I can see where you are coming from but I have seen drunk or intoxicated patients walk into the ER (we call it ED, emergency department) with breaks to lower extremities. To say they do not feel pain would be an exaggeration, indeed most felt plenty of pain but they ambulated well enough but every one of them were surprised that they had actually broken something. The victim in this case was not sober and may well of indicated that he was okay. I would not personally have left it at that (having said that I would not be driving drunk) He did leave him wrongly but it was bad judgment as was his decision to drive. I don’t think it was a malicious act to leave him. As for the drink driving I do not feel the penalties are strong enough it should carry the same penalties as involuntary attempt at man slaughter.

Definitely, a similar thing happened to me a few months ago when someone ran a stop sign and hit me while riding my bike. You are in shock to try and relieve your body from pain that you cant think straight.
He ran over someone and they “snuggled up” I would think they are dying. This dudes excuse makes no sense

Sitting here two weeks postoperative ankle fracture. There's NO WAY the victim said everything's ok. Extremely painful and requires metal plates and screws to put you back together. Asshats left him there! They're worried about a tow fee and the poor guy probably won't be functional for a couple of months!

While mustache driver feared being caught driving drunk on a “no ATVs” trail, the helpless victim may have, understandably, been *very afraid of the two large men.* He’s severely hobbled and on a dark, rural trail (no witnesses) and might’ve feared being killed and dumped in the woods…to never be seen again. It’s possible that he also noticed the chainsaw in the back of ATV (mentioned by the driver to officer). 😧
In a similar situation, with a phone, I may have waved them off too. But without a phone, I would’ve had to take chances on the strangers helping me…rather than dying from exposure, as you imply.

I mean, a broken ankle isn’t going to kill you most of the time. You’d die from dehydration or exposure before that. Since this seems like a fairly high traffic area (who goes for a run at night?) I’m fairly sure he would’ve been discovered before that happened. That’s not an excuse for his actions, but let’s not act like his whole body was run over. I’m just thinking like a judge who’s considering the sentence.

That’s super narcissistic to drive on a trail you’re not supposed to be on, drunk as Hell, hit an innocent person, flee without even calling for help, and leaving them immobilized and injured by themselves in the woods at 10:00pm. He needs the book thrown at him. Poor victim could’ve died. I hope he makes a full recovery.

The drunk guy said he stopped. According to the cop that was injured guy, he was on the verge of passing out from pain. I don't think that the other guys ever stopped. The guy with the crushed ankle would have been in a world of pain and in need of an ambulance!! Pretty scary place to be helpless in the dark!
Both the driver and the victim said he stopped, so I believe that. He stopped for a moment and went "are you okay?" victim obviously wasn't, driver knew how much s**t he'd be in, left the scene and the victim in the hope he'd get away and not be identified. So still classed as a hit and run, and a massive, tower sized DI*k move! He didn't care about leaving the victim out there with a crushed ankle and foot. I'm sure he was also worried about having to pay for the mans medical care. So he stopped briefly, then took off, according to the victim and the driver.

Dump of adrenaline when you think you're going to die will keep you from feeling anything. got in a BAD motorcycle accident, got right back up, walked off the side of the road, and was more concerned about my bike than really hurting, just felt kinda bumped up. it wasn't until i tried to unbuckle my helmet and couldn't move my fingers that i realized i'd shattered my hand. Turns out i shattered my hand, shoulder, and fractured both of my heels from hitting the ground so hard.

