CRAZY Cop Pulls Over Bikers... You Won't Believe What Happens Next

  • Story:
    We were 4 bikers on our way back from Flight 93 Memorial in Stoystown, PA. My friend and I get pulled over for crossing on double yellow.After waiting for citations for 10-15 minutes the other 2 bikers (my brother Ryan and other friend) walk up to see whats going on and just to wait with us. They stand off to side as instructed by the officer outside the vehicle (Officer Smith) After another 5 minutes or so of casual conversation among ourselves and Smith, he asks for ID from Ryan, who responds, "I am required to show you ID?" Smith responds, "I am a police officer." Ryan says, "I understand that but whats the reason." He responds by saying, "You came on my scene". Smith asks for his name which Ryan gives. At this point the other officer (Williams) gets out of the squad car and asks whats going on. Smith says that Ryan isn't showing ID and immediately the Williams says, If you don't show us ID right now we can arrest you, tow your bike, and then you have to pay bail. This is when my brother says, "someone get this on video". So I pull out my phone and the following occurs.
    After the Video: They seize my phone and play the video, which has audio obviously. I am then arrested by Williams for audio taping them without their consent (Wiretapping Law), which according to the ACLU does not apply to officers doing their regular duties in public. So I'm arrested as well. Eventually my friend calls his police officer friend who talks with Williams. Then we are both released as long as we give them the video and delete it. So they continue to seize my phone to make us follow them back to the station to transfer the file. After not being able to transfer it due to software issues the Smith takes a video of my video with his iPhone. I am then told to delete the video so I stealthy slide to the next video, which Williams created while seizing my phone (he had no idea how to use a smartphone) and deleted that one. Now I'm sharing this ridiculous video of a cop on a power trip arresting innocent civilians after they visited a 9/11 memorial.
    Court Case:
    In the end my brother was found not guilty, because the judge had a feeling it was all about refusing to show ID. The judge did however scold my brother, telling him "you shouldn't have been there". During the court case, my brother was not allowed to present the video because the judge confirmed that the Wiretapping Law made the audio recording illegal and not admissible evidence in court. Also the officer, Williams was exaggerating details and making it seem as if my brother was disorderly and a threat to the officers safety. Williams said when they told the two approaching bikers to stand off to the side my brother kept approaching (lied under oath). Smith even proved this point when he gave his testimony and said when asked to stand off to the side of the road they did. Williams also said my brother caused a unsafe road condition by making them stop traffic as he was being arrested, which was completely out of his control because...he was already under arrest.
    The onsite arrest was removed from his record as he was found not guilty.

    How many mistakes did the officers make in this video, lets find out. #1: 1st Amendment violated. I couldn't tell but maybe a 4th Amendment violation. No miranda rights read while being placed under arrest. Yeah this is getting thrown out/dismissed. If I were you, I would sue, and go after both of those officers badges to have them decommisioned. Was there ever any reasonable suspicion, or probable cause to show you did anything unlawful?

    "Stop and identify" statutes are statute laws in the United States that authorize police[1] to legally obtain the identification of someone whom they reasonably suspect has committed a crime. If the person is not reasonably suspected of committing a crime, they are not required to provide identification, even in states with stop and identify statutes.

      OK. All courts are adversarial. Who's rights has this man violated? Statutes are statutes and laws are laws. What evidence do they have to prove it applies to anyone just cause of there physical location. If courts are based on facts and evidence than what evidence is there to prove there opinions? Every bureaucrat spews forth there opinions and somehow its a fact. Well a badge and a gun and there willingness to kill us does not turn opinions into facts.

    What the hell is up with that wiretapping law being used to not allow the video in the court. I think and I hope that that has been thoroughly overturned by court precedent by now. In public, video and audio recording is permitted, at least it should be. Especially the recording of police officers on duty.

      +jimmi izzy my understanding of the law is that audio recording is illegal in the event that you try to record private conversations...however, police while in the middle of their duties are in the middle of a public service, which by its very definition IS NOT considered to be private, thus police officers on duty do not have a right to/expectation to assume privacy, so unless I'm incorrect this video should have been admissible in court.

    I’m a cop, unless there is probable cause and that’s meaning a crime, You do not have to provide ID , if they arrest you say nothing, the courts will dismiss it and you will sue for false arrest

      They are the problem when they try to make someone a criminal and ask for ID when they have no probable cause ( meaning they do not suspect a crime has been committed ) and try to intimidate! I have had this happen when a cop pulled me over for no reason while driving the speed limit and used into a garage sale! The cop pulled in behind me, turned his overhead lights on and asked for my license and registration and proof of insurance. I gave it to him, he went back to his car and after about twenty minutes he came back and said, You know something like this can mess with your CDL. (comercial drivers license) I said, something like what? He had not told me why he pulled me over. Then he responded by saying, well I was going to give you a warning but now I am going to give you a ticket! And I said, A ticket for what? He still did not tell me why he pulled me over (which is required by law). After about 30 minutes, he came back with a ticket for improper use of a turn signal which carries no points and would never have any effect on a commercial drivers license. I told him I would see him in court. Then he tried to convince me not to take it to court. He is just another king shit cop that wanted someone to grovel and apologise for something they did not do in the first place! I wish I would have video recorded it!
      I will never kiss a cops ass just because he is on a power trip and has a piece of tin on his chest!
      This shit happens all the time and they do not get into any trouble for it! It is abuse of power and they should be fire and never be able to be in any position of power!

