Today we’re discussing Amazon Trademarks, Brand registration, and Error 5665, and what you should do to get out of the Generic brand issues in Amazon selling. These are things you need to know before you start your business on Amazon!
I’m going to walk you through each of these situations so you can plan ahead before you even begin selling on Amazon and understand the pros and cons of each set up option. I’ll share the history of these changes on Amazon, and how to understand what’s going on moving forward.

Hey Camron, thanks for the great info. I just recently was denied my Trademark with the USPTO, my attorney that I used through the IP Accelerator program appealed the decision and unfortunately we were again denied. Just curious to know what you would do if you were in my situation. I'm currently only selling one product under the brand on Amazon and just starting on Shopify. I had intended to add additional products until i was denied now Im not too sure what to do next. I have a lot invested in the brand, particularly to acquire reviews and customer base. I'm leaning towards scrapping the brand and starting a new one. Thank you

However, just to be clear, once we receive the necessary information from you to prepare the application, we can generally get a trademark application on file within 24 to 48 hours. Under the structure that Amazon has put in place, you should be able to begin the Brand Registry enrollment process on Amazon within fourteen business days after we have obtained a serial number for your pending intent-to-use or use-based application at the USPTO and have entered it into the Amazon system. Typically, the serial number is sent out from the USPTO very quickly after the application is filed.
Hello , the lawyer in ip accelerator said that i can start brand registry only after 14 days after i got pending number so then additional wait 2-3-4 weeks brand registration approval from amazon ???

I currently have a trademark and I tried applying for Brand Registry but I was denied because they said they will accept a “Supplement Register” only a “Principle Registry.” A trademark is a trademark….. I don’t know why Amazon is so difficult. What do you recommend? Thanks
Hi James , so with the BRAND APPROVAL by Amazon with DO NOT need to take action with
USPTO to register our Brand ? And Trade Mark registration is almost Synonymous with Brand
Registry ?!

If I am purchasing from Alibaba and it is not a product I specifically enhanced by working with the manufacturer, meaning anyone can just buy the same product from them, do you think it is still worth to trademark the item? Essentially that is the supplier's product and I am just putting my logo there - can I still trademark the item?

I had the problem 5665, so I sent to Amazon y products photo with my logo and also boxes designed in 99 design. But they answer me with this message: `` Branding or lack of branding on the product and / or packaging does not sufficiently distinguish your product(s) from other, similar products that do not belong to this brand.``Do you believe after my pending number arrive make all your steps and try to enroll again they will acept? and how long takes? my products are ready to ship. Camron thanks for the video! My brand is in pending status now, and there are hijackers popping up.. What are the options to remove them? Or I am powerless and need to wait for the brand to become registered?
To remove hijackers from your listing, here are some options you can try:
1. Send a cease and desist letter to the hijacker via amazon system.
2. Purchase from the hijacker and take pictures of it alongside your product, note all differences between the two, and report the hijacker to amazon report infringement form.
3. Always display your logo and trademark on your product and packaging and even in listing images so that customers can also identify the authentic product on their own.
So I just started a brand for selling automotive parts and it sounds like for Amazon I will need to actually pay for custom packaging with my brand name printed? I only have my branded product labels that are affixed to generic generic boxes but it sounds like I will not get approved using a product sticker on the box or the part? So my only option now is to pay to have a custom box designed with my brand logo to put the part in?

No lawyer needed. I used the USPTO workers who are at home earning an hourly wage. I spent half a day twice with them. The first woman said she can do what the lawyers do. Mine took 6 months. It was harder getting my old store reactivated.

Hi Cameron, I really appreciate your videos they are very informative , I got my trademark and ordered product, product is on the way to Amazon warehouse/ listing is completed my last step was brand registry... I submitted the info on brand registry and got a rejection 72 hrs later stating " your Mark name contains words symbols or letters that are unaccepted if the trademark status is pending the Mark cannot contain a registered trademark symbol" I believe that since the photo I uploaded has a " E" and my trademark is just pending that this is the issue?... should I have the label recreated to just Say Epic Edge Toys? remove the E and cutting edge verbiage ? this would then require me to ask my supplier to create a new box with a new label correct? I'm really stuck here for time, any help appreciated from anyone !