If injured and fearful, I may have acted similarly since there were *NO witnesses around.* I would’ve tried smiling and waving them on, to then call 911 after they were out of sight. In the days without mobile phones, this helpless victim would’ve needed to take his chances with two strangers who are already breaking laws and have the upper hand…in remote country woods. 😬

Doubtful. Most who offend have no earthly idea they’re over the legal limit, much less incapable of driving. I’m fairly certain that losing your license for six months, paying for SR22 for two years, attorneys fees over $3K, fines over $3K, towing costs and sobering up in a cell *SHOULD* be enough to dissuade most people, yet here we are. (My uncles DUI costs 8 years ago as a baseline, so I’m sure they’re more now)

It is to prove that the individual is in no condition to drive. It cuts off the "but my client has a very high tolerance and can easily maintain control of his vehicle even at that level of intoxication" argument.
exactly, these tests are unreliable in the best circumstances. here on an uneven trail I bet it would be completely invalid and is likely to be thrown out by a judge.
Because drugs don’t show but failing the tests is indication you have cause to arrest and do a blood test.
@@pap3rw8They conduct other reliable breath tests at the jail and or go to hospital and do a blood draw. Refusal gets you the same penalty as being drunk. In an injury accident they usually get a warrant for a blood draw.

I say cool beans all the time. I don't remember exactly when it became part of my vernacular but I graduated in 1979 so maybe we said it way back then.
I came across what I thought was a bag of rags laying in a busy street on the way to work at 5:00am what was the first day of school. Nope it was a teen who had been hit by a car. He was badly injured with a compound fracture of his lower leg. I blocked the scene with my vehicle and called 911. He told me the driver who hit him backed up and said "you'll be OK" and drove off. He kept trying to get up so he could find his skateboard that was precious to him . Finally others stopped to help and block the road further, I found his skateboard and shoe about 50 yards away. and gave it to him to help calm him as thee was no way he could walk on that leg. About a 2-3 minute response time from Station 77 , Paramedic Ambulance & EMS Battalion Captain, evaluated him, packaged him and transported him to a level 1 trauma center at a local Hospital. Don't know what happened to him or if any investigation ever happened. Welcome to Los Angeles

I crushed my ankle over 20 years ago. Ruined my very active life. 3 surgeries plus 6 mons of pt. I can't ride a bike, run, surf or even squat etc. When you crush a joint there is no getting back to the way you used to be.

I actually shook one’s hand after a speeding ticket and said thank you. 😂 I get nervous when I get pulled over, and he was super chill, so my words and actions were on super good behavior. 😂
They all seem nice, even the drunk guy (except for the little thing about the hit and run part). The cops were super nice, the nurse at the hospital too.

Yes, if you plead guilty you can’t plead your case, if you plead not guilty you can try to plead your case… often lawyers advise the consequences of this and why it’s better or worse for your particular situation. He chose to haggle and bullshit most likely. Because he has no case…but he’s a loser. So. That’s what losers will do. It still can be a smart move even though…bc a lot of judges are known to be terrible a holes etc… corruption can cause effects. It’s a fuckin game at the same time. But I digress…

@@AlWorth9738 I'm a cyclist and it's easy for me to see why some cyclists annoy people in vehicles. I was forced to follow two cyclists in my car for about 2 miles recently. They stayed in the middle of the road, side by side.
I never do anything like that. I take up as little space as possible and let drivers know when it's safe for them to pass me on narrow roads. By the time I'd got past, I was shouting abuse at them.

Pedaling your way on 2 wheels doesn't automatically make you better than "just about" everyone else nor award you special authority over the highway. The pigheadedness involved in riding side by side to intentionally block traffic simply because "we're here and ain't moving!" is akin to brake checking, except it's a hell of a lot more dangerous outside of the suburbs. It's the sort of thing that gets us killed. I almost plowed through a couple taking a Sunday ride on a rural road doing this very thing as I was coming around a blind corner while taking a Sunday drive in my truck. This is why we are, contrary to popular belief, legally obligated to pull over to the side and allow faster traffic to pass regardless what we're driving or riding. Your kids can't play in the middle of the road and neither can you. Impeding traffic is extremely dangerous and illegal. Just as dangerous as not giving a cyclist ample room while passing after the smart ones move out of the way. Be aware, be courteous, be respectful, be decent, be safe. Don't be an ass. It has a price on the road.

