Rape on the Night Shift (full documentary) | FRONTLINE

  • Every night, as most of us head home, janitors across America, many of them women, begin their night shift. They are often alone or isolated in empty buildings - and vulnerable to sexual violence. (Aired 2018)

    Following up on the award-winning collaboration that produced “Rape in the Fields/Violación de un Sueño” in 2013, FRONTLINE, Univision, the Investigative Reporting Program (IRP) at UC Berkeley, Reveal from The Center for Investigative Reporting (CIR) and KQED teamed up to uncover the sexual abuse of immigrant women, often undocumented, who clean the malls where we shop, the banks where we do business and the offices where we work. Drawing on interviews with the women themselves, an attorney for the federal agency that enforces sexual harassment laws in the workplace and a watchdog group that monitors workplace conditions for janitors, the investigation sheds light on an underreported problem - and reveals how employers have fallen short in dealing with it.

    THE MORAL OF THE STORY;
    If you can't protect your employees from sexual assault or rape, then you have no business in the business. Saying that you have hundreds of employees and can't provide safety for all of them is no excuse. A Sexual Harassment Lawsuit is a cost you pay for being careless.

      Bro you're talking about a company that outsource to smaller companies that only hires illegal immigrants...they do that so they don't have any real responsibility toward them...most of the time these big companies hire out to sub contractors ...the sub contractor hires the women...it's a game that's been going on for years in the construction business cleaning business and the nanny business...I remember when I worked at a hospital in NYC u had a cleaning staff that was employed by the hospital
      ..the employees were union workers getting good pay and benefits the hospital also had what's called satellite buildings and offices in different locations throughout the city.. they started outsourcing the cleaning jobs and the security for all the outside satellites buildings that were away from the main hospital..before that everyone u seen working at any site in any part of the hospital was hired by the hospital ...now today the cleaning staff at all parts of the hospital comes from a outside company that only hires illegal immigrants for crap pay and no job protection...I asked my friend that still works at the hospital why would the hospital do that ..he said they don't have to pay for anything involving the cleaning crew or security also it's a tax right off...the hospital just cut a check every four months and that the last of their responsibilities...he said the sad part about the situation is the union allowed it....

    This was difficult to watch but it speaks to a bigger problem in the United States that rape isn't taken seriously. For every rape conviction there are literally thousands that never see trial. It's a shameful mark on the country that such a heinous crime is allowed to fester.

      I personally think high profile women who are assaulted and they take money instead of the courts prosecuting their rapist should stop taking the money and signing NDA's. They're leaving rapists go free for hush money! That turns my stomach.

I know high profile women who have been abused and raped and instead of making a criminal complaint, with substantial evidence, they'd rather take the money. There are women who care more about money than protecting other women from a rapist that they let go free. I'm not saying any of these women are like that, but not all women are saints, that's just a fact. The more men who get to pay monetary settlements instead of being prosecuted and punished with prison time is telling them they can continue to abuse and rape - they just have to come up with some money.

    I worked on a DOD project and witnessed a rape attempt at our unionized work. I was the union steward. I walked up to the incident spun the attacker around and cold cocked him. When the investigation was conducted he claimed she was the instigator of his attack. We were both sent home for the night and I reported to my union bargaining chairman when I got home by phone. I returned the next day and learned the attacker was discharged as the young woman filed a complaint, also. I would do it again.

    When I told my manager that I was groped by a coworker he told me that I would be fired because I defended myself. My manager swept the whole incident under the rug. 12 years later I still regret not calling the police.

