  • Supplement (6:09PM EST) - never in my life have I ever seen anything happen like what happened this afternoon in NM v. Alec Baldwin....NEVER!!!! That said, need to push start time to 8:30 PM EST to get fully caught up...
    The 4th of July may have come and gone, but the fireworks persist!!!
    There's a less-than-0% chance that the case against Alec Baldwin will be dismissed by the time this live stream starts, so I guess we've got some stuff to talk about...Welcome to Friday Night Frenzy!

    🚨 On the docket 📢 -
    ➜ NM v. Alec Baldwin - fireworks went off today (Friday) after the Defense raised a Motion for Mistrial based on discovery violation that was discovered after trial commenced. The Judge sent the jury home and used the remainder of the day to try to resolve the motion - let's see where things stand (if at all) when the dust settles....
    ➜ YSL/Young Thug Trial - Judge Ural Glanville has now finally transferred the motions calling for his recusal to a different Judge, and the State of Georgia has filed a formal response. The fireworks keep going off in this case and there's been a renewed motion for mistrial that warrants a glance!
    There might be an additional docket item or two, but with the developments in these cases...there's a whole lot already up for discussion!

      Totally agree. I feel the same as you, I don't particularly like AB but the law is the law and you can't have the State hide evidence.

      Based on Kari, Baldwin does not deserve to be in prison. I'd say Halls had less culpability than Hannah but *way* more than Baldwin, and the State didn't chase him down with pitchforks and press releases. While I still believe Baldwin was responsible for the death, he'll be paying for it the rest of his life with the huge blow to his career/income/reputation, which arguably is somehow more important to some celebrities than their freedom is

      The fact that Morrisey seemingly doesn't understand that whether they matched or not is not the issue is mind boggling to me. It was the fact she hid them not that they didn't match. Her testifying was a great example of her not being able to read the room.

    The moment Poppell starts with not recalling stuff, when she declares "I don't interview witnesses" (but this one she did, so she should remember), then basically "I was following orders" + Hancock saying "I wasn't there" + the cop saying he alerted her + Morrisey saying she didn't know... you know it's the moment they all know they f'd up.

      @@riannarodriguez9759 I don’t trust Poppell at all after this mess as I see a very dishonest, judgmental, and emotionally driven nightmare who should never be in a position like this in which she has extreme power over the liberty of citizens. I found Seth to be extremely unlikable and sus AF during the HGR trial, and I thought Hancock was ridiculous - but now I find Hancock (who had at least TEN *interviews* w/Seth the Meth King) and her sidekick Poppell to be very sinister. Wonder what other evidence they decided to file under “new” file numbers?! Yikes.

      It’s not. Had they released the information instead of hide it, defense would have tried to use it as a red herring but that is it. AB would have had to have a hearing.

    In the Guttierez trial, this judge barely piped up.
    The fact that this judge took the lead in questioning witnesses was spelling Doom on the prosecution case.

    Watched with Runkle all day 😁 then went to EDB to watch her reaction and uhhh the Prosecutor Erlinda resigned during a sidebar that I totally missed 😳
    The sidebar right after the Prosecutor finishes with the Seth guy and Spiro is starting and the Prosecutor asks for a sidebar- when finished Erlinda walks back to their table; picks up her stuff and walks out 😳 edit- just got to 2:01:00 where you find the resignation ❤️

    I don't think the judge had much choice in terms of constitutional rights, but there was no justice here for the victim and family. That's on the law enforcement/prosecution.
    I didn't realise they had called in the MA police to do this🙄

      Gosh can you imagine if Karen Reed's defense attorneys had filed a motion to exclude evidence collected in red Solo cups due to that being improper evidence collection and it actually being agreed upon by a legitimate judge or if the case would have been dismissed after all the shenanigans with the inverted video the Proctor should have recused himself in his text messages and everything how it would have been handled in New Mexico versus massachusetts? It would have been handled so differently in new mexico. Because the laws in New Mexico are basically it would have no bearing on whether it pertained to Karen reads guilt or innocence but her rights and Prejudice and this evidence and the way it was investigated Prejudice her and so all of this would have been thrown out in New Mexico in her case would have been dismissed by judge Sommers I believe

