and the tenant can break the lease without the penalty. it is a requirement in all houses and apartments that are rented, you don't have to supply AC, but you do have to provide heat, and space heaters don't count. This landlord needs to have a lot of work done before re-renting that place, but I guarantee that she rented it again and didn't fix it

Neither one seemed like a "bad" person, but I can't help but just LOVE how beautiful the plantiff was. ...and I'm referring to the way she carried herself, her poise, her class, and even her reaction when she got embarrassed. Does my heart so good to see a young, classy women showing the world what a true lady looks like and how a true lady handles herself. Hats off to her and I'm assuming her parents.

I'm from California and now i live in Alaska I rented a home for 3 1/2 years and the heat went out something is not legal to happen if it does it has to be handled RIGHT AWAY! Me and my children were without heat in the middle of Alaska for months and they told us to buy fire wood. Bull shit 😤
Harvey asking people of someone can withhold rent for lack of heat (he's done this with other cases about other issues) - it's a question that has a state specific answer as laws vary from state to state on that score. For instance, in Alabama you can NOT withhold rent, unless you want to be legally served with eviction papers, for anything wrong in the place you rent. You are allowed, by law, with the landlords written permission to contract and pay for the repair and take that amount (with receipt) out of the rent - but if the landlord doesn't give you written permission to do so you're SOL and you have to eat the repair cost and pay rent. In some states like Alabama, the law and the attitude is "if you don't like where you live - move". Unfortunately landlords will use this to their advantage when they want someone out.
So Harvey the Lawyer - you oughta know better than to ask a general question that does not have a blanket, accurate answer - oh wait ... he was a lawyer so asking such questions is exactly what they do!

The defendant is one of the reasons why we have such pro-tenant laws. I own and rent homes and it's getting difficult every year because I keep losing rights. It's renters like the defendant who is the reason why it will take two years to evict a tenant for nonpayment of rent. As a youth we lived and a home owned by a slum lord and he did horrible things to us if my mom was late on the rent. He would shut the water off, turn the power off, and he shut off the heat. Just for being a month behind. I understand and agree with a majority of the laws in place to protect renters. By now the pendulum has swung way to one side.

Harvey's questions are funny, yes, you can withhold rent for heat, and not only that but if it's not fixed it can be considered a constructive eviction and the tenant can break the lease without the penalty. it is a requirement in all houses and apartments that are rented, you don't have to supply AC, but you do have to provide heat, and space heaters don't count. This landlord needs to have a lot of work done before re-renting that place, but I guarantee that she rented it again and didn't fix it

This lady's behavior should should be recorded and be a lesson to every black people in the world. This lady could be the best sales person . I would give her a job any minute. She is a people person..