    I worked overnight at Walmart from 18-22, as I needed to attend my college course during the day. Had more than once instance where security and even the police 2 times had to escort me to my car. Threats against me by men who couldn’t deal with no. I couldn’t imagine working alone at night. 🥺

    i’m a woman and worked for 5 years on nightshift at a hospital in Cali. there were at least 30 of us plus my managers who were great, i never felt unsafe. then i moved to Ohio, got a new job at a different hospital also on nightshift.
    this hospital is very small and so there was just me and ONE other guy. he wasn’t bad, just annoying (very lazy, pretended to not understand directions so then things got put on me because it was “easier” than disciplining him). but it was just us, no managers work at night there.
    then they hired a third guy…. and right from the start he made my hair stand up on my neck. he would stare at me sometimes, ask creepy personal questions, etc. i told my managers in the morning how he was behaving and they completely brushed it off. this guy is 20 years older than myself at least (i’m 29). after 6 months of dealing with other problems and not having them resolved, i knew they wouldn’t do a thing about this guy.
    so i quit. i’d rather worry about money than my safety.

    working the overnight shift in an office, you get to know the cleaning people. the two women on the cleaning crew always went everywhere together. i figured they just enjoyed each other's company...i never imagined they could be doing that for their own safety. terrifying!

    My husband along with my sister in law (different times) worked for ABM my husband used to tell me how women were treated but he's always been a gentlemen so would stay after hours waiting for the ladies to leave and make sure they were safe and in their car, so when his sister started working years later he made sure to to let them know she was his sister and they better not mess with her. Would go wait for her outside to pick her up and stand by the side of the car so the men could see him. 💪🏼
    However in other locations we knew horrible things were happening, so sorry for this workers. 😟

    This also happened to me while at work during the day. I immediately reported everything that happened to my supervisor who was a woman. She told her immediate supervisor who was her husband. They were friends with this man and both took the position that I must have done something or led him on in some way. The most I had ever said to this person was hello in the morning as I did to everyone as I was clocking in. I can not even begin to tell you how this made me feel. This moment forever changed the way I look at things. I assumed that because I was truthful, that I would be believed. I was 22-23 yrs old at the time and very naive. Everything I told management was thrown back at me . They made it seem as if I had done something to deserve this man feeling like he had the right to do whatever he wanted!
    I’m so sorry to these women who went thru this! The bravery it took to go thru these situations and then report it is admirable!!
    There really is strength in numbers and strength in telling your story and being believed!

      All women should go directly to the hospital when they have been raped. The hospital has a “ rape kit” and they can see immediately if it was a rape because there are always little tears. They take DNA samples and photos and clean you up and help you get better. Even if the rape was incomplete, the hospital can see by the type of bruising that it was attempted rape. Staying silent just helps evil people to make more victims.

I've been present for dozens of forensic exams (rape kits) and worked with hundreds of survivors, and rarely is there obvious physical evidence other than DNA. It doesn't mean they aren't helpful or that people shouldn't get medical care - I will always advocate for people to get medical care if it is safe, sexual assault nurse examiners are incredible people who truly care about survivors, and if people do want to report to law enforcement a kit can be important. I just wouldn't want people to think that if they don't have physical proof, they weren't raped.

    Wow... my mom did this type of work when she immigrated to the US. She's so private about her life so I don't really know what happened in detail, but I do know she's been through several abusive incidents at workplaces. To think of my 105 lb. mother battling health conditions, cleaning buildings at night, working at a clothing factory during the day, raising me, fighting off predatory ppl, and making sure I had most of the things I wanted as a child/teen... all without having any nearby family to lean on. I honestly have NO IDEA how she did it. I have a relatively easy career, financial stability, no health problems... and I still have a hard time just taking care of myself lol

    I worked for ABM for several months. It was the hardest, most physically demanding combined with fast paced job I’ve ever had. And in the top 3 worst employment experiences of my life.
    The building was over 50,000 sf, and 7 hours was given to make it perfect every day. WTF… I was called a bitch and fired by text for not being able to cover my supervisors shift the FIRST TIME I was requested to do so because I was at a restaurant with my Husband on his Birthday.
    My dog died 3 days later and when I called in, this is AFTER reporting the above matter (and agreeing to stay as acting supervisor until a replacement could be found), I was told it was just too bad, I had to work. Ummm, I couldn’t breathe, she died in my arms at home and I was alone.
    I quit the following morning and should have sued because my final paycheck didn’t come for 3 weeks.
    F^^^ ABM. The most hostile, combative, cruel and brutal company to work for, EVER.

