This happens in rock music as well, but we don't see rock musicians held accountable for things like sex with underage groupies, ie Kid Rock, who confesses to statutory R wording girls in his songs, or older generation of Outlaw Country singing about their crimes.

Maryland prosecutor here to explain the difference between First and Second Degree Murder here: First Degree requires premeditation (or other circumstances but I’m trying to keep this simple), Second Degree doesn’t. And while premeditation only requires enough time to consider whether or not to do something (I.e., barely any time at all), it’s not unusual for juries to find a reason to go for second degree absent massive amounts of evidence of planning.
Also, we charge all the crimes rather than focusing on murder because the time often stacks and because you never know what a jury will actually believe; I’ve seen them acquit on murder charges for someone being shot to death and still convict on the gun charges and assault. Explain that logic.

In terms of using a person's artistic endeavours against them it depends how personal an artist's work is. If people are telling their life stories in song and what they write about directly coincides with a crime they're being tried for then perhaps it should be used as evidence.

Would like to see a video on the UK drill scene. I've seen a short documentation once and it is really crazy what's going on there with drill music and street gangs. For example there was an incident where Headie One was being harrassed after a gig but made clear that he had a weapon on him. A video of it was spread on snapchat and the gang that attacked him made fun of him. He then answered with a track (Know Better) where he rapped about that incident. Furthermore there seems to be a strong connection between song releases and violent gang on gang crimes. I.e. people get stabbed for things that were said on those tracks.

In terms of using a person's artistic endeavours against them it depends how personal an artist's work is. If people are telling their life stories in song and what they write about directly coincides with a crime they're being tried for then perhaps it should be used as evidence.

I think that generally your art shouldn't be used like that, but say you killed a dude with a knife on baker street and you make a mixtape the next day "On the mic dropping hateful beats, that fool dead on baker street, murder was the crime and he had it comin, a knifing more gangsta than run and gunnin" you probably aughta take that as evidence, or at least a general idea of what happened.

Would like to see a video on the UK drill scene. I've seen a short documentation once and it is really crazy what's going on there with drill music and street gangs. For example there was an incident where Headie One was being harrassed after a gig but made clear that he had a weapon on him. A video of it was spread on snapchat and the gang that attacked him made fun of him. He then answered with a track (Know Better) where he rapped about that incident.
Furthermore there seems to be a strong connection between song releases and violent gang on gang crimes. I.e. people get stabbed for things that were said on those tracks.
Check out the drill scene in NY and Chicago, 16 year olds getting murdered for calling their ops a bitch…

The thing is... I don't think anyone should be indicted just based on song texts, but if there is other compelling pieces of evidence and then you have a song text that just happens to be suspiciously simular to the alleged crime, then I feel like it's not unreasonable to take it in as evidence.

It's to cause you to either plea out and save everyone time, or to make sure they definitely get you on something. A jury could disagree and one or two people not want 1st degree murder for this reason or that. But they might all agree on 2nd degree. So you get charged with both to make sure one sticks. And if neither stick, you still have both assault type charges and the use of a gun charge. They wanna make sure SOMETHING sticks
