    Just because a wall is "damaged" or "stained". Doesn't mean it was damaged by an insured peril... nor does it mean that the wall cannot be repaired by drying equipment, stain blocker and paint.... and the schedule of loss or list of contents, adjusters want that, so I'm sure they would be happy you already completed it, idk why you want them to sign it, they Haven't inspected the contents nor are they contents experts, they may be electronics that need specific experts to open and look at it. If you cannot indicate when the damages happened the isnruance company may come to the conclusion they could of been done at different times and that could mean different claims and multiple deductibles... not a great idea. It's a statutory condition to work with the insurance company on your claim, they may even have a condition that requires you to make a statement under oath... you are just trying to be difficult, it will not help.

    By the way, fraud is a jailable offense. I would highly not recommend you attempt any of these suggestions... especially since when I catch you, the insured, will likely end up with nothing. (see definition for CONCEALMENT in all insurance contracts). Attempts to conceal information as in the way described actually releases an insurer, of their obligation to pay. The public adjuster is willing to take that gamble, it's not their money so they loose nothing if it doesn't work. Whereas you will loose all of the value of the premiums you have paid to the insurance company if the public adjuster were to loose this gamble, with YOUR MONEY. How about them apples? lol

  • @nicholasmarshall3881
    @nicholasmarshall3881 Год назад

    1- You could just have a contractor submit his estimate and he and the adjuster can work out and agreed upon final. 2- Before you waste your time trying to record the adjuster, check to see if the adjuster is a staff adjuster or an independent adjuster. Independent adjusters do not have coverage authority . 3-I love it when there a is a list I tell them to hold the list and we will compare when I am finished with my inspection. 4. Why is this guy telling you to lie "I don't know exactly" but you do know. I mean if you have known about a slow leak for 6 months but didn't report it then your claim shouldn't be covered. Why is the insurance company the only party in the signed policy agreement that has to adhere to the policy. I have always been taught to err on the side of the insured, give the insured the benefit of the doubt. If you have a pipe leaking in your wall for 6 months but just noticed it, you called to start your claim when you first noticed it. I am going to cover that loss. I can't expect you to be able to see into the wall anymore than I can trust this guys Cause of Loss. 5- I would prefer to inspect alone, if you have given permission and access to your property it actually goes faster. If your supposed to be there and you no show, you have put yourself at the end of my list. We will have to reschedule you for another time and I am about two weeks out. So lets go ahead a get you scheduled for two weeks from now. Don't forget, while we are waiting for the inspection it is the insured's responsibility to prevent further damage. So lets hope you get the emergency tarping done, get mitigation to dry you out I would hate for mold to set in and deny your loss because you didn't take the necessary steps to prevent further damage. I find its alot easier to for everyone if the adjuster establishes a good relationship with the insured and the insured's contractor. Not sure what carrier this guy worked for but they must have been crap. Alot of the adjusters are independent adjsuters. IAs are paid on a tier schedule meaning the more the claim the more we get paid. There is no bonus for saving the insurance company money so most of us are not trying to leave money on the table.

    I Have never seen an adjuster make a ''low ball'' offer after an inspection. We prepare an estimate based on damage reported and observed. When you have a contractor estimate or invoice, we adjust up from there based on additional damage or additional cost not estimated for when incurred or found by the contractor. The worst thing I have seen is the outrageous deductibles in some locations(LA) and people who do not have the coverage they think they have. Do a video on coverage review. More useful. In my experience (StateFarm and Allsate) they go out of there way for the insured, if it is in policy, to pay as much as possible. It's the "In Policy" that needs to be addressed before the event. .......And most independent adjusters work on commission and get paid more for more damage found. During a mass claim event you are almost assured to get an independent adjuster who's commission is paid by the insurance company and does not affect your claim. It is not in their interest to ''Low Ball''.

      Respectfully, I'm not really sure what you're saying is accurate. 1) Insurance companies will tell you, Independent Adjusters, to take things off their estimates. How do I know? In depositions we got their original esx files and noticed after sumbission to insurance company it was altered. 2) While you work on commission based on the amount again please refer to #1 3) We have more lawsuits after Hurricanes because IAs (not saying you) but 80%+ do not accurately depict all the damages. Again, this is by and through depositions my attorneys take that put insurance company hired adjusters on the hot seat as we show pictures and line items of damages "missed" or not accounted for. 99% of all inspections in Florida done by IAs are extremely low. I can show you an appraisal we just settled for $145,000 approx and the "Independent adjuster" wrote a $52,000 estimate. Please email me I'd be happy to share all these documents and as many independent adjusters estimates you need to show how my experience is complete opposite of yours. I'm in the trenches until the very last day of settlement and beyond. Your job is simply write the estimate and your done so my experience I believe is much more accurate account of things. Saying "I don't know exactly when the [loss] occurred" when an insured, in fact, knows exactly when the loss occurred IS a misrepresentation and possible fraudulent statement, voiding insurance coverage, if the loss date/time is relevant (material) to the insurance company's investigation and determination of coverage. Same goes for how a loss occurred. I understand you're trying to sell your public adjusting services by scaring people into thinking their insurance companies are out to screw them, but telling (and trying to teach) them to "trick" their insurance adjusters does a disservice to yourself, your profession, the industry in general, and your prospective customers. Be careful, people.

