Best advice ever: Never talk to the police. Their job is not to advocate for you. Thanks for covering this Dr. Grande.
Their job is to fill all the private prisons with the maximum amount of people possible.
FACT.
Some of the best free advice ever
And never take a polygraph!!
She told everyone she killed a man, they talked to the police
Sickening. She never should have been charged. She did society a huge favor. She was exonerated in 2006. The DA and his lackeys should be charged for this travesty
Did she sue. She needs restitution money
I wish police & prosecutors would be held criminally & civilly liable when they stitch somebody up like this, but they rarely face any consequences, which is why they keep doing it.
Actually, the best thing for us, would have been for her to have been eliminated in addition to the other guy.
She wasn't. She was released a few years ago.
What favor did she do if she did not kill the guy?
The best advice I've heard is : If your guilty , you need a lawyer . If your innocent , you REALLY need a lawyer .
Here’s some more advice:
You + are = you’re
@@CankleCanklethis isn't 2005 anymore, it's not funny or cool to be a grammar n@zi, so shut up and mind you're own business
Exactly because you can unwillingly collebarate some little fact here or there and BAM you r fuxked
40 - 100 years was the original sentence for killing a man who apparently raped women and was a drug dealer. I don’t understand sentencing.
Vigilante justice is not welcomed by the State.
I don't think sentencing depends on what sort of person the victim was, does it?
Yeah I just learned about a case where a 23 year old mother murdered her 2 year old child and dumped her body down a sewage pipe. She got TWENTY YEARS.
How is that guy's life worth 100 years of hers. Unbelievable.
@@eadweard. Actually it often does. Victim impact statements are taken into consideration by the judge when sentencing.
The only thing that she should have said to the police was, “I want a lawyer!”.
It’s your right. Use it!
The cops love it when you chat freely with them. Whats the worst that can happen?
They view you as the enemy if you want a lawyer right away, your not helping them.
@@bradsanders6954I hope this was sarcasm
Yeah, she was a turd. But the guy was a complete shitbag and loss to no one.
Agreed!
Best advice ever to people under arrest from “Homicide: A Year on the Killing Streets” - the police are not your friends.
"She was a clothing challenged dancer...just trying to implement a member separation agreement" 😂 I love Dr. Grande
I wonder is she servied time in a " penal " colony ?
Of course you do. What if it was a member of your family. Murder and Mutilation has no place for humour.
@@johndean958 There's jokes on every video regardless of the crime, why not watch something you enjoy?
It sounds like Kirstin didn't have effective lawyers at trial. The appeals lawyers did a good job. In 2019, Kristin filed a federal lawsuit against the Las Vagas police and detectives who handled her case.
Good, I hope she has/will bury them. Police sometimes get terrible tunnel vision, and cannot appreciate the absolute devastation they can render on the lives of innocent people when doing so. There's no excuse for it, and they are just as guilty of causing harm to the innocent when they do so as any criminal. The consequences for such actions should be devastating, to remind other police they must at all times be guided by evidence alone, not by their own subjective judgments.
She was exonerated, not even needing a retrial.
I like that.
@@JMurdochNZ Unfortunately, police are rarely held accountable for this type of behavior. But we can be thankful to live in America, because in America we have heavily-armed black nationalists who occasionally settle the score when police make a habit of going too far.
@@JMurdochNZTotally agree, it should be a criminal offence to destroy an innocent person's name, character and life.
The fact it took 16 years is repulsive. There should be overwhelming evidence before incarcerating someone, obviously there isn’t sometimes.. The system is broken.
There is rarely overwhelming evidence. Few cases are based on hard information. Circumstantial evidence is the norm.
She was SO STUPID that she TOLD MULTIPLE PEOPLE what she’d done!!!
@jamese9283 there are plenty of cases with direct evidence. Eg. Ted Bundy, Jeffrey Dahmer, Wayne Williams, Gary Ridgeway (the Green River Killer), Joseph DeAngelo (the Golden State Killer), Lonnie Franklin Jr (the Grim Sleeper), Ivan Milat, mass shooters like Martin Bryant or Nikolas Cruz, not to mention more recent cases such as, Jodi Arias, Letecia Stauch, Stephanie Lazarus and countless others.
A friend made the mistake of talking to the police because "he had nothing to hide". Yeah, the lawyer's fees bankrupted him. The lawyer told him it would have been a lot cheaper to not talk to the police.
Sounds like he had to hire a lawyer either way.
They'll hire you a perfectly good lawyer, why bankrupt yourself paying for a lawyer? Do they actually check if you can pay for one yourself or not? No, right? You just say you can't and the state pays for it?
