I know where I live parents are having issues with schools. Many kids don't have a classroom because the classes are too full or the classroom doesn't have a teacher... and they only found out last week or this week. So it's a big scramble because there are too many kids and too few teachers.
She had a court order that they had to attend that school. If she needed to move them out of that district she needed to ask the court. The court isnt going to give her leniency because she moved. She needed to tell the court she moved and ask that the order be updated to reflect the new school district. Just moving the kids is asking for contempt.
I bet her lawyer told her to go ahead and enroll them b/ c he was telling the judge that she didn’t need permission to move less than 100 miles and he would talk the judge into changing the school system. But that didn’t fly…poor kids!
Judge likely came in with bias due to the mother failing to participate and cooperate with the friend of the court. People don't realize how important it is to be decent for all proceedings, even the minor ones. Written opinions and other councilor actions are seen by the judge if they are relevant to the system and relevance.

I don't hold that against him and attorneys are expected to do what's best for their client even if the client doesn't realize it. I can't believe he tried to argue for the children to have LESS stability and be moved around all the time. The whole point of family court is to provide the children with stability and a good environment. When I'm on any sort of important call (video or audio), I tend to pace and roam. It's like an anxious energy that I can't stop. With that being said, this isn't a "video call." It's COURT, and when you're in Zoom Court, you should dress and behave exactly as you would if you were there in person. Sit still, wait your turn to speak, dress appropriately, don't drive, pace or smoke, etc.

The lawyer didn’t make fun of the ex-husband for not being able to afford a lawyer; he pointed out that the ex-husband has to follow the rules, including the rule that requires a party to deliver a copy of all court documents to the other party. Plus, I think you’re giving the ex-husband way more credit than he deserves. He was sending his girlfriend to pick up the kids. They’re both behaving badly. Neither one of them has any sense of decorum or civility. They’re both really angry. It’s a bad situation, and their behavior is making it worse.

The mom doesn't get to decide unilaterally that the kids go to the school of her choice. He's arguing about how much traveling she has to do but the fact is that the dad would have to do the same thing in opposite. And for her to flat-out tell the judge "no" is just the stupidest thing she could've done. She's going to be held in contempt now. Since it's obvious that she has a habit of kidnapping the kids and not returning them, going so far as to refuse a judge, they might bump her down to supervised visitation. Our courts will stop a hearing and tell you to appear in-person, if you cannot stay still on zoom. And that attorney would be held in contempt for interrupting. Dad needs an attorney BADLY to counter the mother's overbearing attorney, who addresses mother driving while ignoring that father would have to drive round trips on Thursday, Friday and Monday. Our judges would reprimand the attorney for his condescending addressing the opposing side, and if it continued, find him in contempt, and fine him. And what I consider blatant incompetence of her attorney with not being familiar with all prior orders, and recommendations, is astounding. Her attorney had no problem interrupting the father, and the judge, but when he should have stopped his client, he sat their like a ventriloquist dummy.

@@supernova743 You can't very well treat Civil Court like Criminal. Sure, you have the right to refuse to talk, but it will be held as an _Adverse_ Inference in Civil Court. On top of that, you want to look like someone that knows how to cooperate, if you want to prevail, because Cooperation (Factor "J" in Michigan) is one of the key parenting factors being reviewed.
Tough lesson to learn. But it seems to me that the Defendant is more concerned about thwarting the Plaintiff's new relationship, rather than looking out for the welfare of the children. The Defendant not showing up to pickup? Worrying about who's babysitting during the Plaintiff's time? The common denominator seems to be a refusal to interact with the Plaintiff's new significant other. All telltale signs of someone that hasn't moved on.

Also dunked on him when the Defense lawyer claimed that the Plaintiff didn't drive, and then the Plaintiff nonchalantly displayed his truck sitting in the driveway. -Which turned the Plaintiff's ill-advised idea to be outside during the hearing, into a win for the Plaintiff. Also, the idea that the Plaintiff might not have transportation was undermined by the Defendant unilaterally moving the children to a different school. Which is also its own violation. But the idea that it would unduly harm the opposing party would not be a good argument to present in court, either. Furthermore, you're telling me that the Defense lawyer is too lazy to open up the online court docket and pull all the documents to get up to speed on who filed what before his appearance? The lawyer didn’t make fun of the ex-husband for not being able to afford a lawyer; he pointed out that the ex-husband has to follow the rules, including the rule that requires a party to deliver a copy of all court documents to the other party. Plus, I think you’re giving the ex-husband way more credit than he deserves. He was sending his girlfriend to pick up the kids. They’re both behaving badly. Neither one of them has any sense of decorum or civility. They’re both really angry. It’s a bad situation, and their behavior is making it worse.

