An Army Wheel Mechanic has so many levels of training that is amazing. I retired from the Army after 20 years in the medical field, however my husband was also Active Duty and was a Wheel Mechanic in the Army. His incredible training and expertise was amazing. He helped so many soldiers overseas get a cheap car and get it to not just a level to drive but one that will be so dependable. Let me tell you I would never challenge a military mechanic the training and continuing education is always tested to be current. This how they receive their promotion. Good for the Petioner. Thank you young man for your service and representing the Army with such a high degree of professionalism. Hoah….

Yes! I know nothing about cars, but I know a stripped screw when I see one, and what caused it; ill-fitting screwdriver. This was basically the same thing. Ill-fitting lugnuts stripped those holes and ruined the wheels. But the "expert" thought that was just fine? So glad he lost.
He would’ve lost if he wasn’t an expert, many people lose cases against mechanics because they can’t properly explain the bad work they received. So you either take it to the manufacturer or you bring an expert with you. He’s also well spoken so that helped.

It doesn't take much experience with tire replacements to see some wheels do have different requirements for the cone part of the lug to seat properly. Most are universal but these certainly were not.

I'm a mechanic. The defendant might be an expert but the people that do the actual work at those tire places are barely able to tie their own shoes. They should have known the lugs were too small to properly seat and then recommended proper lug nuts. There are 3 major types of lug nuts, conical, shank and washer. But there are smaller variations of conical and that's what the difference was in this case. I would have replaced everything that was damaged had this come in my shop and then fired the guy responsible. I'm glad they got most of the money to fix the problem.
The Plaintiff shredded the Defendant! Love it. 30+ years experience and he thought he was gonna talk his way out of it.... All wheel tech in the army rolls up with evidence and clearly articulates the defendant’s shop was at fault! Boooom! The judge did well.
He didn't shred anyone. The picture was all the evidence, not his testimony. The defendant knows his company had some rookie in the bay that made a rookie mistake and didn't want to admit fault because that isn't in the best interest of the company he works for. The defendant knew and the judge figured out the problem was greatly exacerbated by the woman who ignored an obvious problem but kept driving on it! The judge deducted 25% because she knew that damage was from a wheel wobbling and would've been yanking that car all over the road but she continued to drive until she broke three of the studs off. I have no doubt his 30 years experience is far superior to the entry level army mechanic and this case was decided entirely on a picture which anyone could have taken.

I called it a rookie mistake because anyone making that mistake doesn't have a job very long and anyone who has done the job a while knows not to make that mistake. There isn't a need for experience when the picture showed the same wheel with both proper and improper lugs and how some lugs fit and others didn't fit. The picture showed how one lug "seats" well into the wheel while the other lugs didn't seat at all and caused damaged. It's like looking at an x-ray of a broken bone. I don't need medical training to see it's a compound fracture and the judge didn't need tire changing experience to see how some lugs fit while others didn't.

Plantiff is right, in most cases you cannot put aftermarket lug nuts on to your factory wheels. You need the factory lug nuts to do so, which is why they didnt use the factory lug nuts to go on the aftermarket wheels. Alot of these small tire shops got kids working for them and dont care and rush the job since they are only getting paid $12/hr.
Loved this case! The plaintiff couple were beautiful together and dressed for success. She was proud of her man and it showed. Not all women pay attention to that kind of stuff. I’ve felt that before in my SUV and my first thought was, I better get my husband to drive it. I also know how being a wife of a soldier can be. He’s retired now thank God. But when he was deployed I would go straight to family for help being from the state my husband was stationed at. I had that opportunity but most army wives do not if spouse is deployed. It was the defendants job to see these things and make them aware. Not just for safety but for profit. Every auto shop mechanic I’ve been too purposely looks for complaints or it seems that way. Glad they were prepared and victorious.
All three are probably true He may be a 25 year expert, and structurally speaking those lugs were probably fine. But the lug nuts are only totally fine with the matching wheels.