I love you man… you’re so factual dry and hilarious all at the same time … super entertaining especially for us true crime lovers. 😂😂😂 please never stop posting Dr.
Isn’t he great 😂❤
@@julieannalauer1612 he is! I just love him.
well-said!
Poor woman. Can’t imagine sitting in prison for a crime I didn’t commit. 😔
The LDS never fails to provide interesting people to the world at large.
One thing religious cults try to do is to repress human sexuality. All that does is to cause pressure to build up until finally there is an explosion. This is what happened to Kirstin and it happens to people like her. Their natural urges are suppressed for a long time until eventually it all comes out in the form of promiscuity and sexual addiction.
As far as never talking to the police, that is a good point. In addition there is a saying that is relevant in this situation… If your guilty, you need a lawyer. However if you are innocent, you especially need a lawyer.
I wish jurors had to take a course on the law and the Constitution and Bill of Rights. Reasonable doubt is a thing.
Good idea. I'm surprised there aren't more hung juries. I think they often end up agreeing just to get out of there.
@@jamese9283yup. You’re 💯 they do do that quite often. This is why it’s best to avoid the sheep at all cost
They don't want you educated in that manor. If they did, there would already be such a course. They also don't like when people know, or speak, about Jury Nullification.
you learn that shit in middle school.
I always say that it is shocking how horrible our education system is yet the same government expects randomly selected jurors to be effective in deciding the outcome of a trial. A lot of jurors can’t read or write their way out of a paper bag let alone properly apply critical thinking skills. The only thing more tragic is how eager police and DAs are to convict ANYONE versus the actual perpetrator.
In addition to his knife wound the victim also sustained a terrible beating and the police never showed that Kirstin inflicted that beating or even had the physical ability to do so. The defense attorneys should have raised this, as well. It is clear the she did not receive a fair trial.
My first thought. How is a small woman going to knock out a man's teeth?
@@sydneyfairbairn3773with the baseball bat in her car because shes high as shit on meth which will give you what seems like super human abilities because it turns the switch off thats supposed to tell the brain "hey dont do that".
the judge kept it out
Also, I highly doubt she had the physical ability to lift this guys body and throw it in a rubbish bin in one piece.
The cops are so desperate for a conviction, her lawyer must be the worst ever
The cops will always be in a hurry to solve a case of a murdered black drug dealer.
Not sure if she had one, but public defenders are overworked and never have time to prepare which certainly wouldn't have helped her.
I think I heard the national solve rate for murders is only 10%, because they can only dedicate a certain number of hours to investigating each case. Of course, nowadays it's much easier with cameras and dna.
I'm sure she couldn't hire a good lawyer so a public defender is what represented her and obviously a bad one.
"When a person adds substances to their life, they subtract the presumption of innocence." This statement is so haunting to me, as a person in long-term recovery from substance use. I have been clean for several years - because I attend a methadone clinic I am regularly monitored and have a lengthy and consistent record of clean drug tests - however, I know that the fact that I was once an IV heroin user will be a dark cloud hanging over my head for the rest of my life. Forget about the fact that I have a degree from NYU and have worked for some of the largest newspapers in the world - if I were to ever find myself in a situation like this one, in which I coincidentally happened to cross paths with an individual who ultimately ended up dead through no fault or involvement of my own, I would certainly end up as Suspect #1 due to my "incorrigible history of hard drug use." It's a bitter pill to swallow knowing that law enforcement (and a sizeable percentage of the general population) will _always_ perceive me as just another junkie no matter what I accomplish in my life.
Is this really the fault of the cops?
Excellent comment 💎
And super congratulations on overcoming that addiction and lifestyle.
I've heard it's a real beast.
Strong work my friend
@@eadweard. the fact that these investigators determined her guilt based on their subjective biases instead of the extant evidence...? Yes that is their fault lol.
@@Sarah.Riedel Your comment was about the police seeing you as a heroin user, wasn't it?
Well in this case…that theory doesn’t really hold up - bc the attacker was also a substance user with a lengthy violent history…yet the cops presumed him to be innocent 🤷♀️
Thank you for shedding light on this all too common occurance. Never talk to the police. Always have representation, your freedom may depend on it.
We like to think the truth prevails, not so. If someone has been prejudged by an investigator they tend to find evidence to support their theory. Members of our family, a husband & wife, got into a physical altercation, the husband pulled her hair leading her up some steps. The detective called the wife to inform her he had changed a couple words in her statement to police. He took out pulled her hair & wrote choked her. She & I asked a lawyer why he would do this. He said because pulling hair is misdemeanor, choking is a felony. This detective wanted a felony charge. We found out what lengths some will go. Sad
It is surprising to me that the cops put any real effort into finding that guy's killer, given his criminal record and being a known drug dealer.
