Teen Accused of Dumping Baby in Trash Gets Win in Court

  • The trial for a New Mexico woman accused of killing her newborn baby and leaving him in a hospital bathroom trash can has been delayed. Alexee Trevizo's trial for the death of her baby was scheduled to begin later this month. But the judge presiding over her case ruled what happened at the hospital with doctors treating Trevizo is privileged and can't be used against her at trial. Law&Crime's Angenette Levy looks at the issue and talks with Trevizo's lawyer, Gary Mitchell, in this episode of Crime Fix - a daily show covering the biggest stories in crime.

    The video doesn’t mean much tbh. If the autopsy shows the baby was alive when he was put in the garbage then that’s enough for charges.

      Since the baby did not cry and wasn't appearing to be breathing, she thought, in her young immaturity, that the baby was stillborn and dead anyway. I'm not saying it's right what she did in the end, but again in her immaturity, she thought the baby was dead anyway and that maybe the stresses in her life would all go away (her mom's anger at her, the fact that she had been pregnant, etc.). She didn't wrap the baby in plastic...she put the plastic over the baby so that if one was just looking at the top of the basket, that it wouldn't look like there was a baby in there. Again, immaturity, but she honestly thought the baby had been born early and had died.

      Totally agree especially since she was taking a weight loss drug through the pregnancy to try to hide it. That stuff is def not for pregnant women either. How dare her take weight loss drugs that are a stimulant but then sue the hospital for trying to help her pain.

    Blaming the baby death on Morphine but hiding the body in the trash? She was stable enough to walk to the bathroom on her own. If nothing else she hid the baby's body. It's legal to detain a suspect pending investigation. Worrying about patient rights, but what about hiding a body?

      they asked her if she was pregnant and she said no she lied and she new she was getting morphine because when they give you a shot or anything they tell you what it is and you also have the right to ask what they are giving and she had the right to tell them she did not want the morphine knowing she was pregnant

      Luckily we have a constitution, a body of laws that the state must abide by. This would not be the first case that went south because of mishandling by LEOs and, in this case, health care workers. Not sure why you're angry with the grandmother.

    I ve had a woman deliver a baby into the toilet, and just sit there, until she got someone to call an ambulance. They never got the newborn out of the cold toilet water until the ambulance arrived. BUT because Mom didnt disconnect the umblical cord, baby lived because it was still getting blood oxygen from mom. Baby was in poor shape, but no criminal charges because she just sat there like a lump. This little twit detached umblical cord and hid the babys body.

      Exactly, like people have to understand that even if a woman “didn’t” know she was pregnant, once you deliver there’s no denying it. That’s a live, breathing human being. The levels of conscious choices one then has to make, like do we go to the hospital, do we alert doctors, or do I CUT the umbilical cord myself. And that’s literally what she did, she cut the umbilical cord, wrapped the baby in a plastic bag, and then proceeded to try to clean up the blood…and still withheld info on giving birth to medical staff until it was forced out of her. There’s no way this isn’t seen as premeditated. She knew exactly what she was doing.

      Happened in Hobbs, NM with Alexis Avila. NM sentenced her to 18 years in prison but she was out within months on appeal. NM is a ridiculous state.

Her boyfriend and boyfriends mom were at the hospital, there is another video of them in the waiting room area and cops were asking them questions about what was going on. She knew she was pregnant, there are pics of her in her tight cheerleading uniform showing how small she looked before she was pregnant and then pics of her after the got pregnant. It was very obvious to see she was visibly pregnant.

      and put another bin bag over the top. If I remember rightly she has taken the bag out, got a clean one from the bottom (cleaners often put extra clean bags under the one in use, it saves carrying them around), put the baby in the clean one, put it in the bottom and put the used one on top.
      If I've remembered that correctly from what the cleaner said, then she can't even really claim she was panicking, there's rather a lot of thought went into that.

