Got it few hours ago at $40 I can set aside the Title Screen and Lack of a Good Story Mode, we can all agree it's bad. As for the gameplay, it's below normal. I've been having fun for the past couple of hours already but I can say it can definitely be better if the Recovery Frames are just shorter for faster gameplay. That's the exact reason why it looks clunky and slow. I really just hope they actually revamp the gameplay to be faster because that's literally the only thing stopping it from being good aside from the lazy Story Mode contents. Definitely not worth $60. Getting it at $40 still feels too much. If the game somehow gets better in Gameplay, $30-$40 would probably be a decent offer.

Dear Nintendo, I am writing to you today regarding your Community Tournament Guidelines. Put simply, I am not a fan of them. While I do think that there is merit to the idea of having community tournament guidelines, I disagree with some of the restrictions you’ve included. Below are some of the issues I take with it, along with questions about it, and suggestions for ways to improve it. I hope whoever receives this letter will take the time to read through it, potentially pass it along to those in charge of these guidelines, and maybe respond back with answers to some of the questions. Firstly, the participant restriction. “Tournaments may include up to 200 Participants for in-person tournaments or up to 300 Participants for online tournaments.” Why limit the number of participants? I can sort of see a reason to limit the in-person number, what with COVID and all that, but I can’t think of a single reason why there should be a cap on the online number, at least on your end. On the end of tournament organizers, I could understand them capping it due to only wanting the tournament to run for a certain amount of time, or not having enough people available to moderate a tournament of large size, but I don’t see any reason why you’d want the number of participants capped. Additionally, the recently released Splatoon 3 Tournament Manager allows the amount of teams per tournament to be capped at 512, or up to 2048 individual players. Since the manager requires you to read and agree to the Community Tournament Guidelines before creating a tournament, this runs counter to the cap on participants that you yourself have put into the guidelines. If you could elaborate on A) why there is a participant cap, and B) why Splatoon 3’s Tournament Manager breaks it, it would be greatly appreciated. Alternatively, removing the online cap altogether and just letting the tournament organizers decide themselves would also work. Side note: the workaround described in Q12 of the Frequently Asked Questions is neat, but sometimes tournaments are only able to get a venue for a single day, making it entirely impossible for those tournaments to run. It would definitely be a better solution to just not have a cap in the first place. Next, disclosing accounting. “Organizers collecting fees must publicly disclose all accounting related to the costs of hosting the event promptly, including entry fees, admission fees, and prizes distributed by posting them on a website and/or on social media accessible to everyone.” This is a bit unclear. Do they just need to declare those three items, listed, or do they also need to declare other things such as amount they are paying the venue to be able to host the tournament there, or the costs of equipment like the systems or monitors they’re bringing, or the cost of gas for traveling to the venue? This part definitely needs a clearer definition. If it’s only the three things directly stated in the guidelines, I’m perfectly fine with it. If it requires you to disclose backend information, stuff participants likely wouldn’t normally be concerned with, I see no reason for it to stay that way. Following up on that point, sponsorships. “When hosting a Community Tournament, Organizers may not receive goods, services, money, etc., from third parties as sponsors.” Additionally, lower down in the guidelines, “Nintendo Games may not be used for Community Tournaments that…Have sponsors or that advertise or promote any entity, products or services”, and from Q3 in the Frequently Asked Questions, “Tournaments that are not permitted by these guidelines include but are not limited to…Tournaments that receive goods or money from third parties, such as sponsors.” I must again ask, why? What is the purpose of banning sponsorships outright? I’d understand requiring any sponsors to be disclosed, or requiring the sponsorship be used exclusively for covering the costs of organizing the tournament and towards prizing (and thus limiting it through the $10000 of cash prizes per year rule), but I don’t see any good reason to ban them completely. I’d suggest removing the ban and instead implementing limits on them. Something like what Capcom has for their “Street Fighter V Community License Agreement for the Americas” would work. “The sponsorship contributions must not exceed $6,000 USD per Event” and “The total sponsorship contributions within any given 12-month period must not exceed $30,000 USD” seem like reasonable limitations. These next 3 are relatively minor things, but I still wanted to cover them. First off, “The names of Community Tournaments may not contain Nintendo trademarks or IP, such as Nintendo’s company name, logo, product or service names such as game titles, names adopted from Nintendo Games such as character names . This includes any shortened or modified uses of Nintendo trademarks or IP.” This is restated again in Q6 of the Frequently Asked Questions, and Q2 even expands on it by stating “it is not permitted to use Nintendo game logos, character images, game images, music, or sound effects for community tournament promotions, venue decorations, or venue background music.” I do understand why this one is here, I’m just not a fan of it, especially the last part about shortened or modified uses. When the tournament doesn’t have multiple games from different franchises featured, using recognizable phrases or imagery related to the games featured is a quick and easy way to help people understand what is featured at the tournament. For example, there’s very few people who are familiar with the Super Smash Bros. series that wouldn’t immediately understand what the focus of Super Smash Con is. I’m not going to push too much on this one, I know Nintendo is very protective of its Intellectual Property, but please consider changing or removing this guideline. Secondly, I wanted to get a brief clarification regarding linking the guidelines. “The Organizer posts the following notices on-site and on tournament websites and other promotional materials: “Terms for participating in and viewing Community Tournaments using Nintendo Games” accompanied with [URL for Nintendo Support article on Community Tournament Guidelines]”. I don’t actually have a problem with this one, just two questions for clarification. Would a QR code work as a substitute for the URL? Would copying the contents of the article into the posts or printing out the article for physical materials work as a substitute