    Is there any chance, in the slightest… Morisseys true intentions behind taking the stand have *EVERYTHING TO DO WITH ENSURING THE HGR VERDICT STANDS?*
    Meaning, so it can’t be overturned no matter how her attorney writes her appeals or how *MANY* he writes…
    I ask this because of the banter back and forth between Morrissey and Spiro, when she is on the stand… At a certain point, she is adamant in making known *”THIS IS THE STRONGEST EVIDENCE AGAINST HGR,”* and Spiro returns comment, *”ya… you keep saying that…”*
    Does she keep wanting *THAT* on the record, regardless of the outcome of this case, to ensure the conviction of HGR *CANNOT* be overturned?

      I definitely agree it was known by defense but if they were setting it up the prosecution easily thwarts their plan by turning the evidence over.

      Defense kept getting turned down when they submitted motions for evidence from prosecution. That went on for several months. I think they knew of conversations that the rounds or something else were being submitted but didn't understand why they then would not have this evidence disclosed to them. They still had a right to or have their own experts examine them. Kari made them irrelevant by herself which isn't up to her, then according to another witness, she and another made the evidence taker put them under another case number. I agree this is awful for the victim's family as I'm sure they were hopeful for a decision about Baldwin rather than never having this retried again because of the prosecutor's misconduct or incompetency or cover-up.

      @kiwifruteon1510 I believe the prosecutor when she said she thought it would be filed under the same case number, and that she didn't understand what Poppel meant when she offered to enter it as a dock file (I don't know the exact term). It feels like Poppel offered to do it like that because she'd done it before with other prosecutors who understood that she meant 'hide this evidence', but the special prosecutor, as a defence attorney, didn't twig what she meant. Then, when she found out during the hearing, she wanted to burn her down for corruption

      ​@atypicaloddity that's a great point! You have to consider that Morrissey is usually a "good guy" and not needing to play games or hide evidence, she might have realized quick and wanted out.

      @@atypicaloddity I think that scenario is a fair and reasonable one. Unfortunately, it still left Morrisey knowing the evidence had arrived and it was alleged by another witness that she was part of the conversation to tag it to a different case file number and, she is ultimately responsible for not disclosing it to defense. Morrisey may have been stupid to take the stand but her stance told through her testimony is on record and whether that's helpful to her in whatever comes of it, may whichever of the universe's god she believes in bless her well.

    It became clear to me the more the motion hearing went on, that disclosure seemed to be very low on Morrissey’s list of priorities. Several things weren’t sent to the Defence when they should have been, but eventually were. When the body cam evidence was discovered, disclosing to the Defence should have been one of the first things Morrissey did (given they were in a motion to dismiss for non-disclosure!). Instead she watches it, watches with her witness and then examines a witness about it, and STILL hasn’t disclosed its existence to the Defence! That’s just evidence for the judge that she doesn’t care about disclosure. Even on the ropes for non-disclosure, when new evidence comes to light, she doesn’t disclose it!! Defence pre-trial motions raised being unhappy with Morrissey’s responses to Grand Jury witnesses and Judge gave her the benefit of the doubt. It just all began to look like a pattern of behaviour from Morrissey.

    Dismissing the charges was the right call in this circumstance, but it just feels like justice was not done for Halayna. Properly handling this evidence wouldn't impact this case either way, it just might create a delay if the defense requested to have it tested. In the end, Baldwin was reckless and cocky and caused the death of a young woman. Law enforcement screwed up and Morrisey wasn't dilligent enough to catch it.

      In the end, no live rounds should’ve been on the set, much less in the gun. Baldwin didn’t put the live round into the weapon and was told by the armorer that the weapon was cold.

    I watched this to the bitter end with EDB from the UK (it ended very late!) and, to me, Kari Morrisey was like somebody already standing in a hole and not realising that the time to stop digging passed some time ago... and proceeded to dig herself a sinkhole!

      Yep! She had zero ability to be able to read the room in that moment. The judge telling her she didn't have to take the stand was the judge tactfully telling her there is nothing you can do to save yourself or this case. She then made it worse by speaking to the media afterwards. Her statements to the media made it Crystal clear that she did not understand what just happened. It wasn't whether the evidence was relevant or matched it was that she decided it didn't matter in the case and then hid it, the defense had the right under the law to know about and have access to that evidence and she hid it from them.

