    JM acting like all seniors are timid peaceful people. I’ve seen with my own eyes older people spitting and cursing at young adults over an argument and using all sorts of racial and derogatory words.

      I agree.... old people are definitely the worst. They act like their age gives them the pass to say and do whatever. I think she was clouded by judgement because she herself is closer in age to the plaintiff than the defendant. And spitting at someone is definutely assault.

    I’ve worked in customer service for close to 20 years now.. Elderly people can be the absolute worst but when a superior comes out they turn into a sweet loving person ..don’t ever judge a book by it’s cover. They can be some of the most cruel vile name-calling customers that I ever encountered..

      Yes!, the judge didn't even give a chance at even believing the old man could have done anything like that at all... she went way too far.
      She must live with the higher uos because. I see this happening on a daily basis of old people starting crap with younger people even after that telling younger people after harassing them to respect their elders lol.... lmao!
      Alot of these old timers have lost their minds...
      With all that said I freaking love judg Milian... it's just like 5% I would totally disagree with her and this is one of those times...
      She even tried baiting him into getting angry which failed... she tried multiple times and didn't work..... I was like dude please don't get angry she trying to bait you into it....DON'T....LMAO!

      So agree. Its as if there is an entitlement. I have seen this too often and it is embarressing. I am 68 years old and have never disrespected someone due to age, race or religion. Even if the individual is disrespectful to me I just leave them at where they are and take my dgnity with me. This plantiff gives me the wrong vibes.

    I’m 75 now. I worked customer service for 13 yrs when I was in my 40-50 yrs of age. Older people are the rudest customers.

    In this case...i really feel that the defendant was telling the truth. There ARE old folks out there that behave just like he described. This case left me a bad taste....sad

      Judge was blinded by age difference. If defendant had anger problem he would have blown up when Judge was yelling at him. He was polite throughout

      @@Fyrn33 I’ve known enough men like him in my life to know this isn’t true. The judge has power over him and is an aggressive, blunt person who has no problem yelling at and putting people in their place. An old quiet couple in a car? Easy targets for that type of anger.
      Although I do also think the older couple weren’t completely honest too. But men like him only target those who he perceives to be less powerful than he is so that he can feel powerful.

      They DEFINITELY weren’t being truthful. They were entirely too forgetful and basically said the same thing about the conversation as if they rehearsed it. The judge had to put the words in the lady’s mouth to get an idea of what was said. She also hit the nail on the head for this entire exchange without even realizing it. The older guy never felt like he was in danger. I wholeheartedly believe he spat in the younger guy’s face and was basically an a**hole throughout the exchange, including what he allegedly said about the wife and children. All this was backed up in his closing- he thought he could take the guy due to his time served. Her judgment was undoubtedly correct, but her assessment of the situation was wayyyy off on this one.

      Agreed lol old people were 100% lying and judge ruled with them because their seniors and acted innocent, I’ve first handed seen how rude and disrespectful the older generation of people are, especially when it comes to the younger generations. Without a doubt that old ass man spit at that guy twice and called him names, I don’t believe he called his children names though but definitely his and his wife or just the man. Then his comment at the end with his dumb ass badge, lmfao some 50 year old military trainings not going to save you against someone who fights. Wasn’t worried about it until his entire face is fractured and broken, that generation has no respect and thinks their all high and mighty until their shown otherwise, as a retail manager I deal with hundreds of them a day. They were absolutely dishonest and disrespectful, thankfully he didn’t injure his old ass and nobody was harmed.

    Only an old person would call children 'little bastards', because young people don't see it as a stigma to have children out of wedlock and probably don't even realise the true significance of the word 'bastard', also the old man knew that he could aggravate the young man by insulting his wife and children as well as spitting in his face, why else would the old man have rolled down his window?...

    I do believe there was truth to what the defendant said, especially after the plaintiff brought up at the end his combat badge. I believe the judge mistaken their age as some sweet old man, but honestly I kept thinking how sweet are you to stop in traffic not move then a crazy man walks up on you & you keep your window down and don't flinch??? I questioned if he was once that 34yr old tempered man but he's 66 now! He surely was not afraid!

      The combat badge just means he wasn't going to operate from a place of fear. It's not evidence that he was hostile to the defendant.