      Can you please point to any statute in any state that clearly reads someone can't say the exact date of loss in an insurance claim? Please point to any insurance policy that states the same.
      I love how you insurance company people get all upset when someone is actually helping and protecting people from insurance companies because of how they treat people.
      You insurance company people always say if you say that or don't say that it's Fraud , a misrepresentation, LOL

      @@theclaimsquadpublicadjusters Why don't you ask your regulator, the FL DFS, what it thinks of telling insureds never to tell the truth even if they know the truth about an exact date or cause of loss.
      But since you asked, FL Statutes § 817.234 states:
      (1)(a) A person commits insurance fraud punishable as provided in subsection (11) if that person, with the intent to injure, defraud, or deceive any insurer:
      1. Presents or causes to be presented any written or oral statement as part of, or in support of, a claim for payment or other benefit pursuant to an insurance policy or a health maintenance organization subscriber or provider contract, knowing that such statement contains any false, incomplete, or misleading information concerning any fact or thing material to such claim;
      2. Prepares or makes any written or oral statement that is intended to be presented to any insurer in connection with, or in support of, any claim for payment or other benefit pursuant to an insurance policy or a health maintenance organization subscriber or provider contract, knowing that such statement contains any false, incomplete, or misleading information concerning any fact or thing material to such claim[.]
      Saying one doesn't know exactly when or how a loss occurred is a "false, incomplete, or misleading" statement if the insured knows exactly the date or loss, right? There's the statute for you.
      Surprised you don't know the insurance fraud law that exists in the state in which you are licensed, Mike.
      You should be telling your clients to tell the truth and cooperate with their insurers' loss/claim investigations rather than telling them how to "trick" their insurers' adjusters.

In fact Public Adjusters typically try to write for more damages that you have since they get a % of the overall claim, which in return affect your premiums. You despise insurance companies...well I'm pretty sure they despise you as well. In case you didn't know, claims are paid based on the coverages provided in the policy, not what you can negotiate or damages you can fabricate that did not occur from a "covered peril" Seems your video is a step by step guide on how to commit insurance fraud (misrepresentation of the facts etc). Plain and simple, if damages existed BEFORE the occurrence, it will not be covered. You of all people should know that but since your bread and butter is mainly collecting a percentage of the settlement, I can see how you'd lie, cheat and steal to maximize insurance payout for your clients.

      Thanks for your reply. Being that you're an adjuster or insurance agent, I'm sure you can appreciate my fight for people just as you fight for the insurance company. As you will see from my other videos, where I give specific examples, time and time again, of adjusters/agents/insurance companies, like where you worked, took advantage of people, lied to people, stole their policy money and denied their legitimate claim(s) and underpaid their claim. If it wasn't for people that worked for insurance companies like you, I would never have this job to fight for people. So I do thank you very much. I really am grateful for insurance companies and the way they treat people because if they treated people fairly I wouldn't have a job.

      @@theclaimsquadpublicadjusters You are correct, I'm a commercial property claims adjuster. So I know firsthand what it means to have the "stigma" of untrustworthiness some insureds may have when it comes to settling a claim, for a host of different reasons. But at the end of the day, claims are settled based on factual documentation obtained on property damage (engineers, contractors, etc) and policy language/limits, not assumptions or perceived estimations. You may be right, there may be some carriers out there only concerned about increasing their bottom line and denying claims help them achieve that goal. However, there is a thing called "good faith" which is something I hold sacred in the work I do (speaking for myself). So you can understand my annoyance when I hear someone like yourself speaking about my profession, in general, as some global criminal enterpise only focused on swindling the public. If that were the case, literally all property claims would end up in litigation or in front of a jury. Let's face it, most people have no clue what's in their policy, much less how coverage is applied. It is our responsibility to educate them on what they are paying for and fairly compensate them based on covered damages. If you are such an advocate fighting for the people, you should make that a starting point with your clients, instead of portraying insurance companies as the boogeyman. Knowledge is power. And by the way, I hate denying claims. I try my best to find loopholes (per say) in the policy that give back coverage on losses that would otherwise not be covered. II'm an advocate for both the insured and the insurer. It's a mutual relationship. I don't pick sides. I pick the policy. I will check out your other videos, just so I can be more educated on these unfortunate scenarios and learn from them. Happy New Year to you sir as well.

He specifically said that you should NOT talk about prior damage because the insurance company will deny your claim. Of course they'll deny your claim. It's a fraudulent claim. I'm going to forward this video to the Florida Department of Professional Regulation. My guess is, he'll take it down pretty soon.

      And by the way - I am NOT condemning ALL Public Adjusters who advocate for insureds for justified claims. I'm sure most of them are honorable people providing a valuable service. I only condemn those who use FRAUDULENT tactics like hiding prior damage from insurance companies to further pad the claim - and increase the public adjuster's commission in so doing.
      Look over the critical comments below. In every case, Mike responds by pretending his critics are ALL working for an insurance company. Really? Do you realize that, while HE is paid by commission and earns MORE for getting claims jacked up higher, the insurance company adjusters are NOT paid any extra for denying claims. They are paid either by the hour, or a flat rate per inspection. They would have NO incentive to spend time here arguing against his practices.