    What startles and scares me the most is the many people who can't see this as a proper ruling. They are potential jurors and I certainly would not want them on any jury. I have seen a new situation where lawyers dig into people's social media when they are potential jurors and find these kinds of comments on cases to keep them off a trial.

      @elizabethpatience6523 I can understand a dismissal, but I don't think it is material enough to the facts of the case to actually matter. So it's a frustrating decision, because at the end of the day he pointed a gun at someone and pulled the trigger. That's all that matters to me.

    At the end I really think she took the stand to save her reputation. She was offended at the thought that she did any of that knowingly or with intent and wanted to put her position on the record.

      She contradicted her own lies on the record. She was offended by the truth. Like most people, she was most upset she got caught.
      She not only knew about the bullets back when they were handed in. She ordered them hidden under a different case file.
      Which completely contradicts her statements just earlier that day. About being surprised about this evidence and not knowing anything about it until the defense brought it up.

    My faith and trust in law enforcement and some attorneys, more so law enforcement has been broken between this case and the KR case. I know things like what has gone on in both of these cases happens a lot but it has really been brought to light. It makes my heart heavy because my 24 y/o son was just hired on with our local county sheriffs office. It’s sad that the industry he has dreamed of being a part of is so tarnished.

    Remember that part of The Last Samurai where they are talking about dying by your own sword or by your enemy's and the guy chooses the enemy's? That's kind of what Morrisey taking the stand reminds me of. She asked for it, so they had to give it to her.

    In a world where the Teske ammo was properly disclosed, what could the defense do with it? Would it have mattered to a jury or would they have been more concerned with the actual events surrounding the shooting? It seems like they went a long way to hide something that wasn’t that damaging.

    On the voting question - yes, absolutely. If the prosecution was hiding the ball on something they DIDN'T think was good evidence for the defence - how many other things they were hiding the ball on?
    Don't blame baldwin, blame prosecution. I think he was absolutely reckless with his gun - but this is not how justice should work!

    I think i finally understand what KM meant when she was talking about the reason why Erlinda resigned. When she said "I believe she didn't agree to have a public hearing", I thought this meant that Erlinda didnt want to have the discussion in open court. But in reality I think Erlinda didnt want to have a hearing at all bec she thought the case should be dismissed. But ofc KM had to be sly about the answer instead of just being upfront about it.

      She is normally a defense lawyer. She was only a special prosecutor for this and the HGR case, so that's the only other case tied to her in that capacity. The police however, maybe.

    I really appreciate how you still show respect to Morrissey and recognize that she had her qualities and flaws. I really don't think she lied either and I appreciate that she insisted on testifying too. She did screw up but not intentionnally imo
    Also : the Judge was awesome ! If only she was the Judge of the YSL trial... the contrast couldn't be stronger !

    Wow you don't see this often. It started bad and the longer it went on the worse it got with jaw dropping admission from the detective. The judge was pissed and you could practically see steam coming out of her ears. This happens but rarely do people see it in such unbelievable way.

    I watched on replay! I wanted to say that my crim law final in law school was a mock trial and I was made the lead prosecutor and we hadn't even had evidence yet 😱. I did to the defense what Kari did and watched his brain break from frustration (the guy I was against kept forgetting he was on direct was leading like mad bc we were all newbs 😂). I was warned by the teacher acting as Judge that it was a risky move bc it could irritate the judge and/or jury so I asked the judge to direct the defense to ask questions properly 😂 and then pivoted a bit. I won't lie, it was really fun & I def thought, "ooh I am not sure I could deal with that." And he did try to do it backb but I was expecting turnabout lol. It was hard to deal w/but I had the benefit of a heads up. The funniest part is that I never wanted to be a trial lawyer. I earned a concentration in IP & intended to go back to get a science degree so I could sit for the patent bar. My goal was 100% transactional law; I interned with in-house council for an art museum. But, life happened and I do not work. Bur, I still love the law & it was super interesting watching all of the different lawyering styles.

