    Eminent Domain is no longer being used appropriately. When it's for corporations, it's illegal. I hope these people win their fight. Go IFJ!

      Unfortunately, the Supreme Court KELO case still controls, saying that as long as a local government can claim that the proposed use of the seized property would benefit the public (even indirectly through increased tax revenue from a private development), it is legal.

    The unfortunate unrecognized reality of our system is that you do not own anything. When you purchase property you are buying the right of occupancy contingent upon the payment of rent to the real owners wich is the Government.

      Liberal judges on SCOTUS made that impossible. They ruled that "Public Use" actually means "public benefit." That means that government can come in and condemn the property, force the owner to take pennies on the dollar, give the property to politically connected private developers for private gain. The "benefit" being the promise to pay more property taxes.
      The developers will come in ans initially offer at most $0.70 on the $1 with the threat of using eminent domain to take it for $0.10 on the $1 after it has been condemned.
      But I say IJ must fight and make it too costly for the developer or the state to take the land.
      MD is among the states that rules as if the US Constitution does not exist.
      Most states passed laws to strength property rights after KELO to prevent cities from taking private property for private development under the guise of increasing tax revenue.

      Well if it was a class action lawsuit, then take it all the way to the Supreme Court if necessary and let them define eminent domain. Thomas Jefferson started it to build roads and infrastructure. NOT FOR ECONOMIC GAIN.

      They'd loose. SCOTUS ruled on a Florida case back in the mid 90's dealing with the E.D. issue. The city had seized a mobile home park with privately owned trailers and used the excuse of E.D. so a developer could build something that would generate more taxes for the city. SCOTUS agreed the city had the right to do so. I see a need for E.D. for highways, military bases etc but this sport of the things is just out and out theft by the government.

    I went and supported and signed there cause and i'm running for mayor of Cumberland Md i dont be leave some one should lose there homes if they pay there taxes. I will still support home owners even if they dont support me. Owning a home is every ones dream and should not be hindered by any government.

      Here is what you need to know to run a city, state and country.
      1.put citizens before illegals.
      2.Operate a clean and safe city,state and country.
      3.make sure tax payers money is not being improperly used.
      4.clean out any corrupt official such ad judge,lawmaker ect out of office if violate laws and safety of the People and country.
      5.Obey laws and carry them out if it don't violate safety and rights of the tax payers and law abide citazens
      Basic stander operations on top of not letting other gov agency's going rouge on the citizens.

    I hope they either get to keep their homes, or at least get twice the tax assessed value.
    If you want to sell your home, fine. If not, eminent domain shouldn't be used for private developers, or contractors to kick you out.

      Turns out eminent domain wasn’t needed. The developer offered more money for the properties which led to more people selling. Now I understand that the project is on hold and might be cancelled permanently.

    I was born in Cumberland and this is not the first time homes have been destroyed. In the early 60's our home was torn down for a road along with several others. One house was from the Time of George Washington and it was documented that he had stayed there. A beautiful mansion on Averitt Ave in Westside Cumberland.

    I absolutely despise emanate domain abuse. In fact one of the things that bothered me about Trump is his history of emanate domain abuse. He's the big reason I wrote in a 3rd party candidate.If someone owns some property it should be the owners decision whether or not to sell it.

    It seems that the governors of this town need a little investigating themselves. Their possible connections and involvement with the developers may need to be called into question. How, in any so called civilised society, can such an order be made ? This whole scheme smells very fishy. I'll bet the people behind it also are not so squeaky clean. USA.     Just yesterday my handicaped friend who has a speech impediment got pulled over down town and discriminated against and abused by the town cops.they called him Joe dirt impounded his girlfriend s car fined him and he passed all their sobriety tests all cuz he is disabled.id like to see the body cam footage.

    Eminent domain should be banned for transferring private property to private developers. It should only be used when property is blocking the construction of something the public needs and will use, like an interstate highway or something along those lines.     Cumberland is in serious need of some redevelopment but until some jobs come back to the area it will be a tough job. In the meantime it continues to decay.

      It would certainly help if there wasn’t such a huge drug problem there was well. There is a lot of riff raff loitering in the downtown mall area. It’s my understanding that new businesses are having a difficult time finding people to work because they can’t pass a drug test.

    Cumberland’s biggest failure and all time low.
    As of writing this comment it is October 2024 and the “Rolling Mills Strip Mall Project” started in 2020. The plan is to include restaurants, a hotel, and shops. But unfortunately, only 1 awkward shaped building stands, only a few houses remain and the lots sit empty. Last time any progress was made was 2021/2022.

    The government can take property under eminent domain, but they cannot then sell, lease, or give the property to an individual of their choosing. In lieu of public use, they MUST put the property up for PUBLIC auction.

    Land Patent's are not issued with the purchase of land nor home, we are No longer provided with Allodial Title's only mortgages as tenant, property registration permits the state "lawful" ownership. All item's purchased with Federal Reserve Note's/Debt Note's are Promise's to Pay, even Bank Loans are Promise's to Pay, unless the Home and Land are paid with Gold or Silver then legally WE do not own it.

    From a building and I've always had a problem with this eminent domain. The problem I have with it is that the people that own the most valuable part of the Improvement project don't get too participate in the prophet part of the project. So they want my land, have to have my land, to make millions of dollars in profit okay I don't like it, but okay. However if I'm going to lose my family's home and probably have to spend a lot of money to get a comprable home, and I have to move away for my friends and family, and my kids have to change schools. It seems to me at some point there should be some profit in this for me

      The documentary did not show the actual state of the neighborhood. There are definitely a few houses that look fine, but the rest of the neighbor hood is in an incredible state of disrepair. It’s the very first thing people see when they enter Cumberland, which is awful for businesses and leaves a bad impression. The morals, however, are still questionable.
