Im glad I requested my termination letter from the employer because now I have in writing they fired me for a protected activity (talking about unpaid bonuses). Im gonna fight for this.
I'm in Texas and the company I work for is family owned. They used our times worked during the holidays and instead of paying overtime ( the owner is ridiculously cheap 🙄) they paid us in PTO. I was upset , but let it slide. They recently during the Covid spike locally .. we had accumulated a lot of overtime and he decided to change our pay periods .. which drastically caused us to be under regular full time hours instead of in overtime and without warning. The other thing he's done to me personally is I had a dentist appointment on a Thursday and used my PTO to cover that day , but ended up having to work that Saturday which was fine I felt better anyway. Then come payday I realized my pto which was approved prior was removed and my supervisor said it's due to me working that Saturday I couldn't use pto and be paid overtime. At this point I was so fed up that i looked into our manual and it's NOT stated in there ... it said in the event pto is used with overtime that you are paid regular hours.. which should have been 6 days of regular pay .. no overtime and that's what I expected and needed. I'm asking if there are any ways I can handle this legally.. since it seems my job is doing things illegally.. and is it worth the hassle and the other question I have is should I if I sue .. look for another job? I love what I do but I hate the company I'm working for

Capn, if you informed the employer about your medical condition and they refused to accommodate your medical needs then the next step is to contact your jurisdictions EEOC office or states human rights commission and file a complaint. You can usually do this online. You may have rights to wage loss and other remedies so act quickly as in many cases you only have a limited time period in which to file your claims. My son is 23. His boss told him he has to take his check from his wknd OT to start paying him back because he made a mistake at work. My son is an hourly employee. His boss (the owner of the company) told him he's gonna give him a deal to only pay him back 2k instead of 6k. My son has been noticing his checks have been short for months prior to the mistake he made this wknd. My son fixed the mistake already but he's saying he has to come up with "a solution" himself to get him this money and he suggests $50 wkly until paid off. He's signed no contract and doesn't want to answer him. The boss already owes him money. He works FT but gives him 0 benefits also. He was accruing sick time but it disappeared. He's also not getting pay stubs anymore just checks and we found the man is being sued left and right. There's no breakdown of his pay anywhere. He doesn't know what to do and he's so young. Is liable for a mistake he made at work as an hourly employee? What about the money he missing out of his checks and the sudden lack of official normal paystubs?

Worked for a company for 4 years,Started getting sick at work! Manager took my work vehicle away and just gave me a ride home to find a neurologist on my own.. Was found to have non epileptic siezures.Was put on STD and as soon as fmla was up they told me they had to fill my position due to company hardship! Told me i would receive LTD and then I lost my medical while waiting for decision, It took 4 months for a denial and I've lost everything... Hi Royce. Sorry to hear that this happened to you. I would suggest you reach out to your jurisdictions human rights commission or the EEOC.gov and then contact an employment lawyer in your locale. The fact that you were out for so long may be an issue, but it certainly is worth looking into. Also, if they denied your LTD then find a lawyer immediately that handles ERISA claims. Is intimidation a cause to sue? I witnessed an employee commit a crime, went to an immediate supervisor, said he would handle it. Came out later he never went to higher management. So i did. They told me it wasn't illegal, they told me several lies, that what i saw was a policy violation not criminal, that nobody there liked me or wanted to work with me, told me names of several employees who had complained about me. Never mentioned beforehand. I was told it was up to the board to determine if it was a crime. I caught the immediate supervisor doing the exact same illegal thing and videotaped it. Also got several other employees committing the same crime on video. Is this grounds to sue?
Hi Kevin. Typically the intimidation needs to relate to a public policy like racism, gender discrimination, ageism or disability for example. Sometimes you may experience mental health issues resulting from the intimidation. That could raise an issue that is a human rights issue if it implicates anxiety or depression for example. Some jurisdictions may allow for wrongful termination claims (if you have been fired) when they relate to a violation of public policy such as reporting a criminal offense and being fired for it. Those cases are often difficult and need to relate to the reporting of the illegal activity. You can always contact your local human rights commission and raise the issue with them. I’m bilingual (English, Spanish) I work in NYC for a clinic office. I have to mention that there are a lot of patients who are bilingual or they only speak Spanish. They need me to translate a lot and I don’t get pay to translate. We also get interns for internships, and the majority that comes in their native language is Spanish, so I talk to them in Spanish so we could have a better communication. Today june 8, 2022 my employee told me that I couldn’t speak Spanish because in the office we have to talk in English only. Also, in the office we have variety of cultures, and languages. They speak their language when they need including the manager, but now she told me that I couldn’t because that is disrespectful. Adding that, I speak English with that ones that speaks English only, so I communicate with everyone using the language that we have in common or the easiest one for both parties. The manager told that they had a policy that mentioned that and I asked her that no one told me about it when they hired me, and if she had it that she has to show it to me (she didn’t showed it). In conclusion, all of them use me to translate for them, For their own benefit and they don’t even pay me for that, but I can’t talk to my coworkers in Spanish because “that’s disrespectful” what should I do?