It may not seem like a battery in the sense of punching or kicking someone, but If you express your anger, frustration, or disgust with another person by spitting in their face (or anywhere on their person), that is precisely the criminal charge you could be facing. The old guy expressed the road rage.

    I believe the judge had a bad day on this episode, They both were trying to show who is the "big bad wolf in the den" and were both equally responsible for what happened that day. This was an episode I wish I hadn't seen. I'm very disappointed on how she reacted to one and not both

    I think the judge got ahead of herself a little there. What the man said about his combat certification at the end most definitely says something about his attitude as well. I do believe the older gentleman is just as aggressive as the defendant. He just made sure to have good behavior in court 😂

      Yeah, he probably did spit when the defendant got in his face, but the defendant clearly started it and was the aggressor. Personally, I find it astounding that people who know - or at least should know - they're in the wrong are often the first to "double down" and makes matters even worse.

The defendant did start it for sure by beeping the horn and the plaintiff played into it by sitting his car right there to piss the guy off even more. I certainly wasn't trying to imply that the plaintiff was blameless; most people faced with an angry driver angrily would just drive away if he/she started to approach. Still, the defendant has to have pretty poor self-control to ditch his family in the middle of the street just to berate another driver for intentionally delaying him.

    Defendant is actually very well controlled and respectful. Plaintiff totally did it. JM is massively wrong and I’m glad all the comments see it too.
    Now, he still needs to pay for it legally. But morally he was well justified. Getting spat on twice and all he did was hit a car instead of a person.

Any sociopath online can come comment and claim "poor defendant" , the long and short of it is that the defendant escalated the situation regardless and easily could have wound up shot and killed.       He said the defendant honked his horn twice. Once when he tried to get into the lane, and then a second time when the light just turned green. But somehow even with the light having just turned green, the plaintiff was still parked there giving the defendant enough time to get out of his car and walk over to him to yell at him and punch his car?
      you can tell right here he's lying about something. IT doesn't add up, this story cannot be true. unless you add in like "the light was green but I decided to stay there just to piss him off" to start, which ruins the 'meek older man' image they're trying to sell here.

    Spitting on another person isn't harassment, but actually assault with bodily fluid witch is even more worse. For anyone that has the balls to go ahead and spit on someone else is absolutely outrageous and they deserve every single thing that comes there way from the criminal charges and all the way to them getting there behind beaten to a pulp along with everything in between.

      She does say that it was father's day and the cop didn't want to do paperwork. I assume she knows. Could be wrong. Have family in law enforcement. They say it's more of an add on charge. Majority of the time it escalates to a physical fight. It's probably the most disrespectful thing you could do. With that said it's old dudes word against his. Also given his age during time of this taping he would have been drafted during Vietnam. That CIB he wears most likely gotten him spat on when he got home from a war he probably didn't volunteer for. Just got lucky and made it back home. I'll take the old man's word on this one. Dude looks like a hot head. But yeah totally agree that spitting on someone is the worst.

      I find very few actually are under their surface. I disagree with the judge’s bias in believing the foggy vague testimony of the plaintiff over the calm factual testimony of the defendant.

      Yelling was not the issue. did you even listen to the case. People yell all the time. My parents yelled all the time. Judges yell. Police yell. That's a normal sign of anger. What is crazy is Illegally blocking traffic, getting out of your car to go confront someone and kicking their door in. Thats the abnormal part

      The defendant could barely contain himself. He immediately used argumentative language when it was his turn to speak. After he realized the judge believe he wasn’t the victim in this whole thing, his posture changed. The way he had his arms straight and hands behind his back, His facial expressions -the strained, pursed lips and mostly his inability to just keep his mouth shut even after the judge told him to multiple times are all telltale signs that he has impulse control/aggression issues. Patient people don’t get out of their car to approach another car…. Passive-aggressive people will tirelessly blow their horn. The old man may not have been the saint he claimed, but this guy pushed his way into traffic “putting his family in harms way” as he puts it, then got out of his car and approached another car. The defendant has issues that he barely controlled in court.

      I think it should also include the word, “So…”. Everyone would pass out drunk! The defendant seems like a real a**hole with serious anger issues. The plaintiff needs to face reality that at 66, that the “CI” pin on his lapel won’t resuscitate him once a crazed person shoots, stabs or stomps on him in a future road rage incident. Stay in the car, Pops, and don’t get out!

