      Had C&P exams for 3 different problems due to a TDIU claim. The C&P exams were via VES. One exam ( a primary service connected issue) the sent me a survey. I am not a dr. I did not know his results. So how can I really judge his performance? so after about a month, I sent it back blank. the scheduled me with a second C&P exam for the same thing but with a different Dr. and now another survey. This one was rude and physically forced rotating my head which left me a lot a pain for the following 2 weeks. He didn't listen to how the problems impacted my life. dismissed the related radiculopathy. didn't use the goniometer thing. Ignore the survey? I already have an attorney listed but I do not feel they are very proactive on this and communication has been minimal. H&P said they couldn't do anything unless I have them remove themselves or a statement to that effect. If my rating is not reduced I will sign up with your boot camp 1st of the month if I can swing it.

    My Chiropractor wrote a Nexus letter for me. She is 42, divorced and said she hadn't had a date in 10 years. I didn't pay her any money for the Nexus letter, but, it wasn't free.

    Craig as you might remember in one of your previous videos you taught me that its perfectly legal to write your own Nexus, and just have your provider sign it attesting to their agreeing with what you wrote! I initially paid for a Nexus letter through a company which at the time cost me 600, then drafted (Fornatted) up more Nexus letters for my other illnesses by simply tailoring my New Nexus letters with the relevant medical evidence for that particular illness, its also better bc your able to explain better in the Nexus letter exactly what you want to convey to the rater, so I got 3 diffrent Nexus letters free, as Veterans we need to help one another.       Perfect. Exactly what I did for my headaches. I drafted the Nexus letter for my doctor and asked her to sign it if she concurred. She signed it no problem and no “added cost”! And more so, no drama in waiting.
      I plan to do the same for my hypertension & AFIB as well as CENTRAL Sleep Apnea. After going through my MILITARY medical records (EVIDENCE) , I finally found two records that (I believe) identify hypertension. One record barely high enough blood pressure and one other definitely high enough. I was not smart enough to get a non-military provider doctor appointment within the first year. But at 15 months my hypertension was documented as very severe in need of medication. I will add to the letter my TESTIMONY that military medical technicians would often take multiple blood pressure readings in order to document that one of them was acceptable to maintain flight status without waiver and/or treatment which is absolutely the truth.
      So if my heart doctor concurs I actually had untreated hypertension on active duty, then the more likely than not statement signed by her will give me that Nexus. Then do the same for both AFIB (secondary to hypertension) and for Sleep Apnea (secondary to AFIB).
      Key is a good relationship with your doctor, be honest and straightforward, be efficient with their time keeping wording short and relevant with the copy of the specific medical record/evidence.

      @@SilverBulletNationas this particular comment said, write your own and have your doctor sign it. I found it impossible to find a doctor to write it. Although I did see many doctors will for a significant upfront payment.
      Or get a lawyer and they take care of it. All that can take years.
      If you already have medical evidence, draft it, make a doctor appointment for followup visit, and ask them to sign it if they concur. Done in the time it took you to get a doctor appointment if they concur and at zero additional cost.

    This is probably my most favorite video that completely describes the process to everyone who gets out only to have their disability fester long enough for veterans to reach out to the VA, only to have them stack the deck against you and kick you under the rug. It is also my favorite video that shows the complete array of options we have to kick back and get what was promised but rarely delivered. Just one additional thing I learned during this drawn out process: Your VA doctor will not write a nexus letter 99% of the time, and they typically write up your conditions and interactions in ways that negatively portray your situation, so keep that in mind during every single interaction with the VA.

      CC: I am 100 P&T as of January this year. I know I'm not scheduled for any upcoming evaluations but do I need to keep scheduling and attending VA appts to ensure my 100% stays in place or can I just sit back and chill?

      I agree 100% a VA physiatrist told me if my mom spanked me when I was young, thought it was a weird question but dint lie (she did as older generations do). In the report she put past physical abuse by my mom that made me so **** angry

    I am a 77 year old Vietnam vet that has never filed for disability. I have tinnitus, headaches, tremors and balance issues. I have had 3 heart bypass surgeries and lost one kidney to cancer. I believe agent orange did a number on me. I need VA benefits to survive and am gathering my civilian medical records now. I will submit an intent to file in the next few days and would like someone to help with or review my claim before I file it to the VA. Thanks.