Sometimes videotaping a co-worker could lead to discipline but since the context is racial harassment it doesn’t hurt to file a complaint. EEOC.gov is also a place to file for redress. My past two employers told me my taxes were not being removed because the IRS sent out different W4 forms. They did not look different nor did I file exempt on any for. But for some reason my federal taxes are not being removed. I work In a medical waste plant where we deal with needles and blood daily, well the lights went out in certain parts of the plant. I have a question. I was hired through a disability program that helps people with disabilities work. I struggle with social anxiety. The manager and her assistant have both yelled at me within a weeks time because 1) manager didn't include a full day of pay on my payroll and after she seemed to not care too much, I sent multiple emails and a photo of my timecard to corporate. If you are to make a claim for hostile work environment based on anxiety then you will need to show that the employer (supervisors or coworkers) are engaging in severe or pervasive actions. This generally means they need to be harassing you in a way that would objectively be viewed as a violation of the law. What this means in simple terms is that you have to be able to show that the harassment is related to your anxiety and it needs to be more than just ordinary work related concerns. The pay issue and yelling are probably not enough but if the yelling persists to where it creates exacerbations of your health condition, you should ask your supervisor to stop or if its a coworker tell a supervisor or Human Resources. If they refuse to do anything about it then you can go to the EEOC.gov or a local human rights commission and file a complaint. Inside the sealed packet there was a dead moth embedded inside the chocolate when i bit in to it, It was disgusting 🤮 . The first thing we can suggest is to go above his head to Human Resources or a district manager, for instance, and then report the harassment. If they refuse to help then file a complaint with EEOC.gov - document the actions as well so you have a paper trail and make sure any reports to upper level management should be in writing. I will tell you that being unvaccinated alone is not a protected category when it comes to the “At Will” laws and exceptions to those laws. However, if you are not vaccinated due to medical and/or religious reasons, the company knew this, AND you were asking to be accommodated in some fashion, then you may be able to discuss a possible resolution with either the company, or the human rights commission. For example, if they would let you wear a mask or respirator on the bus that may be considered a possible accommodation. Or perhaps they allow you to drive yourself or seek other transportation such as an Uber. The thing you will want to do is make sure you have any documents like emails and get those together and try to find a lawyer that will review that stuff and see if you can make any claims. If you are dealing with anxiety over these conditions be sure to explain your concerns and tell them about your anxiety. Doesn’t hurt to also put it in writing in case they try to fire you. The EEOC.gov can help if they do and you have discussed your anxiety and a request for workplace accommodations. Sometimes you can request to see an employee assistance program therapist to discuss these issues as well. You may also contact OSHA about the conditions and sometimes they will investigate. That code covers experimental drugs but given the fact that there have been clinical trials and now some vaccines are FDA approved - it would be a hard sell. You are better off to determine if you may be exempted by disability or based on one’s religious beliefs. If so there may be an accommodation. Regular testing may be required or masking, at least until this virus winds down.

Hello I’m from Houston Texas long story short the Job I’m currently working on first day of hire my trainer didn’t speak any English and it turns out they immediately made me get on the forklift and begin working even though I was assigned to another department that doesn’t use a forklift mainly they never train me on how to properly lift anything in the warehouse and there’s no safety training at all or protocol whatsoever they never tell you to put on PPE when handling glass it’s a glass warehouse they don’t provide and eye protection unless you directly go to them and ask for it so basically the sum this all up there’s absolutely no safety protocol training.. no sexual-harassment training or any type of training whatsoever to protect you.. today I recently dropped a pallet of glass that could’ve killed someone because it was overweight and I was immediately demoted to another position even though I’ve never received a day of training for my position I have tons of proof videos voice logs of me talking to supervisors in emails is there anything I can do legally about this or does it not matter thank you

Please help if you can, I worked for JVC through staffmark a temp agency in California my original assignment was only a few weeks. The company liked the way I worked and kept me there 4 months until today where I was fired after a normal day of work with no warning one possible signed write ups but just out of the blue ironically on the same day new employee’s got hired. I asked for sick pay for the previous week since I had a stye on my eye. It’s also felt as if the company was black mailing my co-workers and i by stating that if we do not stay overtime it will result in a negative impact on your performance report which was never shown to us. I work presently for a large company and I am a Veteran with a permanent disability for the last 8 years. 2 weeks ago my store mgr told me to get a doctor's note. I conformed and have him the letter a few days later that stated 8 years ago that I am a disabled veteran with a permanent disability. Salvatore, that is an interesting question. The real question you should probably my ask, if you haven’t already, is why did the employer want to letter. If the employer wanted a letter to assist you with a workplace accommodation of some sort then your consent to get that for him was probably a legitimate interaction regarding workplace accommodations under the Americans with Disabilities Act. If he just wanted it to harass you then perhaps you should reach out to the EEOC.gov to seek some guidance. I wish you well.