No …. Brand approval will show your brand name only instead of showing generic.

Hi ... This is the part I am struggling with .. The branding and if I need a trademark... so I am just starting out and I have decided not to get a trademark at this point. I am thinking out loud here, so I will need my supplier to send me a finished product with my logo permanently fixed to the packaging and then I can send the pictures of me holding it ( all sides ) to amazon and then try to get Brand approval that way and stating error code 5665.... is that correct? Once I get brand approval then I can finish my listing and then order the products from my supplier. This has been holding me up for a few weeks and I'm getting nowhere. I hope someone can help me ...

I have one brand registered with Amazon but I want to launch another product under another brand .but it's been rejected.can I launch my new product with the old brand but the class under which the product that I want to launch has not been approved with the IPO(UK).Can I register my class later on if the new product is a success on amazon with the old brand.will it be a smooth launch without any trouble .

I've a question regarding brand approval. I've completed my brand approval after which I've made a listing and now i want to enroll in brand registry but my inventory haven't arrived yet neither have I created a shipment plan yet... So is it better for me to enroll in a brand registry now or should i wait my inventory to arrive at Amazon warehouse?
P.S: I've applied for trademark previously and and I also have pending trademark application number.
Where did you register your trademark application? Brand registry is also accepting brands that has trademark pending base on country or if filed thru Amazon IP accelerator. If yes- proceed with brand registry while waiting for the items which usually takes less than 2 weeks.
If it take long for the trademark approval which you dont want also your items to stuck that long- you can use the brand approval in creating ur listing. You need to create an intial listing for the shipping plan.

Listing is already created but i haven't placed order for the stock yet since the sample is on the way to me and I need to vet it before placing mass production order.

1. Would brand approval alone allow for A+ content?
2. If I want the A+ content and need the brand registry and trademark, is it easy to file for a trademark for a non US citizen, living outside the US? I am planning to sell in the US marketplace. Can I file a trademark for where I live (Canada), and use it for Amazon? I understand from a legal standpoint my trademark would be protected in Canada only, but wondering more just from the Amazon side to get the brand registry approved, and be allowed to have the A+ content.

1. Brand approval - only text can be use in making descriptions. Need to ba brand registered to make A+ content.
2. I think there is an option for you to merge the account. Check out your eligibility on you ASC for merging 2 marketplace..

@@ommba07 yes it is possible even if Non US citizen. File directly to USPTO. Just prepare the neccessary documents. For you to make it easier and faster, reach out experts also. Better to book a call with Camron too. I think he is offering such service. 😊

@@ommba07 no. Trademarks can be applied from anywhere in the listed countries, Canada included (only handful of countries are in the list).

Buy a sample and have them put your logo on it. They can send you pictures to use as soon as they’re done. I know some people get pictures photoshopped.

I'm having issue with amazon getting brand approval. My product have logo engraved and I have sent pictures to Amazon and they declined it even if I send another pictures. I checked USPTO and also amazon site and there are no one with this logo or name. They not explaining reason for declining and forwarding me to Amazon Brand Policy link. What is a BRAND, exactly? Let's say I have a logo and a name, is that the BRAND? Like Nike is the brand name but they can sell whatever with that name... shoes, shirts, pants, socks, jackets... whatever.... so, do I just need a logo with my company name on it, does that now become the "brand" for whatever I wish to sell with that name and logo on it? Totally confused. If I am going to sell 50 products on Amazon, from sponges to hammers... and each one of those has it's own product name, but ALL sold under MY company name and logo... do I need to get a trademark for each of those 50 items, or just once for my company name and logo?