Theres no rule that you have to sit. Most judges will ask you to though. Basically if the judge is okay with it then its acceptable.

Was that lawyer actually arguing FOR the kids to switch schools? The whole point of the family court system is to make sure the kids maintain stability. The mom doesn't get to decide unilaterally that the kids go to the school of her choice. He's arguing about how much traveling she has to do but the fact is that the dad would have to do the same thing in opposite. And for her to flat-out tell the judge "no" is just the stupidest thing she could've done. She's going to be held in contempt now. Since it's obvious that she has a habit of kidnapping the kids and not returning them, going so far as to refuse a judge, they might bump her down to supervised visitation. Don't ever say no to a judge.

Our courts will stop a hearing and tell you to appear in-person, if you cannot stay still on zoom. And that attorney would be held in contempt for interrupting. Dad needs an attorney BADLY to counter the mother's overbearing attorney, who addresses mother driving while ignoring that father would have to drive round trips on Thursday, Friday and Monday. Our judges would reprimand the attorney for his condescending addressing the opposing side, and if it continued, find him in contempt, and fine him. And what I consider blatant incompetence of her attorney with not being familiar with all prior orders, and recommendations, is astounding. Her attorney had no problem interrupting the father, and the judge, but when he should have stopped his client, he sat their like a ventriloquist dummy.
Yeah the attorney ducks and as no-nonsense as the judge is I'm surprised he didn't say anything about the lawyer interrupting and speaking back to the Dad.

I so hope she doesn't show up in court as ordered. The look on her face when the judge orders primary custody to dad will be priceless. Then when she has to start paying child support will be the cherry on top. Mother is used to stomping her feet and getting her way. This judge will teach her a life lesson about such an attitude if she doesn't show up in court with the children.

On top of that, you want to look like someone that knows how to cooperate, if you want to prevail, because Cooperation (Factor "J" in Michigan) is one of the key parenting factors being reviewed.

Tough lesson to learn. But it seems to me that the Defendant is more concerned about thwarting the Plaintiff's new relationship, rather than looking out for the welfare of the children. The Defendant not showing up to pickup? Worrying about who's babysitting during the Plaintiff's time? The common denominator seems to be a refusal to interact with the Plaintiff's new significant other. All telltale signs of someone that hasn't moved on.

Also dunked on him when the Defense lawyer claimed that the Plaintiff didn't drive, and then the Plaintiff nonchalantly displayed his truck sitting in the driveway. -Which turned the Plaintiff's ill-advised idea to be outside during the hearing, into a win for the Plaintiff.
Also, the idea that the Plaintiff might not have transportation was undermined by the Defendant unilaterally moving the children to a different school. Which is also its own violation. But the idea that it would unduly harm the opposing party would not be a good argument to present in court, either.
Furthermore, you're telling me that the Defense lawyer is too lazy to open up the online court docket and pull all the documents to get up to speed on who filed what before his appearance? Sure, the parties are supposed to send copies to the opposition, but nowadays that everything is online, there's really no excuse for an attorney to be this utterly unprepared.
Of course, you also get what you pay for, and the Defendant probably isn't paying her attorney a whole heck of a lot, either. (The attorney shushes his client like he's a relative)

And there needs to be a better solution for pick up and drop off. If she doesn't want to see his girlfriend, then perhaps she needs to pay for a court appointed person to be at the police station to take the kids from her and once she leaves the police station, then the girlfriend can come in and get them.
Well, that's more like: _too bad, just suck it up._ People can have their significant others watch their children, and there's nothing the absent parent can do about it. If they wanted to be around, the cost of that was not divorcing, in the first place.

Indeed, it's difficult to succeed without a lawyer. It's just that the Defendant was in Contempt of Court, and literally contemptuous in her responses, and therefore, the Plaintiff just couldn't lose on this rare occasion.