my employer is a private company in Pennsylvania. I have not received a two-week termination notice as it says in my contract. In 2016 my employer random drug tested me and I passed, two weeks later they drug tested me again and it came back inconclusive and said I failed. Twc, made us go to court and they produced two drug test with one positive and one inconclusive but neither of the test where signed and I beat them and they ended up paying me out of pocket for unemployment. Hi Apple. Sadly, it is hard to believe in the times we live in that a supervisor would say such things. However, unfortunately that is not enough to sue. You need to be in a protected class such as race, disability or age for example and you are either seeking workplace accommodations for some reason (i.e. medical leave) or you are being harassed due to your gender, age or race, for example. If the employer or supervisor causes you anxiety, for example and you tell them the harassment is causing you anxiety and ask for it to stop and then they don’t stop it, then you could seek assistance at the EEOC.gov or your local human rights commission. I was fired because of an altercation I got in with a member of my credit union. When fired I tried to apply for unemployment, I was denied unemployment for 2 months because my employer reported I was fighting but I did not fight on the job, I have the reason why I was terminated. Hey Juiceman. Defamation in employment cases are tough ones but if they are lying it may not hurt to find a local attorney and see if they are willing to take the case. If you feel you were discriminated against in some fashion then an EEOC claim may also be an avenue and while that would not cover defamation the defamation claim could be included later. I'm in Texas and the company I work for is family owned. They used our times worked during the holidays and instead of paying overtime ( the owner is ridiculously cheap 🙄) they paid us in PTO. I was upset , but let it slide. They recently during the Covid spike locally .. we had accumulated a lot of overtime and he decided to change our pay periods .. which drastically caused us to be under regular full time hours instead of in overtime and without warning. The other thing he's done to me personally is I had a dentist appointment on a Thursday and used my PTO to cover that day , but ended up having to work that Saturday which was fine I felt better anyway. Then come payday I realized my pto which was approved prior was removed and my supervisor said it's due to me working that Saturday I couldn't use pto and be paid overtime. At this point I was so fed up that i looked into our manual and it's NOT stated in there ... it said in the event pto is used with overtime that you are paid regular hours.. which should have been 6 days of regular pay .. no overtime and that's what I expected and needed. I'm asking if there are any ways I can handle this legally.. since it seems my job is doing things illegally.. and is it worth the hassle and the other question I have is should I if I sue .. look for another job? I love what I do but I hate the company I'm working for

Is intimidation a cause to sue? I witnessed an employee commit a crime, went to an immediate supervisor, said he would handle it. Came out later he never went to higher management. So i did. They told me it wasn't illegal, they told me several lies, that what i saw was a policy violation not criminal, that nobody there liked me or wanted to work with me, told me names of several employees who had complained about me. Hi Kevin. Typically the intimidation needs to relate to a public policy like racism, gender discrimination, ageism or disability for example. Sometimes you may experience mental health issues resulting from the intimidation. That could raise an issue that is a human rights issue if it implicates anxiety or depression for example. Some jurisdictions may allow for wrongful termination claims (if you have been fired) when they relate to a violation of public policy such as reporting a criminal offense and being fired for it. Those cases are often difficult and need to relate to the reporting of the illegal activity. You can always contact your local human rights commission and raise the issue with them. I’m bilingual (English, Spanish) I work in NYC for a clinic office. I have to mention that there are a lot of patients who are bilingual or they only speak Spanish. They need me to translate a lot and I don’t get pay to translate. We also get interns for internships, and the majority that comes in their native language is Spanish, so I talk to them in Spanish so we could have a better communication. Today june 8, 2022 my employee told me that I couldn’t speak Spanish because in the office we have to talk in English only. Also, in the office we have variety of cultures, and languages. They speak their language when they need including the manager, but now she told me that I couldn’t because that is disrespectful. Adding that, I speak English with that ones that speaks English only, so I communicate with everyone using the language that we have in common or the easiest one for both parties. The manager told that they had a policy that mentioned that and I asked her that no one told me about it when they hired me, and if she had it that she has to show it to me (she didn’t showed it). In conclusion, all of them use me to translate for them, For their own benefit and they don’t even pay me for that, but I can’t talk to my coworkers in Spanish because “that’s disrespectful” what should I do?