It's also most as if the prejudices we have about cops aren't strictly accurate.
I wonder if he had mob connections. Which wouldn't make the cops look very good.
@@synchro-dentally1965 Why wouldn't it?
Maybe some police corruption involved. Drugs and money.
Only because they found someone they hated even more to go after.
'Member separation agreement ' 😂😂😂
I really enjoy your work! 🇦🇺
It's amazing she got convicted at all. To say that the evidence for her guilt is weak would be an understatement.
Unfortunately, very few convictions are based on hard information. Circumstantial evidence is the norm.
@@jamese9283There is nothing wrong with convicting based on circumstantial evidence. Often it's better than direct evidence.
People just don't really know what it means.
@@eadweard.What is your definition of direct evidence?
I think you are going on the legal definition instead of the common one.
She was addicted to meth.
"Clothing-challenged dancer"!!!!!! "Severance package"! You, sir, are a riot. Please keep making me laugh like this...your dead-pan delivery is just perfect!
That's frustrating when you can't quite recall who you stabbed. I mean, that could happen to anyone.

Thank you as always, Dr. Grande! By the way, my husband bought me "Harm Reduction" for my birthday this year. Im going to start it tonight as we recently moved and have been extremely busy. Finally, we're all settled and im ready to crack that book open tonight! 😊
You will enjoy Harm Reduction! Unexpected twists. It’s a page turner.
Cannot believe she would get convicted of this when there is pretty much only reasonable doubt when there have been so many other extremely CLEAR cases where they get off the hook bc of reasonable doubt.
Like Casey Anthony.
She may have been acting in defense or just made up a story that coincidentally sounded similar to an actual situation, but some of the things she did/said did not help her case. If it was in defense, it would look suspicious to many that she would simply leave without calling for help or alerting authorities. If she just made the story up, that is not the wisest thing to do either, especially with how gruesome the story was. And whether it was in defense or made up, what you should definitely not do is tell authorities you did not think anyone would miss an individual you seriously injured as a justification.
Well said. Thankyou. Somebody at last has some common sense. She sounds like a ruthless b.itch.
Yeah, some of the things she said or done sound quite sketchy. I actually don't think I can blame the police too much for honing in on her, innocent or not.
Could have been just tough street talk considering what she did for a living, after all. They used it against her without a shred of real evidence. Unfortunately she thought being honest with police would be enough. Just awful.
Thank you Dr. Grande!! I’m glad Kirstin was finally released. I hope she has some good support….you are the best🌵💕😇from Jean
Very frustrating that her appeal was rejected, even though there was good reason (and what sounds to me like objective, verifiable evidence, re: the insects). The fact that law enforcement and the courts would make such serious decisions based on assumptions means that the problem won't be going away any time soon. Thanks, as always, Dr. Grande!
My heart goes out to her. 💜 Thank the Lord charges were eventually dropped.. she's been through Soooo Much. *hugs to her*

"She lived as a clothing-challenged dancer," Dr. G delivers in his inimitable low-key style. Hahahahahahaha- classic!
“Never talk to the police” wise words given how a story can be arranged against someone with murky history. The police must, I believe, to solve cases. 🙏Dr Grande for your disciplined perspective ☀️
Kirstin Blaise Lobato is a Nevada woman who was exonerated for the July 2001 murder and mutilation of Duran Bailey, a homeless man from St. Louis who was living in Las Vegas at the time of his death. At her first trial in May 2002, she was convicted of first-degree murder and sentenced from 40 to 100 years in prison. In a 2006 retrial, she was convicted of the lesser charges of voluntary manslaughter and sentenced to 13 to 45 years. Lobato's case gained significant notoriety due to the publication of new evidence, which some believe points to her innocence of the crime.
Clothing challenged dancer 😂😂😂

You are such a talented writer and brilliant analyst.
Thank you Dr. Grande for what you said about drug addicts not being treated fairly when being considered innocent or guilty
"...a clothing-challenged dancer..." This is why I love you, Dr. Grande!
I'd love to know if Dr. Grande ever had to serve on a jury and uf he may be blacklisted from doing so (forgive the snark). Love him!
It is truly shocking that a person can be convicted with so little evidence. Most people have a sense of confidence that they cannot be falsely accused and convicted of a crime.
Poor Kirstin. What a difficult life. I really feel sorry for her.
Any particular reason?
She didn't help herself by being promiscuous, violent, rebellious, a stripper and a drug user.
@@davidpetrosky Because she didn't deserve to go to jail. It was self-defense.