      Sir, a good VSO (Veterans Service Officer) can help you compile your medical records and sort out your presumptive vs non-presumptive issues. There are VSOs at most VA hospitals and also your local veterans organizations. You will need a diagnosis for each ailment you wish to file a claim for. If they are presumptive you will not need nexus letters. If they are not presumptive you may need nexus letters. Submit your intent to file now and look for a VSO to help you.

      Hi buddy, Vietnam vet here, call the DAV, make an appointment. Bring anything you have like personal statement, buddy letters etc. To the appointment. When there sign power of attorney over to DAV. They will assist you to file an effective claim, hope it goes good buddy. I filed 26 years after discharge, was helped by DAV, recieved 100% P&T

    These videos have been keeping me motivated to continue to speak up about issues I have been dealing with for years. I would always feel ashamed to tell any provider or friend anything, but I have a family to take care of and I need to better myself with them in mind. These informational videos have helped me push forward and begin my claims process. Great job on them.

    If you were diagnosed with a chronic condition while in the military. You do not need a nexus letter from a doctor. Diabetes in the service is still diabetes when you get out 5 years later. You only need nexus when you need to prove something happen in service that's wasn't diagnosed while in service

      Would I still need a C&P exam ? I got out submitted my claim within the 1 year period and have claimed everything that was on my diagnosis and what Ive been taken meds for.

      @@tataelchapin Yes, more than likely you need a c&p exam. Unless you provide a completed DBQ by a doctor, ànd even then they may still require you to attend an exam. Think about it, how else would the VA know what rating to assign to you?

    My experience of the VA is NOT that "the VA is not a fan of veterans". I think I'm still alive because of the VA. I just got rated 100% P&T because I believe the examiners and raters tried to help me. I wrote my own "nexus statements" in personal statements in support of claim forms by doing my own research linking my service-connected condition to the secondary conditions I filed for. I know every veteran has their own story, but the VA has been good to me. At the very least, there are a lot of truly good people in the VA system.

      I 100% agree with your comment, and I have the exact same experience with the VA as you. I am also, as of today, rated at 100% P&T. I think being kind and telling the truth and having evidence to support your claim in your C-file, is enough. I had no paid for nexus, lay statements, or statements of support.

    Isn’t it ironic that a Family Practice NP practicing for 7 years is sought out by the VA to give a medical opinion of a MRI diagnosis written by a Physician that more than likely went to school 7 years to become a Dr ?

    So, if I have a claim currently pending(initial review) at the VA for anxiety, but over the last month I was diagnosed with migraines that is secondary to my anxiety. do I wait until a decision is made on my anxiety then file a claim secondary to anxiety if it's found as svc connected? I assume I can't file a secondary claim for a condition that is not currently approved/determined as svc connected.

      I asked my neurologist to write a note saying the PTSD symptoms (insomnia and such) are major provoking factors in the frequency and severity of my migraines. I sent a secure message asking if he did, and he said exactly where and what he wrote. So I have it in a secure message AND on my chart. Talk about 1 in a million chances.

    Great video ! I see you mentioned that if you are within the 12month window of getting out you don't need one. I submitted my Military Medical records that state my meds and diagnosis for the things I had while in. Will I still be getting a Nexus letter from the C&P Examiner even though I have already been diagnosed and take meds?

    I’ve been having headaches and migraines for a while, I wasn’t able to get them checked out during service however I’m still within my year. I’ve been service connected for sleep apnea and tinnitus. Im thinking about claiming migraines as secondary to sleep apnea, I haven’t been diagnosed with it but I know either sleep apnea or tinitus is causing it. I’m at %90 (86) so I’m so close to 100.
    I need one more 50%.
    If I get that I can close the gap with another easy 10 and 20.
    And I was also denied for chronic sinisitus even though it’s in my medical record.

      Go get a diagnosis from a doctor prior to filling. You will need proof that you have headaches. The doctor needs to link it to the apnea or tinnitus.

    I am a 72 yr old Army veteran. I had my C&P exam a little over a month ago. I gave my C&P examiner a copy of the Nexus letter from my physician, whom i have been seeing for 8 years. I also provided the examiner with my diagnosis after having an Electrodiagnostic test done on my left foot my examiner basically typed during my who examination. I am still waiting for the VA DECISION. I was diagnosed with nerve and muscl damage.