      @@ahill4642The hospital gave her what was safe to give a woman who “may” be pregnant as they very much did suspect she was and acted accordingly. Women in labour are given morphine, it’s not uncommon. I had major abdominal surgery while 24 weeks pregnant and had many different drugs before, during and after the surgery including general anaesthetic and morphine. My baby was fine. As far as the hospital “not noticing”, she came in wearing layers of big baggy clothing, refused an abdominal exam, declined to even lift up her clothing or allow them to examine her back. It’s a far cry from seeing her jumping around a basketball court in tight leotards day in and day out as her abdomen was growing. I believe her mother knew or at least strongly suspected she was pregnant, her responses seemed a little staged. She is an only child and her mother appeared quite controlling, surely she would have been suspicious she wasn’t having her period.

      I have know of women that got pregnant and either didn't know or hid it from others, but they were all of a bigger build where it didn't show much. It is possible that the mother didn't know but I doubt there's evidence either way.
      However, the main point I was making is that only the patient and medical professionals would be covered by privilege, not the mother.

      I agree it was a bad ruling because she was 18. So saying other people(like mom) being in the room didn't wave her privilege seems like a bad call. If she was a minor, I think the defense would have a sound argument for violating her right to privacy. (because you have to have a parent/legal guardian present if you're minor.) But because she was 18, I think it doesn't apply. I'm hoping the supreme court overturns this judge's ruling.

There are plenty of instances where someone wants someone else there with them during a consultation, such as if they're getting bad news, or the other person needs to understand the condition because they need to care for them.
      But there is no evidential value in this video at all. It won't affect the ability of the DA to prosecute.

      @@ahill4642 she had already stopped her birth control and been taking diet pills before they ever tried to relieve her pain. And just so you're aware, a lot of women get epidural to deal with labor pains, and the baby was born alive before she concealed it and placed it in a garbage bag. And she removed the cord so nothing the hospital did was negligent.

      @@ahill4642women are commonly given opiates for pain during labour. Thats hardly the thing that should be the focus. They also asked her and she lied about it, and when they ran their tests, it confirmed their suspicions. Everything that happened was due to the patient’s choices.

    She went to the hospital where she had the privilege of a private conversation with medical staff to say what was going on. She was in the perfect place to get help and protection from her mother. She continued to lie. Its a two way street here.

      She was in the perfect place to get help giving birth safely, to get help keeping her Mother out of the room, to get help from a social worker to deal with not wanting to be a mother and placing the baby in foster care, to get help telling her Mother that she had a baby. It was the perfect place. That she did none of those things tells me she was frightened and immature. I bet she'll be offered a plea deal and she'll take it, serve some time and then go on with her life. Hopefully, she'll also get some therapy so that she leads a long, happy and productive life.

    The hospital where Alexee was treated was a "safe sanctuary" facility. She could have delivered the baby & no questions asked handed it to any hospital employee & they would have turned it over to Child Protective Services. For foster care-adoption.

      The attorney also lost me when he claimed that administration of NaCl (which is saline) played a part in the loss of the baby. I received like 3 liters of IV saline when I had my son.. this whole case and situation makes my brain bleed.

      Some babies don’t cry whej they come out… so it may also mean maybe she did think it was dead… but she should have taken it to a doctor immediately. She hid it and that’s literally tampering with evidence and a corpse.

      The autopsy showed the baby's lungs were working & he was breathing until his face was wrapped up & smothered in plastic bag and then placed in another bag under the bag of trash in the bathroom garbage bin.
      As a 19 yr old adult, this Mom chose to murder her son & then tried to hide him from being discovered so she wouldn't be caught.
      She then came out of the bathroom & never once admitted to having just given birth - nor until after they found her dead baby at which point she referred to him as "Nothing" repeatedly.
      The Death Penalty would be justice as she murdered a totally innocent infant & Life in Prison without Parole would be a great Mercy - anything less would be a massive disgrace & injustice.
      Every infant & child in society needs to be protected from this dangerous child murderer.

    Ask her this: if the baby was breathing when born (since she says he wasn’t), then if the baby was breathing, would she have brought him to a doctor to get medical attention?
    Even when the baby wasn’t breathing, if he was born like that then she should have got a doctor to get him medical attention.
    She is guilty on all accounts for omitting medical help.
    And if there’s nothing she did wrong then why did she hide everything?