@@ciobalina7445 The comment was prefaced with, "What a difficult life". The same aspect of many people's lives, is discounted in other stories. Where drug addicted, troubled criminals lifestyles, get them caught up in hairy situations. Guilty, or not, you see a lot more less empathy. You see a lot more comments in the judgemental vein. "That's bad. But maybe if you weren't a druggie out on the streets, you wouldn't have gotten caught up in this mess" A far more stern sense of admonishment, generally. Just find it interesting, how the sense of connection with the human condition, seems to vary depending on who we're looking at.

😊😊Hi Dr. Grande, excellent analysis. You are right regarding substance users. My Therapist threatened me with jail if I didn't do Detox. Said he had friends on the Long Beach, CA police force. So I did Detox ( twice).
As always I learn something new from your videos.
Ever thought about doing a video on Mike Lindell?
Remember: If an investigator wants you to come to a police station to talk to them, you are a prime suspect and they are literally looking for a reason to arrest you.
Not talking to/trusting the police doesn’t come naturally to the innocent.
I trust police officers more than I trust criminals.
It should.
The fact that there was extensive fingerprint, DNA and shoeprint evidence at the crime scene - none of which belonged to Kristin - should have
easily resulted in no charges being filed against her. It is inconceivable that she could end up in trial with all this exculpatory physical evidence.
‘Severance package’.
You’re killing us Holmes. 😂😂😂😂😂
Lmao over the severance package and the revoked membershjp. Wickedly funny!
I don't understand why people feel the need to talk to the police. Your first question should be 'am I under arrest?'. If the answer is no, then walk. The police are not your friend. Don't ever think they have your interest at heart especially when they are trying to jam you up. Always tell them you want a lawyer .
"Clothing challenged dancer." I love it!

I was so distracted by her tiny eyebrows I had to go back a few times to re-listen. 😂
Agreed. Most women over-tweeze their eyebrows.
“Severance package”. Your wit never ceases to amaze me.
Thank you for the reminder that given circumstances anyone can find themselves in prison. Mistakes are made as evidenced DNA helping to exonerate people convicted horrible crimes due to the help of the Freedom Project.
My advice to everyone is never talk to the cops. An officer from the Miami police department responded to my home for a domestic violence dispute. My sister and mom attacked me, then called the police to say that I was beating them. They asked me a few questions and I just told him the same thing over and over again that I never hit her over the head with my phone and I never attacked her. Somehow in the police report, they put down that I admitted to beating her which was a total lie, and can be proven a lie with dash cam and body cam footage. We never had to make a big stink of it because my lawyer was able to get my mom to recant her statement and they dropped the charges. However, had I been somebody who was in the middle class or lower middle class and didn’t have the money for a lawyer I would’ve been in a unpleasant legal battle.
For some reason this reminds me so much of that old movie "Freeway", about another girl with a bad reputation who got unfairly judged for just defending herself
Thank you, Dr Grande for this video about Kirstin.
I hope you have a wonderful evening.
You nailed this one, and as usual, hilariously executed !
It's very sad that prejudice led the way with this case. It took so long for her to be set free, but in hindsight, it may have helped her- she was still young enough to change her mind and leave her hometown after a year or so after moving back there, and who knows what might have happened with her. It's still sad though, and I hope she leads a happy life.
Maybe if a random stranger grabbed you and attacked you and tried to rape you, it would make more sense to you.
Consider panic, fear, adrénaline, traumatic stress, etc. That fucks with your memory. It doesnt always make a person hyoer aware to detail when your just trying to avoid being killed or sexually violated.
"That fucks with your memory" doesn't sound all that scientific.
I agree.

Very well done on this one Dr. Beautiful analysis
The police can be incredibly lazy. One sees it time and time again. Also Kirstin must have had really bad attorneys. Very sad case.
“Clothing challenged dancer” .. that’s brilliant
I have self defense insurance because I carry a firearm for protection and the number 1 thing that is told if have to defend yourself is only tell the police when you call, that you have been a victim of a crime and need assistance, give location and advise if need fire, ambulance etc... and hang up. As soon as I heard the man was found in a dumpster leads me to think that it's more likely she didn't kill him. I'm sure she could have managed to get him up in there somehow, had it actually happened, but if so, where's her DNA?. By her being open to admit to others that she was attacked and tried to dismember him is more believable and would not have spoken of it if he died at her hands. Maybe word got out on the streets of his attack and injuries, and the killer used this to establish the similaries.
The fact that she was nowhere near the place during this crime, just goes to show the police bias you mentioned. There should never have been any charges to begin with. They had no problem wasting tax payers' funds to attempt to frame an innocent woman.
Dr., you're awesome!
It's crazy that you can have such a nuanced, logical and reasonable perspective on certain cases (like this one), but have such a distorted, unreasonable & ignorant perspective on others.
Hello Dr. Grande!