    How recent is considered current medical diagnosis? I was diagnosed in basic training in 2013 and had treatments in 2013 and 2017 and 2018 and 2019 for it...

    Hi CC! I don't have my left wrist surgery docs on my medical records and the copies I had disappear with all the moves I had to make. Now, My Battalion Commander wrote the following on my report card: "Due to a motorcycle accident, resulting in a fractured arm and injured knee and subsequent convalescent leave, Cid Campeador could not be scheduled for an APFT during the rating period." Is this statement in my report card enough for my wrist injury to be connected to my service?? Thanks.

    So basicaly the CP examiner works for the VA not the veteran so is baised toward a negative ( deny) The paid nexus Doctor works for the Veteran not the VA so is baised toward the veteran. ( approve). When both the (denial) and the (approval) examiners are equal in credentials and in medical evidance, in equipoise, the decison should go to the veteran.

    I would like to know if I am able to sue QTC for their service and the handling of my issue. I am saying that the original purpose for my Dec 20 filing was for my heart and not the things they are reviewing for in the deferred or in the packed act. My issue is one of my irregular heartbeats. That is the doctor's reason for my congestive heart failure that I have been to the hospital twice for, I am not poking the bear but the bear is trying to get a firm grip behind me. I would like to know if anything by your firm can deal with that matter. This medical interference or were my wording of my request incorrect. I want help on more than just what you see that they owe me. I want help on what they have denied since 2018 even 2012 when I was simply turned away. Please let me know your thoughts.
    P.S. You might be approached by some heavy hitters with deep pockets and deeper connections to misguide this case or keep at a minimal level, if such a thing happens, then the case is pennies compared to the story. I will share with anyone who brings them into the light and helps aid in proving actions that have been taken against United States citizens.

    Ok, I get 10% for service connected tinnitus (MOS 11C). 6 years ago I was tested for bilateral hearing loss and recieved hearing aids. 3 years ago I started being treated for insomnia. 2 years ago I started being treated for adjustment disorder. All these diagnoses was made by my VA PCP. Do I need a NEXUS letter?

    Be careful of out of state Dr's for a nexus letter. The VA is beginning to turn down letters from Dr's that are out of the state the veteran is using. Just was told this April 5 2024. Something to look out for.

    I have not Paid for a nexes, In FLA,I truly believe all vets may have great doc's.A State that cares.!!!!!!!But it's tough to tell the true .! If you don't,they know.repet again ,yeh if you can't .Your Done!!!!

    I told my psychiatrist that I need a nexus letter but he told me that he’s unable to write me one even though he he is willing and would love to write me one. He said he’ll write me a letter though.

    What about a free nexus from a VA doctor that diagnosis you? NOT the C&P doc. My VSO claims he has a good relationship and said every now and then, that will be given if he requests it

    I submitted an "intent to file" and i am working my case. I want to file for Tinnitus as a service-connection. I also want to file a secondary to Tinnitus for peripheral vestibuler disorder (dizziness with slight staggering), as well as Migraine as secondary to Tinnitus. My question... should I file for Tinnitus for service connection and then later file for secondaries or should I submit for every condition at the same time?

    I think a nexus letter from your VA primary dr holds the most weight....My doctor wrote me 2 and it wasn't even a complete sentence and I won both claims.... I went outside the VA , and its been a struggle

      My Va doc wrote in the remarks section of the dbq for arthritis in both knees that the veteran has developed arthritis in knees due to an injury from a fall aboard ship on active duty. But he didn’t say that stupid catch phrase the c and p examiners say …. I opine that the veteran is likely as not or most likely or not likely to have an injury on active duty because there are no documented medical records of this injury.       My VA primary wrote a Nexus for me while I was trying to get sleep apnea. She made points about (and used the famous line "at least as likely as not,") drawing connections to PTSD and service-connected asthma. She also mentioned that I am not obese, as my current BMI is 25. The VA dug back 6 years to when I was obese and said, "Nah, you're just fat. Denied." I just think it depends on if your rater is having a bad day. Maybe I'll send a box of chocolate attached to my claim next time!

    How long has the one year presumptive been in effect? I filed for rhinitis right after leaving service in 2003 and was denied. Now it’s presumptive under the PACT act, should the effective date go back to 2003?

      I don't know talk to a VSO the pact act go's bacteria to the time it was signed into law however you may be covered ask the VSO about it.