As a mechanic. This "30 year" defendant is lacking in education. There are many types of wheel seats and many types of lug nuts. His education has not continued as his age has. As a professional, it is our job to know what is right. Just because someone brings you something and wants you to install it does not mean you should. In reality someone could have been killed because of this shop error.
He shouldn't have been the one to come. He wasn't there, he didn't do the work, and he didn't do the inspection...so he literally had nothing to say about it. Far as it seemed, the company was prepared to lose from the start and just sent whoever had free time to fill the space.
This is what I was thinking too. What the mechanic was talking about are if the correct lugs aren't torqued down, those can have an issue real quick. But what happened here, was too small of lugs torqued past the seat. That will take a lot longer to have an issue.

That 25% reduction is ridiculous. The judge isn’t taking to account that the lug nuts broke. So she very could drove 1k miles before it got real bumpy. Real bumpy when the lugs broke. The soldier deserved a better verdict.
My car had been shaking for months. My inexperienced ass just kept on driving. I figured since the car wasn’t having any issues, it was fine. It happens more often than the judge thinks but overall, a good judgment.
I don't think I've ever been more impressed by the behavior of a plaintiff in a people's court case before. Respectful, knowledgeable, and clearly showing what was wrong, and explaining why it was wrong in the work his wife received on their car. Bravo.

Disagree with the defendant. I had a back tire replaced on my van with new lugnuts from garage and about 600 miles in the lugnuts sheared off going 70mph. The garage knew they screwed up and paid the hotel, towing, and another garage to fix it.

I've worked in the performance automotive industry and my expert opinion after seeing the facts is that the lugs weren't torqued they were just "hand" tightened. You can swap lugs just fine as long as they fit. We do that all the time.

I’ve felt that before in my SUV and my first thought was, I better get my husband to drive it. I also know how being a wife of a soldier can be. He’s retired now thank God. But when he was deployed I would go straight to family for help being from the state my husband was stationed at. I had that opportunity but most army wives do not if spouse is deployed. It was the defendants job to see these things and make them aware. Not just for safety but for profit. Every auto shop mechanic I’ve been too purposely looks for complaints or it seems that way. Glad they were prepared and victorious.

All I hear is a sweet voice on the young man. A light drawl on the mechanic. And allover clear words and cohesive sentences- which isnt always the case in judge Mathis's court with all the slang and fast speech ( no hate♡)... but what do i know im not even from the US.

As a mechanic. This "30 year" defendant is lacking in education. There are many types of wheel seats and many types of lug nuts. His education has not continued as his age has.
As a professional, it is our job to know what is right. Just because someone brings you something and wants you to install it does not mean you should. In reality someone could have been killed because of this shop error.
My girlfriend has never even owned a screw driver and even she was like "oh wow" at those pictures.
He shouldn't have been the one to come. He wasn't there, he didn't do the work, and he didn't do the inspection...so he literally had nothing to say about it. Far as it seemed, the company was prepared to lose from the start and just sent whoever had free time to fill the space.

This is what I was thinking too. What the mechanic was talking about are if the correct lugs aren't torqued down, those can have an issue real quick. But what happened here, was too small of lugs torqued past the seat. That will take a lot longer to have an issue.

That 25% reduction is ridiculous. The judge isn’t taking to account that the lug nuts broke. So she very could drove 1k miles before it got real bumpy. Real bumpy when the lugs broke. The soldier deserved a better verdict.

My car had been shaking for months. My inexperienced ass just kept on driving. I figured since the car wasn’t having any issues, it was fine. It happens more often than the judge thinks but overall, a good judgment.
This was a great case. I love Judge Milian, she has a great balance of humanity, humor, and bs detection.
There are absolutely wheel specific lug nuts. Some require pan/flat, acorn style, etc. The defendant is a complete tool.

Disagree with the defendant. I had a back tire replaced on my van with new lugnuts from garage and about 600 miles in the lugnuts sheared off going 70mph. The garage knew they screwed up and paid the hotel, towing, and another garage to fix it.

I've worked in the performance automotive industry and my expert opinion after seeing the facts is that the lugs weren't torqued they were just "hand" tightened. You can swap lugs just fine as long as they fit. We do that all the time.