My adopted son got into an ATV accident while he was only 18... He died on impact... Him and his best friend were both drinking and riding ATV's on pavement... Please don't drink and drive any kind of vehicle while driving, you never know what the outcome could be... 😢
I remember this guy, that mustache is distinctive and his way of speaking as well. Ran across him a couple years ago down here in Texas. I pulled him over for running a stop sign in a neighborhood. Apologized profusely. Said he was there visiting his child (if I recall correctly) and was lost and just trying to follow the GPS and got confused. I was not overly nice and made it clear we dont take kindly to running signs in neighborhoods where there are kids running around down here in Texas. But he accepted responsibility, and seemed sincerely sorry to have done it, and plainly stated hed write himself a ticket in my shoes. I try to consider everything, and one of those things is trying to recognize if the person understands that they did something wrong and further ensure that they at least will try not to do that thing again...at least for as long as the memory of the stop is still pretty recent. I believed he got the message, so after my stern warning I let him go with a promise that as long as he is in Texas he obey our traffic laws and drive safe for himself and others.

Shame on this driver not only for his actions that night, but then having the temerity to plead not guilty when all this is on camera AND they had to get a warrant to test his blood. Now all this time and effort has to be put into a trial. I hope the injured cyclist has filed the appropriate lawsuits against this drunk driver either in criminal or civil court, because he needs to be made as close to whole as possible. Ankle injuries and breaks can be brutal with long-lasting limitations on mobility.

Those UTV tickets sound like me when I was 15 and got pulled over on my dirt bike while riding a short distance on a street to a trail access.
He got me for no lights, no license, no insurance, no driver's license, operating an off road vehicle on a public street or highway, no off road vehicle permit, and 50 in a 35 mph zone.
I had to sell my bike to pay off all of those tickets.

No one can. All the tests are designed for you to fail so they can get blood. That is where their cases fall apart is the blood draw. But until the results come in you are guilty as far as the law is concerned
And that’s why you should refuse if legally allowed to. I doubt I could do it and in this case it was on a rough dirt trail and I doubt a sober teenage athlete could pass.

Had a family member almost die bc of an atv accident involving alcohol on private property. If their friend hadn’t traveled out an hour to get ems they most certainly would have died. Please exercise caution when using any motor vehicle!

No its not normal to drunk drive a vehicle on a walking trail in the middle of the night. Dude obviously knew he was doing wromg so tried to skip the real roads where he would get caught more easily. He ran over a person. He crushed their ankle then left them alone on a bridge out in the wilderness at night, that is abhorrent psychotic behavior. Very not normal.

@@jessyvalentine7492 But the victim waved him off because he had a phone to call 911. He doesn’t know the drunk men and doesn’t want to potentially “disappear” in the rural woods. While helpless, he did the safest thing by downplaying his injury until trusted help arrived.
The driver was scummy for not immediately calling 911 to report the accident, but he was obviously trying to avoid charges for drunk driving on a prohibited trail. While it may seem “psychotic”, it’s very typical of most intoxicated drivers who downplay their involvement.
If you watch more of these body-cam arrests, you’ll soon realize that this driver is actually more polite and sane than so many others. That’s a disappointing realization, actually. 😔

Well it's Wisconsin so it's a cultural thing. You wouldn't believe how many DUIs I know of, and it's not taken seriously at all, at least in the country

The alcohol test change is a weird one. He was given the option of taking a test by the officer and refused, but sure as hell wasn’t resisting when it was time for the one with a warrant.

You don't have a requirement or duty to report a crime.
Passengers are rarely charged as they usually have no control over the vehicle and unless you are the one who caused this “accident” you aren’t required to report a crime even as the passenger

He and the victim are super lucky the victim didn't die. In spite of his litany of crimes, he managed to avoid getting shot, tased, or even yelled at because he stayed calm, told the truth (mostly), and cooperated.