My past two employers told me my taxes were not being removed because the IRS sent out different W4 forms. They did not look different nor did I file exempt on any for. But for some reason my federal taxes are not being removed. I have a question. I was hired through a disability program that helps people with disabilities work. I struggle with social anxiety. If you are to make a claim for hostile work environment based on anxiety then you will need to show that the employer (supervisors or coworkers) are engaging in severe or pervasive actions. This generally means they need to be harassing you in a way that would objectively be viewed as a violation of the law. What this means in simple terms is that you have to be able to show that the harassment is related to your anxiety and it needs to be more than just ordinary work related concerns. The pay issue and yelling are probably not enough but if the yelling persists to where it creates exacerbations of your health condition, you should ask your supervisor to stop or if its a coworker tell a supervisor or Human Resources. If they refuse to do anything about it then you can go to the EEOC.gov or a local human rights commission and file a complaint. If you are dealing with anxiety over these conditions be sure to explain your concerns and tell them about your anxiety. Doesn’t hurt to also put it in writing in case they try to fire you. That code covers experimental drugs but given the fact that there have been clinical trials and now some vaccines are FDA approved - it would be a hard sell. You are better off to determine if you may be exempted by disability or based on one’s religious beliefs. If so there may be an accommodation. Regular testing may be required or masking, at least until this virus winds down.

Hello I’m from Houston Texas long story short the Job I’m currently working on first day of hire my trainer didn’t speak any English and it turns out they immediately made me get on the forklift and begin working even though I was assigned to another department that doesn’t use a forklift mainly they never train me on how to properly lift anything in the warehouse and there’s no safety training at all or protocol whatsoever they never tell you to put on PPE when handling glass it’s a glass warehouse they don’t provide and eye protection unless you directly go to them and ask for it so basically the sum this all up there’s absolutely no safety protocol training.. no sexual-harassment training or any type of training whatsoever to protect you.. today I recently dropped a pallet of glass that could’ve killed someone because it was overweight and I was immediately demoted to another position even though I’ve never received a day of training for my position I have tons of proof videos voice logs of me talking to supervisors in emails is there anything I can do legally about this or does it not matter thank you

Please help if you can, I worked for JVC through staffmark a temp agency in California my original assignment was only a few weeks. The company liked the way I worked and kept me there 4 months until today where I was fired after a normal day of work with no warning one possible signed write ups but just out of the blue ironically on the same day new employee’s got hired. I asked for sick pay for the previous week since I had a stye on my eye. It’s also felt as if the company was black mailing my co-workers and i by stating that if we do not stay overtime it will result in a negative impact on your performance report which was never shown to us. I conformed and have him the letter a few days later that stated 8 years ago that I am a disabled veteran with a permanent disability. Salvatore, that is an interesting question. The real question you should probably my ask, if you haven’t already, is why did the employer want to letter. If the employer wanted a letter to assist you with a workplace accommodation of some sort then your consent to get that for him was probably a legitimate interaction regarding workplace accommodations under the Americans with Disabilities Act. my employer is a private company in Pennsylvania. I have not received a two-week termination notice as it says in my contract. In 2016 my employer random drug tested me and I passed, two weeks later they drug tested me again and it came back inconclusive and said I failed. Hi Apple. Sadly, it is hard to believe in the times we live in that a supervisor would say such things. However, unfortunately that is not enough to sue. You need to be in a protected class such as race, disability or age for example and you are either seeking workplace accommodations for some reason (i.e. medical leave) or you are being harassed due to your gender, age or race, for example. If the employer or supervisor causes you anxiety, for example and you tell them the harassment is causing you anxiety and ask for it to stop and then they don’t stop it, then you could seek assistance at the EEOC.gov or your local human rights commission. I was fired because of an altercation I got in with a member of my credit union. When fired I tried to apply for unemployment, I was denied unemployment for 2 months because my employer reported I was fighting but I did not fight on the job, I have the reason why I was terminated. I submitted an appeal letter to the department of labor. Should I sue for defamation of character on a libel act because this was falsely reported on my name resulting me not being able to collect unemployment and also this has made me not being able to get a job because of this on my resume and record
Hey Juiceman. Defamation in employment cases are tough ones but if they are lying it may not hurt to find a local attorney and see if they are willing to take the case. If you feel you were discriminated against in some fashion then an EEOC claim may also be an avenue and while that would not cover defamation the defamation claim could be included later. Be careful though because the statute of limitation periods are very short for defamation in most jurisdiction so check into that with your local attorney. Stay well!

I told me employer about some comments that offended me. They brushed it off and the person was not fired. My coworkers has been sexually harassed and they didn’t fire the guy who harassed her. A trans woman worked with me and an older guy kept saying the wrong pronouns to her on purpose. My manager fired him and the company hired him back at another store. I feel like I need to do something to this company in order for them to wake up and realize how disgusting they are .
