    Atty, im planning to buy a land and it's my first time. I have few questions:
    1.) to whom do we go to for verification?
    2.) If verified, how would we know that the title really holds the prospect property? What if ibang lupa pala siya? Kasi I can't imagine how would a title describe the location of its propert
    3.) How to know who owns an empty property na prospect lot mo
    4.) Are there unowned properties? If there are, can I buy it? And How?
    Im sorry if my questions sound stupid po, i am planning to buy palang po kasi and I have never held a landtitle personally. Thanks po!!

    Hello we got 400sqm lot in about 2 months will be done paying fot it so i ask the seller if i when can i get the dead of sale but instead he said he wont be giving me that instead the giving me a MOA i dont think that is right

    To begin with why would you want to buy a house or land from someone who isnt the Land Title Owner?
    And why would you buy land or house with out going through the bank? You should have a lawyer before buying real estate.. regardless where your located.

    May option po ba if half lang ng property ang gustong bilin? Ex: Lot area 200smq. You want to buy 100sqm. May process po ba para doon?

    Atty, May binili po akong dalawang properties sa Pinas a few years ago Pero pinangalan ko sa dalawa kong kapatid. Ngayon gusto ko na i pangalan sa akin kasi May anak na ako para din sa future nya. Paano po ang process para maisalin sa pangalan ko? Pls help. Thanks.

    Hello! New subscriber po. 6 yrs na po hinuhulugan namin yung house and lot sa pag ibig. Sa tax declaration sa munisipyo nalipat na po sa name ng may ari, pwde na po ba sya kumuha ng certified copy of title sa registry of deeds? Nakapangalan na din ba sa buyer yun or kay PAG IBIG pa din yung name? Thanks po

      I mean, kaninong name po magrereflect ngayon yung copy of title? sa developer? PAG IBIG? or yung buyer or nagloan sa pag ibig?

    Need po namin magpasurvey ng agricultural land sa Burgos, Pangasinan. Ito ay 4.15 hectares. How much po kaya ang charge ninyo?

      Malayo na po samin ang Pangasinan. And im not familiar po sa rates ng survey dyan, usually po kasi, hindi nmn same ang rates in every location. Pasensya po.

      Pagawa na lng po ng SPA (special power of attorney) si seller, in favor sa brother niya, para of ever, pwede ma rin yung brother niya na lng pumirma sa deed of sale din.

    Atty. Paano po Kung fake ung pagbili sa lupa during lockdown pero meron ng papers lahat Wala Lang seal and fake signature pa may Laban po ba ung mga pinapaalis na nag squat Doon for ten years ..? Just asking po Kasi un situation ng pinsan namin ...

    Hi atty. if selling price is 400k. Can i assume na si seller na magbayad ng CGT? What if hindi siya magbayad? Or what if sabhn niya ako magbayad?

      ang payment po ng CGT ay depende sa usapan ng BUYER at SELLER kung sino magbabayad. Wala po sya sa selling price.

      @@AttyJJLawMadeEasy atty another question po. What if po bibili ako ng lupa, so naka deed of sale under my name. If may intention naman ako ipabenta next year, pwede ko ba siya ipabenta kahit deed of sale lang hawak ko? Kasi parang ang hassle ilipat pa sa name ko tapos ilang buwan ko lang naman siya hawak.

    Hello po. Question po, sa pagbabayad po ng DST sa BIR, anong requirements po ang hahanapin nila? Si seller na daw po kasi ang magbabayad nung CGT

      Usually, these are the requirements:
      1. DoS with acknowledgement receipt,
      2. TIN Numbers seller and buyer,
      3. Certified true copy of title and tax declaration with certificate of no landholdings
      Ofcourse, ito po ay aside from the payment itself and the completion of the necessary BIR forms.

      Just to make it clear, DoS is Notarized Deed of Absolute Sale, hingi rin po kayo ng acknowledgment receipt from the notary public.

      Atty. J&J : Law Made Easy Wala pong binigay na acknowledgement receipt da notary. Pwede pa po bang makakuha nun sa notary office? Nakabalik na si seller sa Manila. Pero nakalagay naman po yung amount na natanggap nila sa Deed of Absolute Sale.

      Ok lng din naman, but you just have to do due diligence to make sure na good buy yung lupa, para iwas sa sakit ng ulo later.

      Atty, salamat po sa sagot, bakit po sabi ng agent May babayaran po akong vat na 12 percent pag bumili ako ng lupa above 1.9 Milyon, at ito po daw ay Ayon daw sa TRAIN LAW, salamat po sa clarification. God Bless po.

      Only in real estate sales of those who are engaged in the business of selling, developing, leasing or sub-leasing of real property and those licensed to engage in real estate brokerage business based on their commission or If the land is used in the trade or business of the seller, the sale thereof shall be subject to VAT.
      But that’s a different situation from what we discussed in this video.

      Well, if the foreigner’s parents are filipinos and dies intestate. they can acquire thru intestate inheritance but not by way of last will and testament