    I worked as a janitor in Fall 2005 for a company in Los Angeles, CA. We met for work 3A at a night club, and then we would make our rounds. We cleaned night clubs, comedy clubs, television studios, fashion designer warehouses, the shops on Rodeo Dr. and houses in the hills of Hollywood. I was 1 of 2 women on the crew, everyone else was men. Thank God I was not sexually assaulted, but as I think back there was lots of sexual harassment towards me, my female coworker and women walking along the streets (cat calls). There was more misogynistic BS that occurred as well, and I often felt uncomfortable d/t to the inappropriate behaviors. I ended up quitting after a few weeks. The owner was the biggest pig of them all. He even tried to stiff us on our paychecks. The other workers were undocumented, felons or couldn't speak English, so the owner AND his wife really tried to get over on the workers. I wasn't going for it, especially when you mess w/ my money. I had to have my cousin who was a paralegal get involved just to get my last paycheck. I was young, and I wish I'd gone further and actually reported this company. No woman, nobody should have to experience any of this while doing a job trying to feed themselves or their families. This is just heinous!

    I used to clean offices/ banks after hours when I was only 22-23, and I can confirm, it can get scary at times. You are isolated, working in large spaces oftentimes, and for me, I always followed a set routine. All things that make it super easy for a predator . I was lucky in that I had great male supervisors that usually did drop ins. Looking back now I can't believe how naive I was to all the true dangers I was in

    I was team leader for a group of mostly women. There used to be a manager who would come down to my department to flirt and harass some of the women on the evening shift. I reported this to my manager, she said she could not report him because he is a friend. I told her I would go above and report him to HR. Later she changed her mind and reported him because she knew that would make her look bad if I did it.
    It is tough for anyone going through this because they will threaten your job if reported.

    My own mother worked cleaning hotel rooms. It was a pretty good job because there was often food left in the fridges and it was a short walk up the road to it. But the guy in charge wanted to take advantage of my mother in this way so she quit. This was in the 70s when there was a sort of social safety net, and she found other work.

      Hotel room cleaners also experience this a lot. I watched another documentary on this and many of the hotels now give their cleaners panic buttons to call security because so often male supervisors or hotel guests will try to assault them because they're alone. My sister works doing this and has more than once had a male guest try things with her, like answering the door completely nude and trying to pull her in the room.

    As a woman I'm horrified, as an immigrant, I feel lucky that I`ve never worked as a janitor or in an isolated building doing a night shift.

It may take a looong time before they can feel strong enough to think about it or talk about it to a stranger .       While its a good idea, from what I've read its not the cameras that are expensive but the system used to store all the footage and thats why a lot police dept still don't have them. Im not totally sure if this is accurate or not. But mayne carry a recording device while on the job, carry mace or tasers, wish they made underwear that had spike when you try to touch people privates.

    Exactly why i do not want to stay late! I've seen a 32+ y-o manager follow a 16 y-o girl into back room and say, "We shouldn't keep meeting like this" (toyally inappropriate) and she walked away & ignored him and I walked in. Bad thing is, he "appears" to be a "nice" guy. 😒 No one would believe her. I probably wouldn't have if I hadn't seen it myself. What is wrong with our society?!! I used to leave the bank and saw the cleaners come in and felt ill at ease for the women who had to stay with the rough looking men, but looks don't mean anything at all. "Nice" guys are just as bad. Carry mace with you everywhere you go and be alert of all of your surroundings and pay attention to your gut.

    When I was young I worked for the Canadian federal govt., the dept. of transport. I was terrified to go to the copy room because this older man would follow me in and rub up against me as I was trying to make my copies. It was sickening, my heart goes out to these women. I cannot imagine what would have happened had it been night and all alone. I salute these brave ladies who speak out.

