    Not even 'just' talking on his phone, but clearly trying to text and drive which is simply insane. He clearly doesn't realise how lucky he was not to have killed somebody there. What an arse.

      DrMorocho That's just not enough though. The law says that using a mobile phone while driving is punishable by 3 points and a £100 fine. This is direct evidence of this dangerous act and it is going unpunished? Typical British justice system.

      Usually a magistrate will demand a video with a date stamp, and clear vision of the driver. If this guy got a ticket in the mail, decided to contest it in court, he could argue he wasn't the driver. A lot of taxpayers money get's tied up. Get police bodycam video of him admitting to the offence, then ticket him.

      They should - after all, it's a greater safety problem than cyclists passing stationary buses, in cycle lanes on their left, and they made up stickers for that (despite it running contrary to the hierarchy of provision).

    Whilst the pedestrian is on the crossing All of the traffic should be Stationary, and Not preceeding because their half of the crossing has been cleared by the pedestrian.

    Do NOT continue through a zebra crossing until all pedestrians have reached the opposite side. You don't pull away once a pedestrian at the crossing has cleared your side of the road but is still on the crossing. The driver and the cabbie both did this. And so did you, on your bike.

      Even without an actual prosecution, there's easily sufficient for a warning under s59 of the Police Reform Act.
      And probably more effective - the threat of losing a 50k motor is probably more of a concern than a few points on his license, even if it increases his insurance by a few hundred quid a year.

      That's a lie they like to tell to excuse their laziness.
      In fact, anyone (including a police officer) viewing this video is a witness to the offence, so there is no reason for a police officer not to issue a ticket or summons based purely on the video.
      The threshold for a s59 warning is even lower - it only requires that a police constable have "reason to believe" that the offence has taken place and has caused alarm, distress or annoyance to someone.
      A single witness statement is sufficient for that, even without any video evidence.

    I get the same thing all the time. There were 3 today on a 10 minute walk. They couldn’t care less. One I reprimanded just responded with ‘and’ it didn’t get caught’ He didn’t care that it was illegal or dangerous. None of them do.

    At the start of the video there are two tour buses parked in a
    marked parking space, I wonder why the authority's have installed the parking space right opposite a traffic island where pedestrians cross. Forcing them to emerge from between the parked buses. Bad Planning is as bad as distracted driving.

      Michael peberdy I think these penalties need to be in proportion with other driving offenses. For instance in Western Australia driving 20km/h over the speed limit cops 3 points and a $400 fine, about the same as using a mobile phone whilst driving. I don't really think driving using a mobile phone is a 4 or 5 times worse offense than speeding 20km/h over the limit.

    Though the phone use while driving is a major problem, the video shows that his view was likely partially obstructed by the white van blocking his view of the female pedestrian. He stopped later than usual when she had come into his view. The female pedestrian is also holding a phone to her ear on the same side of her face as that of the car approaching. Therefore she may not have noticed the car in time for her to react accordingly.

    Using phones when driving isn’t punished properly. Our legal system has to get serious about this offence.
    They jump up and down about twenty zones being extended but what’s more dangerous? Not looking at the road in a city centre or doing 30 instead of 20 through a small village?

      ALL videos of people driving while using their phones are bad. Whether it is for 1 second or ten minutes they offer a distraction which, as is all too often the case, can lead to an injury or worse for a more vulnerable road user such as a cyclist or pedestrian.

    Is that it, that all you do just film, do you send the evidence to the police do a follow up anything, or do you just horde the clips and rewatch them later.

    Just an "FYI"... in the US, lane-splitting is illegal and considered reckless. Motorcycles are supposed to be given, and use, as much space as a car (exception: when 2 bikes are travelling together).

    Clearly no-one is arsed about the 6 points and a fine.
    I'd Change the law, and give an instant 12month ban, and a couple of grand fine.. I see 👀 about 1 in 5 drivers of all ages don't give a toss about the laws in place.

    While I agree that this use of his mobile is very wrong and it needs to be stopped I have to say that some of the comments here are simply stupid. To support damaging the car or the person or both takes you into the same level as he is. Also think of the risk to yourself. People have been injured and even killed doing just this kind of thing. Don't think it won't happen to me. It happens to someone. If you are that concerned report it to the police and be a witness.

    What do you expect. Mercedes drivers are exempt from the law and he looks like a foreign national anyway so will just say he doesn't understand