      Even if he did, that doesn't justify the defendant's actions. He had no need to get out of his car and threaten the Plaintiff and his wife, not to mention punching the guy's car. As well as blocking traffic. He should know better than to behave that way in front of his wife and young children. It's revolting no matter how you try to justify it.
      I find the fact that his wife isn't testifying on his behalf, is very telling.

      I work in Emergency and while old people can behave poorly, you are at greater risk of harm from young/middle age people. So while an older person might be grumpy and nasty, a I'm actually more afraid of what a young person would do

    I might be totally wrong but I feel the plaintiff and his wife are very good actors in looking so sweet in the court. Plus I feel JM had a clear bias from the start for the plaintiff. Just because two people don't "look like" people who could be nasty, does not mean they are not. I do believe the plaintiff spat in the face of the defendant, which is an assault.

Their reaction is to usually do the opposite of what that person with the horn wants. Watch, next time ur at a stop light and it turns green, if the person doesn't go right away, start blaring down ur horn and see what happens. Yell for them to go! Then come back here and be honest, cuz that person will might just stay at that light, to be sure u miss the green. I've seen it happen a lot. Not sure why. But it does. Can't see the guy smiling happy, loving all the horn play and yelling, and think nah I better not move up. It makes no sense to me. Jus my opinion.

    I'm with the young guy with the wife and kids...people ABSOLUTELY DO come to a stop waaaaay back from the light, and often there will be three or four cars doing that, so the lane is backed up much further than it should be! My guess is, people start texting as they are approaching the redlight, and couldn't care less how their movements are affecting everybody around them

      Their story didn't make sense. "He honked at me to move at the red light. He honked again when the light just turned green -- he had the time to still come out of his car to walk up to the side of my door to yell at me and then hit my car even though he had honked a second time because the light was green"
      See where that doesn't make sense? Why were they still there if the light was green?

      I agree. She didn't even let the defendant speak and that's the 1st time I've ever seen her railroad someone like that. I don't know what it was.
      My thing was why did the man stay there long enough for there to be an altercation? I mean if the light turned green then start driving, why hang around? That seems like a simple question that she would have asked because at that point the Plaintiff has his ego involved.
      I really can't speak to whether the defendant was telling the truth or not because she cut him off so much that he never got a chance to speak and that's the 1st and only time that I've been able to say that.

    The judge's mind was made up after the first three minutes. Why would the plaintiff be wearing a CIB, a military badge, on civilian clothing? The plaintiff strikes me as one of those old farts who want to enforce laws on their own, like driving in the left lane at 49 mph in a 50 zone. I believe that there was plenty of room ahead of the plaintiff but he wanted to prove a point to the other younger driver..

    The old guy could very easily have spat at him, and insulted him, but law wise he still can't punch the car. Sometimes you can just get fed up with people trying to bully you. I've been in a road rage situatin where a woman twice my size, stormed out of her car to point her finger in my face and rage. and yep...even though I'm this slight of a girl got out of the car and stood up to her! She backed off and went back to her car. Most bullies are too cowardice to follow through.

    I used to work in a restaurant and I can honestly say that I have dealt with more disrespectful elderly people than younger people. It is not out of the ordinary for someone elderly to be rude, disrespectful and nasty.
    The defendant definitely should have paid for the damages he did to the car. However, her excuse for him being elderly is not an excuse.
    I’m not sure how I feel about this case

    I feel like the case was over as soon as JM saw the plaintiff and defendant. I don’t know what happened but I do know that because of the both sides ages and looks she believed one over the other. The whole thing made me so angry with JM. They both were judged right for the beginning and court should never be held like that.

    I think that both the plaintiff and defendant weren’t telling the truth. Just because the plaintiff is in his 60’s doesn’t mean he was afraid. Why didn’t he drive off when the light turned green? Why would he stay there and engage with a crazy man? The defendant’s attitude with the judge didn’t help him in this case. I like judge Milan but she took the plaintiffs side way too quick. His story didn’t make sense either. Both him and his wife can’t “remember” what the defendant was screaming at them. I don’t believe that at all.

