Better to bring more then enough evidence for your claims then to be unable to substantiate them. How many times has one party claimed something happened but fails to bring texts or contracts? Anything you think is relevant to some degree is something you need evidence for in court. You have no idea what the other party will claim was said or not said, agreed on or not agreed on.

This is my current landlord. She was smiling & honest when we 1st met. She has since not acknowledged her property is trash. I have photos of a flooded basement, a caved in ceiling, damp floors in my bedroom that won’t dry, mold in the kitchen that she simply said clean w/bleach that returns weekly. There is trash in the basement that rotten & molded when it flooded from the water heater & she did absolutely nothing about it. Sadly in GA landlords have the upper hand on tenants. So even with photos & having never missed a month of rent I would have no case against her. Not to mention she’s accessed the home while I was in the shower. I came out as I live alone w/my firearm &bc I hheard her husbands voice & she says well we rang the doorbell. Excuse u? The lease says 24hr notice. She several times has text a couple hours before & says some1 needed to access the home. Ma’am follow ur lease. I cannot wait until June.

I'm a landlord living in a very "low cost of living" city and their repair bills and lawn care withheld were lower than mine! I am often told my repair costs are low even for where I live. I can do all my own repairs since I'm a retired construction contractor. They seemed amazingly fair with their counterclaim. The only thing I didn't like about the landlords was the alarm system ordeal. They should've had their own contract to buy the system separate from the tenant or pay for it outright and let the tenant decide to have it monitored for an additional fee. I own my alarm systems and they work perfectly and the tenant can choose to have it monitored or not at their own expense.

Yes very reasonable landlords. I was without a properly hot water system for 16 months. The hot water system had a broken valve so that when you used it there was cold water entering which only gave about 2 minutes of hot water. It was a very cold 16 months of showering. 😆

I am under the understanding that she took over the contract. However, she demanded a walkthrough before she moved out (else they would have called out "where is our stuff?" during the walkthrough), and changed the locks out of malice of being evicted. So with those to go by, I am thinking that they transfered their contract with Vivant to her as then she would be considered the primary and not a trespasser in the home, and she either called Vivant to transfer it back (which they cannot do without the second party's concent) or demanded her landlords to take it back prematurely (allowing her time to screw around with their credit by hitting the panic button 5 times a day) I think her problem was feeling insulted about being evicted and wanting to find a way to make them pay, else she would have either paid Vivant's cancelation and kept the system (though it does cause safety problems) or leave it in and then sued the landlord for the return of the system or the money owed.
The alarm system was theirs to pay. When, she took over as she said paying on a monthly to month. They, should have retained the outstanding billing. Because, they initiated it. The judges ruling is legal but improper in my opinion. The curtain rods & items taken were likely taken by her. I think by the being asked to leave and incurred extra expense of getting a new place she was angry.

She didn't pay a $6000 deposit, it was $1950 I believe, the $6000 included her bill she got from the alarm company for taking out the alarm system when she left.
Her deposit was $1500 and in her state she can sue for double the deposit if it's not returned. That makes her claim $3,000. The other $3,000 was for the alarm system.
Ummm she owns that alarms system. She only canceled the alarm contract because the landlords wanted the apt back before the maturity date. Why should she pay over $4000 for a contract she had no choice but to end, and still leave the equipment behind? She might as well had kept it, like she did.🤷🏾♀️

But she didn't have to cancel the service even if she left the apartment, she could have just transferred her contract to her new place.
Wow.. These landlords are actually really nice! They are not charging stupid money! We had a landlord who charged us £29 for fitting a light bulb!! We actually supplied the light bulb but it was in an inaccessible place and it went about 30 mins before we left. So we left the new bulb on the side with a note explaining that we could not access it. So the charges these two had were really reasonable. If not pretty low! She's just messy... No matter how she's dressed.

The judge didnt allow the plaintiff to speak. The alarm system was ALREADY in the home and the tenant had the option to activate the alarm. She didnt purchase the alarm system, she purchased the monthly service and then the alarm company charged her for the equipment.
Having the hardware in the home is one thing....she signed a contract for the alarm SERVICE and then didn't want to pay up. The plaintiff is completely in the wrong and owes the alarm company for the service they provided.
Well she activated the service with the existing equipment. She asked to disconnect because she was moving. Only way makes sense is that she took the equipment with her so owes that cost to the alarm company. In which case its between her and the alarm company and not the Defendants. Note the Defendants have not asked for the equipment back, they are leaving that issue for her to sort out with the alarm company. She should have left the system in the rental property.