for the URL? Not a major thing if the answer to either of those is “No”, but the clarity would be appreciated. Lastly, I wanted to cover the guidelines regarding sale of food, beverages, and merchandise. As stated in Q3 of the Frequently Asked Questions section, “Tournaments that are not permitted by these guidelines include but are not limited to…Tournaments involving the sale of food, beverages, or merchandise.” I’m confused by this one. Is it only banning the tournament organizers from selling these things themselves, or is it banning all sale of food, beverages, or merchandise on the premises? If the former, understandable. If the latter, why??? I get merchandise, in almost every case it’d either be resellers or unlicensed merchandise so I see the vision there, and I could understand a ban on alcohol, but all food and drinks? I know of many tournaments, including ones under your arbitrary participant cap, that regularly last from lunchtime to after dark. While it is usually fully possible to leave the venue and just grab some food from somewhere else, I don’t see any reason to ban people from selling food or drinks on the venue. Moving on to the final thing I wanted to cover, from Q16, “Tournaments that are illegal or could be viewed as offensive or otherwise inappropriate include, but are not limited to, tournaments that [include]…Use of game consoles, accessories, and software not licensed by Nintendo.” Consoles and software I can fully agree with, my one concern from this fall with “accessories”. Many competitors use 3rd party controllers, for reasons ranging from competitive advantage to comfort to accessibility. While I do agree that there should be some limitations on what can be used, I’d much prefer it to be in regards to what each controller can do - something like “no simultaneous horizontal inputs, no turbo buttons, no macro buttons” - rather than limiting controllers entirely. There are already some problems with inclusivity in competitive gaming, please don’t let this be another barrier for people. Now, I do understand that it is unlikely that I will receive a response to this letter. As stated on the guidelines, “Nintendo will not respond to individual inquiries regarding the guidelines or Q&A.” Despite this, I am still sending this to you, in hopes that someone will hear my questions and requests. After all, if I don’t send something there’s a 0% chance my questions or requests will get answered, while sending this at least has the chance that you, the person reading this, will disregard the above. First off, “The names of Community Tournaments may not contain Nintendo trademarks or IP, such as Nintendo’s company name, logo, product or service names such as game titles, names adopted from Nintendo Games such as character names . This includes any shortened or modified uses of Nintendo trademarks or IP.” This is restated again in Q6 of the Frequently Asked Questions, and Q2 even expands on it by stating “it is not permitted to use Nintendo game logos, character images, game images, music, or sound effects for community tournament promotions, venue decorations, or venue background music.” I do understand why this one is here, I’m just not a fan of it, especially the last part about shortened or modified uses. When the tournament doesn’t have multiple games from different franchises featured, using recognizable phrases or imagery related to the games featured is a quick and easy way to help people understand what is featured at the tournament. For example, there’s very few people who are familiar with the Super Smash Bros. series that wouldn’t immediately understand what the focus of Super Smash Con is. I’m not going to push too much on this one, I know Nintendo is very protective of its Intellectual Property, but please consider changing or removing this guideline.
Secondly, I wanted to get a brief clarification regarding linking the guidelines. “The Organizer posts the following notices on-site and on tournament websites and other promotional materials: “Terms for participating in and viewing Community Tournaments using Nintendo Games” accompanied with [URL for Nintendo Support article on Community Tournament Guidelines]”. I don’t actually have a problem with this one, just two questions for clarification. Would a QR code work as a substitute for the URL? Would copying the contents of the article into the posts or printing out the article for physical materials work as a substitute for the URL? Not a major thing if the answer to either of those is “No”, but the clarity would be appreciated.
Lastly, I wanted to cover the guidelines regarding sale of food, beverages, and merchandise. As stated in Q3 of the Frequently Asked Questions section, “Tournaments that are not permitted by these guidelines include but are not limited to…Tournaments involving the sale of food, beverages, or merchandise.” I’m confused by this one. Is it only banning the tournament organizers from selling these things themselves, or is it banning all sale of food, beverages, or merchandise on the premises? If the former, understandable. If the latter, why??? I get merchandise, in almost every case it’d either be resellers or unlicensed merchandise so I see the vision there, and I could understand a ban on alcohol, but all food and drinks? I know of many tournaments, including ones under your arbitrary participant cap, that regularly last from lunchtime to after dark. While it is usually fully possible to leave the venue and just grab some food from somewhere else, I don’t see any reason to ban people from selling food or drinks on the venue.
Moving on to the final thing I wanted to cover, from Q16, “Tournaments that are illegal or could be viewed as offensive or otherwise inappropriate include, but are not limited to, tournaments that [include]…Use of game consoles, accessories, and software not licensed by Nintendo.” Consoles and software I can fully agree with, my one concern from this fall with “accessories”. Many competitors use 3rd party controllers, for reasons ranging from competitive advantage to comfort to accessibility. While I do agree that there should be some limitations on what can be used, I’d much prefer it to be in regards to what each controller can do - something like “no simultaneous horizontal inputs, no turbo buttons, no macro buttons” - rather than limiting controllers entirely. There are already some problems with inclusivity in competitive gaming, please don’t let this be another barrier for people.
Now, I do understand that it is unlikely that I will receive a response to this letter. As stated on the guidelines, “Nintendo will not respond to individual inquiries regarding the guidelines or Q&A.” Despite this, I am still sending this to you, in hopes that someone will hear my questions and requests. After all, if I don’t send something there’s a 0% chance my questions or requests will get answered, while sending this at least has the chance that you, the person reading this, will disregard the above. Still, even if you don’t respond to my inquiry, I hope you are able to address my concerns moving forwards. Thank you for your time reading this.