Also accusing the defendant of being angry and the only one that is throwing a fit is Judge Milian. But, I applaud the defendent for being calm and being a grown-up in court. I cant say the same for that plaintiff, who I believe is lying and for Judge Milian's behavior. Judge, you acted like a baby in this case, and made a total fool of yourself. If your husband and kids aren't embarrassed by your little tantrum, they should be.

    Non verbal communication never lies. When the old man said he didn't call the children bastards, his head nodded yes. I believe he did curse at the defendant's family. Old people can be extremely vindictive just for the hell of it. Not saying that what the defendant did was wrong- it was definitely dumb smhhhhh- but I do believe he was provoked by the guy, who outback just wanted to feel 25 years younger for a second and showboat in front of his wife for a second. I kinda feel bad for the defendant.... even though he was definitely dumb. I think he was just too excited to get back to the grandparents' house to get the celebrations going. Definitely should practice some more patience.... but I think the plaintiff really did do it.

    The weirdest thing about the comments is all the people claiming they see some kind of rage behind the defendant’s eyes. Lmao. Seeing what you want to see. This man was calm, collected, and recounted what happened.
    Meanwhile The arrogant, disrespectful boomers can’t answer half the judge’s questions and gave a foggy testimony with very few details. Lots of shrugged shoulders and “I don’t know”‘s.
    Flexing that little badge on his outfit at the end PROVED how self-important, self-absorbed, and arrogant the plaintiff was and he DEFINITELY did all the things the defendant claimed.

      Even IF that was all true.....the defendant didn't have the space to make the turn in the first place so it's LITERALLY ALL his fault. If you can't safely make a turn....you HAVE to WAIT

    About a year ago I cut off this Mexican dude, I tried to apologise to him but he wouldn't have it, so he decided to break my driver side window with a pair of pliers, and try to drag me out of the car. What he didn't realize is that my laborer was a lot bigger and stronger than him. So in the next 3 minutes my laborer just beat the living tar out of this guy on the side of the road. Then the cops showed up and arrested him for reckless driving, assault and battery, road rage, DUI, possession of methamphetamine, possession of paraphernalia...I guess he proved his point.

    The fact the old guy talked about being military after the show. I know he was dishing it almost as much as me. Domestic violence-road rage was giving. That guy is going to be in jail before 40 with kids that are terrified of him. So scary.

    These old folks strike me as liars. Judge was inappropriately harsh to the defendant though he should have hauled his family in to back his story and things may have gone different.

    Spitting on someone is definitely assault. If you throw water on someone its fine but anything else is assault... I think she just got hung up on the kids part and father's day and teaching the "crazy" guy a lesson. Probably why she started talking even faster so no one would catch that lol

      That's not the point though. He charged to the plaintiff's car, damaged it. Whether the plaintiff spit (which is quite clearly a fabrication since there's nothing on it directly from the police) or not does not matter. He lost his cool. He damaged the car. He pays.

      @@kycutecool5891 I'm not negating that, I'm just saying the plaintiff should've been held accountable for what he did. She said herself, as a former prosecuter she knows that they PO just didn't want to do the paperwork. If the PO acknowledged the assault, that would be even more paperwork. The crazy guy is at fault but I feel like that old guy is playing up the old card. Even the Judge said "does he look like he would do that?" and the old man went with it

      @@marycollins5823 Fair enough. If he did, I agree. But I really don't believe the spitting happened. Otherwise it would have appeared clearly in the police report. Both turned the same thing in. The officer did not acknowledge that such a thing occurred.

    WHAT? The judge is just presuming without any evidence whatsoever, that the old man is a polite, kind old man, and that the young man is rude and aggressive, but there are many old men that would say exactly what the defendant claims he said, and for the young defendant to make up a sentence that only an old man would most definitely say 'little bastards' is not something a young person would say, nor know to make up. And I totally believe that the old man spat in his face and of course the plaintiff's wife is going to back him up, why wouldn't she, she is as vile as him. And the old man even said he wasn't afraid, in fact he even got out of his car to get the license plate number. The judge is so biased and so wrong about the young defendant, his comportment throughout her reprimand shows me he has total self control...

    This is why everyone who owns a vehicle to install a Dash Cam. They're cheap and easy to install and use. It puts an end to all this BS.

      This is so true. My dash cam saved me the very next day after I installed it. Caught a drunk driver who backed right into my car in the mall parking lot. Caught that license plate clear as day. He couldn't lie his way out of it either.