      robert anthony You're right, I just had a state cop pull over my EMPTY CMV, for an inspection, Finding nothing wrong, puts me out of service for "unsecured" equipment. Here's where it gets interesting. He wrote, spare tire, dunange and straps, The truck has NEVER had a spare, It's a log grapple truck, NEVER had any dunnage and the straps are nylon. This is the nonsense we have to deal with. And despite that, you still have a host of people who will claim on a stack of bibles that cops are to be trusted.........YEAH, RIGHT

      santoandkim I've needed the cops plenty of times and they have NEVER helped. I don't know the country of origin of this clip, but you are only required by law to show your I.D. if you are being charged with a crime, and yes, traffic violations count. But, until you are charged you are NOT required by law to show your I.D. in America

    When you use the roadways under license, you must show that license on request to LEO for any reason and at any time. It is the law. Learn it, live it, love it; lest it burn you. You are not obligated to answer any of the LEO questions, including "are you recording?". Also, it is lawful in every state to record anyone in public without consent.

      Right when its completely legal to videotape police or anyone and anything in public view. And can not be considered wiretapping because there is no expectation if privacy in public. These ass hats should have lost their jobs a long time ago.

      He did not hire a lawyer, he fought his disorderly conduct with an onsite arrest and the judge agreed the only reason he was arrested was for not showing identification and therefore said he was not guilty.

    I don't know about other states but I am from West Virginia and you have to be able to prove who you are. A police officer can ask you for proof of ID for no reason and if you don't have ID or won't give them the ID then they can legally arrest you until they or you can prove who you are.

    You must produce your ID if you are operating a motor vehicle. If you're walking down the street and a cop stops you then you do not have to show ID. You can give your name and DOB unless you are suspected to have committed a crime.

    I can't believe he just took your camera at the end of it or at the end of your video wanting to know if there was audio on there I would have to say he was a little nervous I sure hope you guys are fighting that especially if that one guy was only walking and they never saw him on a motorized vehicle still none the less it's basically just an abuse and a power trip of the law they don't like to be told no I have to stop watching those RUclips videos like this it's just terrible to see these cops act like this people that are supposed to be working for the American public power-hungry people with guns

      Paul Rollins of course you are not going to help if you're wanted. Just show id an ride. You would not feel that way if you went home an found your family beat and hogtied. You would want them to do everything possible. That includes checking a ids in the area.

      but in this case... i don't see anything wrong from the cops. but i dont see anything wrong from the 2 guys either. we watch this and don't have a clue on what happened. so this post should be taken down. it's stupid.

      +Chris Martin The police violated the law by arresting the biker who walked up and waited for his brother to get the cotation. A citizen has no requirement to show ID simply because a col asks. They had not violated any traffkc laws, he simply walked up to the scene, and he was not under suspicion of having committed any crime, yet the officers demanded ID cuffed him and arrested the guy.

    Um, if you're just walking around in a public place (and not suspected of a crime) then you don't have to identify yourself. However if you're driving a motorised vehicle (including a motorcycle) by law you must identify yourself. In fact isn't it illegal to be driving/riding without carrying a driver's license?

      +Torgo from ACLU: Police may legally stop and detain you only if they reasonably suspect that you have committed, are committing or are about to commit a crime.
      This was not the case with my brother as he walked up to my friend and I (who had committed the crime). His bike was down the road past the tree line and out of vision. He could have been a neighbor checking to see what was going on...obviously they knew he wasn't because of the riding gear.

      IMO next time you should record like you did but debate it with a judge, not the officer. Just let them know you're complying under duress (a.k.a because they're threatening to arrest if you don't comply).

      You're correct it needs to stop. If police would uphold the Constitution and do the right thing consistently then citizens wouldn't feel the need to push back because they're scared that if they don't their rights will be violated. It's all circular. Citizens see their rights being both violated by police and eroded by our Supreme Court. They end up fighting the police and so on. Everyone becomes frustrated. It still needs to start with the people with the badge and a sworn oath.

    if you actually knew "your rights" and how to articulate them..... then NO one would've been arrested and no one would loose any footage. this is why it is so imperative that everyone learns and knows their rights under the laws of the constitution.
    Go educate yourselves on Common Law...... And the next time you get pulled over you'll know how to handle the situation.
    Technically.... you DON'T even need plates (tags) or ID to travel on the open roads of the USA. The ONLY people required to obtain/hold/carry those documents & tags are people who are traveling in commerce. meaning..... those that are in exchange of goods & service for monetary purposes, such as delivering, hauling, transporting, OR taxi'ing.
    If you are just freely "traveling" within a vehicle then you are at no means needed to register your vehicle or get plates for it and you don't even need a drivers license. all this is designed to suck the revenue out of every citizen and 99% of citizens are clueless to the real laws we are protected under.