This is why I got out of the residential rental game, people have no respect for property they rent, landlords lose a ton when you go through evictions and repairs between renters, in the end it's nothing but a headache and courts usually show too much sympathy towards the renters and the landlords get F'd, if you evict a renter and the court decides the renters need time to find a new residence, the landlord can lose up to 2,3 or even 4 months of rent money essentially allowing the renters to live for free at your apartment without paying a dime while they search for a new place, it's a nightmare! You get to keep the last of the rent withheld but the deposit can't go towards any other month they're allowed to be there for free while looking for a new place, just awful, and made worse if the renters are on section 8 housing or have children, the courts allow plenty of time to renters to look while the property owner doesn't get squat, no thanks I only do commercial/business rentals now, way easier

@@Sera-Marie It was part of the security contract that after payments of 1year were to be completed, then the equipment was hers, that is why she kept it. She couldn't get the owners to take over the payments or negotiate the security lease with her. Petty yes, but I think she was entitled.

This lady is dressed very classily and is an attractive lady, she has style and poise but reading these comments I wonder what does her attire has to do with a contract dispute? This was a landlord-tenant dispute, a contract dispute that escalated because the plaintiff did not read the contract.

Her problem was with the security company not the landlord. She signed the contact with them.
I am under the understanding that she took over the contract.
However, she demanded a walkthrough before she moved out (else they would have called out "where is our stuff?" during the walkthrough), and changed the locks out of malice of being evicted.
So with those to go by, I am thinking that they transfered their contract with Vivant to her as then she would be considered the primary and not a trespasser in the home, and she either called Vivant to transfer it back (which they cannot do without the second party's concent) or demanded her landlords to take it back prematurely (allowing her time to screw around with their credit by hitting the panic button 5 times a day)
I think her problem was feeling insulted about being evicted and wanting to find a way to make them pay, else she would have either paid Vivant's cancelation and kept the system (though it does cause safety problems) or leave it in and then sued the landlord for the return of the system or the money owed.

The alarm system was theirs to pay. When, she took over as she said paying on a monthly to month. They, should have retained the outstanding billing. Because, they initiated it. The judges ruling is legal but improper in my opinion. The curtain rods & items taken were likely taken by her. I think by the being asked to leave and incurred extra expense of getting a new place she was angry.

Ummm she owns that alarms system. She only canceled the alarm contract because the landlords wanted the apt back before the maturity date. Why should she pay over $4000 for a contract she had no choice but to end, and still leave the equipment behind? She might as well had kept it, like she did.🤷🏾♀️
@@franceskittrell8761well she admitted the alarm system equipment was in the apartment when she moved in, so it's not really hers to take but I guess the landlords didn't bother to countersue for that. But she didn't have to cancel the service even if she left the apartment, she could have just transferred her contract to her new place.
Wow.. These landlords are actually really nice! They are not charging stupid money! We had a landlord who charged us £29 for fitting a light bulb!! We actually supplied the light bulb but it was in an inaccessible place and it went about 30 mins before we left. So we left the new bulb on the side with a note explaining that we could not access it. So the charges these two had were really reasonable. If not pretty low! She's just messy... No matter how she's dressed.

The judge didnt allow the plaintiff to speak. The alarm system was ALREADY in the home and the tenant had the option to activate the alarm. She didnt purchase the alarm system, she purchased the monthly service and then the alarm company charged her for the equipment.

Having the hardware in the home is one thing....she signed a contract for the alarm SERVICE and then didn't want to pay up. The plaintiff is completely in the wrong and owes the alarm company for the service they provided.

They charged her for the monthly service fee .. she just stole the equipment that the defendants had already paid for .
Well she activated the service with the existing equipment. She asked to disconnect because she was moving. Only way makes sense is that she took the equipment with her so owes that cost to the alarm company. In which case its between her and the alarm company and not the Defendants. Note the Defendants have not asked for the equipment back, they are leaving that issue for her to sort out with the alarm company. She should have left the system in the rental property.

This is why I got out of the residential rental game, people have no respect for property they rent, landlords lose a ton when you go through evictions and repairs between renters, in the end it's nothing but a headache and courts usually show too much sympathy towards the renters and the landlords get F'd, if you evict a renter and the court decides the renters need time to find a new residence, the landlord can lose up to 2,3 or even 4 months of rent money essentially allowing the renters to live for free at your apartment without paying a dime while they search for a new place, it's a nightmare! You get to keep the last of the rent withheld but the deposit can't go towards any other month they're allowed to be there for free while looking for a new place, just awful, and made worse if the renters are on section 8 housing or have children, the courts allow plenty of time to renters to look while the property owner doesn't get squat, no thanks I only do commercial/business rentals now, way easier