    I can't get my urologist to write a nexus for prostate cancer diagnosis. I was exposed to afff, burn training pits, asbestos lined firefighting gear as a fireman in the air force. We bathed in AFFF everyday and was told it was harmless. I sent my claim in without a nexus so waiting to hear.

    Do you need a nexus letter for an increase in migraines? Or a personal statement? Just wondering what documents to submit for increase? I’m at 30% and have had worse and more frequent migraines and my neurologist increased my medication a month ago

      I'm not an expert, but I would think that already having the condition connected you would not need a nexus, that has already been established. You would just need the report on increased medications and perhaps a running log of dates of your migraines with symptoms, duration, ineffectiveness of treatment. The log you can do yourself, the increase in meds and number of doctors visits should be in your VA medical history. You might want to look over the rating criteria for migraines.
      VA Disability Rating for Migraines
      0% Less frequent attacks (Not prostrating or less than one every two months)
      10% Prostrating attacks on average of one in two months over the last several months
      30% Prostrating attacks on average once a month over the last several months
      50% Very frequent attacks (3 or more per month) completely prostrating and prolonged (2-4 hours or more) and lead to severe economic inadaptability (Job loss, missed days at work, leaving work early due to headaches etc.)

      @@pennydittl3850 You are welcome. Just notice at the 50% level you need to show all criteria. Frequent AND prostrating for prolonged periods, AND economic impact. A strong personal statement in addition to the migraine log would be in order. From watching many of these videos and reading many articles it seems the economic impact point that trips up most people from getting the maximum 50%.

      Ok. So the economic impact would be missing family functions, outings with friends and family and having to cancel medical appointments right? I am retired from the school. When I get my migraines they are prostrating and last for several hours. As many as I get I loose many days every month from doing normal activities and daily routines and chores. My Anxiety is through the roof not knowing if I will be down and out again each day &. My neurologist increased my sumatriptan to 100mg and ibeuphron 800mg. Takes the edge off but never a full fix. I will do a log and my personal statement and give a few months to see if any improvement then submit my documents in the claim. Thanks again for all your help 🙏

    Hey Craig, I'm a current serving member of the ARNG, what are my chances of winning my claim if I lack medical evidence from my time in AIT?
    I have evidence for 1 injury and an LOD to support. But for my other injuries I lack evidence but have a current diagnosis and symptoms.

      If you have an LOD for any injury whether it's during AIT, AT, or just Battle Assembly you should be alright to file a claim. Just upload a copy when you decide to file a claim, or send one if you're filing by snail mail.

    So all my denial letters say in the positive findings, that 1 I have a diagnosis, 2 I have a disability 3 but no record of seeking treatment while in (you did not go to sick call in the USMC then unless an arm was hanging off) and they can't find a connection with my service and the disability (because I did not seek treatment or complain). It sounds to me like they are telling me I need the nexus letter and all the qualifications are met. Does this sound right to anyone?

    I was hit by a hit and run driver two months prior to my discharge and was treated on base for a month this was in 1982 and for some reason done of the treatments can be found why is this the time when they had a fire in the records area I dont know .

    I do not this k they read them, I had DBG for migraine, it was denied, went for another co, had the same doctor, she could not understand why I was back, she told me that she did my dba and should've 50% , the vs denied me

    If you been out for for lots of years nexus is a waste . 20 yrs out and I have medical civilian medical records except for about 10 yrs . 10yrs because the doctors offices destroy medical records . So i got denied because it wasn’t chronic .

      Well yeah. To file you need a current diagnosis. 10 years ago means no compensation. It must be current and you’ll need a connection. That’s the nexus.

    I got to 94% without ever needing a nexus letter. The examiner with write the nexus-if you're lucky. If not youll be denied 100% of the time

      Not true they are supposed to take your Nexus, its against the rules for them not to. But then again the VA doesn't care about rules and have seen them deny claims with a good Nexus.

    Fastest way to a diagnosis is visiting the Urgent Care or Emergency Room during your most extreme pain

    Request an X-Ray 🩻, and blood test with most likely be automatic

    Then that’s medical evidence to help a claim

    Would you rather wait 2-3 months for your podiatrist appointment or orthopedic assortment for an updated X-Ray

    Or get an X-Ray in a more reasonable time at the ER

    Walk 3 miles if you have to show your pain at its worse

    Pain goes up and down but paperwork showing severe pain lasts forever