    If I had a dime for every predator who said, “No one will believe you.” When I was a little girl, that’s exactly what my abuser said. For ten long years I put up with the same behavior these women did.
    Seeing these women recount their experiences leaves me no doubt they are telling the truth. Just because a claim is dismissed doesn’t mean it’s not true.
    Gillibrand is right. The women’s testimony IS evidence. But sexual assault is the gift that keeps on giving. I had therapy and I was “OK” for a while. But it definitely ruined my life.

    I also think things would be different if a leader made periodic unannounced visits to job sites every day or two....that would keep perps on their toes; I think a certain criminal is attracted to such jobs...something needs to be done.

      Oh, absolutely. Predatory individuals communicate with one another. They know all the tricks and tips to finding their victims, and it's usually going to be the ones who society doesn't give a damn about (manual laborers, sex workers, undocumented ppl, etc). Those are the victims who will stay quiet even after being attacked bc they know speaking up will be an even greater headache. Such a sad existence in a so-called civilized, progressive society. It only feels civilized and progressive if you're part of a good enough societal status.

    Makes me think back to the Dominique Strauss-Kahn case (2011). How long will women be condemned to live in fear of these predators? Rape is a form of murder in my opinion and should be taken much more seriously than seems to still be the case.

    My heart goes out to these women. These women may need psychotherapy and group therapy. There is mental trauma and PTSD within them. I hope they will use the awarded funds towards healing, and they become mentally and physically healthy. I wish them to be well. I hope someday they will be able to get pass these horrible experiences, and find joy in their lives.

    I used to do office cleaning at night but my supervisor, who worked alongside me was a woman. There was nobody else on the premises and we were safely locked in. Most of the places had cameras inside as well as outside the buildings. One of the places we cleaned was a bank and they had cameras everywhere. We cleaned warehouses as well. So I was lucky this never happened to me.

    That victim who testified first against ABM is a very brave woman, along with the others who testified against ABM. Those perpetrators should be jailed for life, and those companies should be ordered to be closed down who keeps hiring these monsters.

    It hit me again! Back in 2006 at my job a guy sexually harassed me. He caressed my legs up and down with his legs while I walked by and he was sitting down. Additionally, he would sometimes ask me if I was a “virgin” and other sexually explicit questions that were too personal. I was a 21 year old virgin and never had a boyfriend so it was traumatic. I wish I had reported him!! 😢

    I had no idea this was a rampant problem within the cleaning industry and it honestly breaks my heart. This is a known danger within the industry, so it makes no sense that companies are not taking greater precautions upfront to do all they can to prevent these occurrences of placing their employees in harm's way.
    The common denominator is that these are the most vulnerable in our society: Low income women who desperately need work and are often either undocumented or have a language barrier. To me, the ongoing nature of this is less about indifference toward r@pe or its difficulties to prove, but about indifference toward the type of people in society the victims represent to these CEOs and upper level managers.
    Let me help those upper level managers who keep saying prevention is SO hard:
    1) Hire more female supervisors and always have women work in pairs.
    2) Have an night security guard on duty at all sites. Arm workers with with walkie talkies and panic buttons. I don't care the cost. These are multi-million dollar companies. If they want safety for their workers, make it happen.
    3) Use body cam technology for employees.
    4) Have an inhouse EEO office with bi-lingual employee representatives so workers have a system in place to be heard if they are being made uncomfortable and can be legally and freely represented if a crime is perpetrated against them with no fear of job loss or deportation. The perpetrators all felt safe because they knew these women had little employment or legal recourse.
    5) It should go without saying but extensive criminal background checks should be done on all site supervisors.

    Great documentary on very unheard of topic and frontline did a good job! Thanks Frontline!! The last part of documentary was so satisfying to watch to show power of women.