    Rob, I 100% disagree with your assessment that there is no remedy on Karen Reed. If you go back and listen to the judges instructions to the jury, she told them not to fill out any forms unless they were able to reach a verdict on all charges so that is what they did and they thought that they had to decide on everything before they could fill out the forms so that is why they did not check not guilty on one and three otherwise they would have per two jurors now who submitted affidavits. There are also Rumblings online that there are other jurors who plan to submit affidavits as well between now and the 22nd when they have court again as more jurors are upset. They expected that they would have been asked were they hung on all the verdicts or just one or whatever. So they anticipated being asked and being able to explain to the judge know we had reached a verdict on one and three it was the two and the Lesser included that we were hung on. So if they misunderstood the judges instructions and they did reach verdicts on two counts then there has to be a remedy for that because of the judges instructions super seeding the written instructions as her words she said were more important than the written instructions and told them differently I've watched them three times. So her own words told them to do something that was different than what's in writing. So she's going to have to ask them to come in and at least in camera speak with her and find out what's happened if you had told us okay well if you're only hung on one verdict go ahead and fill out the form for the verdicts you have reached and then you'll be done for the day and you'll be your service will end they would have done that because that's what they thought they would have been told before they were dismissed.

      Exactly! The judges own words caused this mess. The problem is I have zero doubt she will rule against the defense, say it doesn't matter and blame the jury. To get a remedy for this it's going to have to be taken out of Aunt Bevs hands. I will never believe she isn't in on the corruption in this case. She has been on Lallys side and helped him every step of the way and isn't going to stop now.

      This is the very same judge after all who after finding out Morrissey not only had Reeds privileged attorney client communications and gave those to Seth Kenny, did absolutely nothing about it. Privileged communications to a "witness" in the case.
      I find this case infuriating. Sure for Alec Baldwin she did the right thing. But in the case just before it couldn't be bothered to do anything about Morrissey's misconduct. Whoo Hoo! Privilege and money again bought justice.
      That's a win for society. 🎉

    I think Morrissey misunderstood what those bullets were, but at the same time, and especially being a defense lawyer, she should have followed up on them and looked at them in person before dismissing them as irrelevant. She trusted the cops and she got burned. The judge made the right call in dismissing the case, and Morrissey is going to have to work hard to win back public trust.

      Even trusting the cops, she should've made sure the defense had that evidence once they asked for it, given that it is at least arguably relevant. I agree with your assessment otherwise, though - to me, this reads like a small screw-up (not being diligent with discovery, if for an understandable reason) that should have had serious consequences (possibly still up to dismissal, but that's less obvious than this was) by nature of what the screw-up was (discovery violation), which blew up in her face because it turns out she made this error in the one place where the police were outright lying to her and Alec's team.

    I think Morrissey made an assumption and didn’t do her due diligence. She should have looked at the ammunition Troy brought to the police station and she didn’t. She just assumed it was the same. She made a mistake and trusted people it turned out that she shouldn’t have trusted. I do, however, think she was not entirely honest about her feelings about Baldwin.

    Yay i didn't know Runkle knows kendo. I was semi-professional for almost 10 years and lemme tell you if you're a newbie it's not the big guys you should worry about, it's the small ladies and the elderly. They are super fast and do not hold back. And as for Baldwin: what a wild ride! I am disappointed that the entertainment is over but it was the right decision. The prosecution effed around and found out.

However you feel about him he is now a former actor and will be facing civil court cases ad nauseum. He is a good man, a husband and father and was a talented actor. I’m glad our judicial process MUST be fair. We are rapidly losing our great actors.

    I get that some people might not like Morrisey. But I actually have mad respect for her. And she clerly is able to turn it off and on. Who else has that ability? There is plenty of obnoxious lawyers, but they usually do not control it. She clearly has it under control and uses it as a tool. And she is so smart on her feet, and has nerves of steel. She is amazing. And I think I would like her personally. I actually liked her in court, as an entertainment. And then we have Hancock... she is opposite of Morrisey, seems so nice that everyone tells her everything, but she actually seems so clueless. I think she realised what actually happened after she got home and watched some tv.

    Heres the thing: with this case being as big as it was and morrisey forcing the testimony, she did a huge solid as a defense attorney to those who may have been wrongfully sentenced. Id be curious to see appeal rates following this case of those who were sentenced where either poppel or hancock had testified or been involved in the investigation as their credibility is gone now. Its huge grounds for appeals.
