On the trademarks.ipo.gov.uk website, when applying for a trademark a notice comes up on the screen that says the following: "At least one of the trade mark owners, or their representative, must have a postal address within the European Economic Area (EEA)." My question is the following: is the UK still in the European Economic Area? The www.gov.uk/eu-eea webpage does not mention the UK on the list. I live in the UK and have a UK postal address and want to put my name and UK address as the trademark owner. Can I still go ahead and file the trademark?
@@iidjkg Hey, the IPO is for trademarks registered in the UK so you'll have nothing to worry about. I would be more concerned if you were registering a trademark in the EU and that statement appeared on their website.
@@haideryousaf1016 yes you can, it doesn’t change anything. It also depends if you filed it with a colour claim or not which that is a limitation because you are then claiming ‘Brand Colours’.

And I always say the same thing to all of my friends but never take it on myself :) I think at this stage it would be helpful to see a review of business bank accounts with some options for a small ltd that needs to have access to different currency payments. Also tips on finding the right accountant. It seems that this is the most difficult part of it all. I am looking for someone reliable, that could advise and answer the beginner's questions. The majority of the accountants that I found are either online companies with bad reviews, or accountants that offer only phone/email contact. This is absolutely fine later on, but I would prefer to have the initial meeting in person to go over everything. Do you have any recommendations?

Thank you Mario, another great video I was planning on registering a trade mark in a particular class. The same trade mark word is already registered by a third party as a figurative trade mark in Class 28 (Games and playthings; gymnastic and sporting articles - the relevant term in class 28 would appear to be "Inflatable toys in the form of boats"). The third party seems to have registered this TM in relation to cheap inflatable dinghies they sell, but this appears to be only be a minor product for them, I doubt they sell many tbh. I want to register the same word as a trade mark in Class 12 (apparatus for locomotion by land, air or water - the relevant terms would appear to be 'kayaks' and 'inflatable boats'). I have no doubt that Class 12 is the relevant class for my proposed product, which will be a high quality inflatable kayak. Based upon your video, I guess the owner of the TM re the inflatable dinghy could challenge my registration application on the basis of potential confusion with their existing product? I wanted to register a Word mark if possible. The problem is that if the third party objects to my trade mark application then it could cause a big delay in the manufacture of my kayaks since I cannot risk spending thousands on a product bearing a logo which could potentially be a breach of an existing TM. Do you think there could be a risk of challenge? I guess I could apply to register a figurative TM for the logo and use a different design for the words to reduce the risk? Thanks Gareth

Hi Hazzaldo, my pleasure! Regarding the worldwide trademark, I don't believe you can use a single system for that. Each territory has their own system which you'll need to use and they all have different rules, for example the US system requires that you use a point of contact in the US and therefore you need to use a trademark registry service which can be easily found online. To register a trademark in China you'll also need to use an agency as I'm guessing you can't read mandarin? Hope that's clear! If not then please feel free to write back ☺️

Well, I just spoke to an IP solicitor yesterday and he told me that they use the Madrid WIPO system for a worldwide trademark application, which streamlines that entire process. It's quite a reputable law firm, so I assume the system is reliable! I'm reading the instructions on their website and will look to file a worldwide trademark soon. Maybe it's something you can look into and see if you wish to make a tutorial on it. P.s. applying for a trademark in China is like trying to beat Usain Bolt at a sprint race. Pretty much pointless XD I'm not even thinking about trading in China. In any case, thank you for your help and feedback.
@@hazzaldo Hey, I'd save your money and either do it yourself with WIPO or pay £40 and have IPO do it and check it over who then sends it to WIPO. No need to pay hefty lawyer fees.
Great tutorial Mario, thank you! I'm in the process of applying for a Trade Mark and I've just received an initial response informing me that there were two companies which had similar names, and one had an identical class number, although my application has not being rejected. So to play it safe and reduce the chances of opposition, I'm replacing one of my class numbers so that the only similarity is in the word, however they really don't look that similar because my font style is totally different and all lower case and the name is split up by a hyphen, on top of this I went for a logo included, so pictures and letters choice. Fingers Crossed!!

Hi Sina, To give you an accurate answer can you clarify what you mean by its 'part of' another persons trademark? Do you mean someone else has already trademarked the word you want to trademark, or do you mean the word you want to trademark is included in someones trademark? For example you want to trademark the word 'jet' and someone has trademarked 'inkjet'? Also, is their trademark in the same class as the one you want to trademark?
The Holistic Hustle yes sort of, for example somebody has trademarked “Game of Thrones” and I want to trademark “Thrones”, and yes in the same class also.

Now the amazing thing is if you could do a tutorial on how to register world wide trademark using the Madrid WIPO system. :D
Hi Hazzaldo, my pleasure! Regarding the worldwide trademark, I don't believe you can use a single system for that. Each territory has their own system which you'll need to use and they all have different rules, for example the US system requires that you use a point of contact in the US and therefore you need to use a trademark registry service which can be easily found online. To register a trademark in China you'll also need to use an agency as I'm guessing you can't read mandarin? Hope that's clear! If not then please feel free to write back ☺️

Well, I just spoke to an IP solicitor yesterday and he told me that they use the Madrid WIPO system for a worldwide trademark application, which streamlines that entire process. It's quite a reputable law firm, so I assume the system is reliable! I'm reading the instructions on their website and will look to file a worldwide trademark soon. Maybe it's something you can look into and see if you wish to make a tutorial on it. P.s. applying for a trademark in China is like trying to beat Usain Bolt at a sprint race. Pretty much pointless XD I'm not even thinking about trading in China. In any case, thank you for your help and feedback.
@@hazzaldo Hey, I'd save your money and either do it yourself with WIPO or pay £40 and have IPO do it and check it over who then sends it to WIPO. No need to pay hefty lawyer fees.

Great tutorial Mario, thank you! I'm in the process of applying for a Trade Mark and I've just received an initial response informing me that there were two companies which had similar names, and one had an identical class number, although my application has not being rejected. So to play it safe and reduce the chances of opposition, I'm replacing one of my class numbers so that the only similarity is in the word, however they really don't look that similar because my font style is totally different and all lower case and the name is split up by a hyphen, on top of this I went for a logo included, so pictures and letters choice. Fingers Crossed!!

The Holistic Hustle I wanted to ask a question. What if the brand name ( its just one word) that I want to trademark is part of another persons trademark, does that increase the chances of it being rejected?

To give you an accurate answer can you clarify what you mean by its 'part of' another persons trademark? Do you mean someone else has already trademarked the word you want to trademark, or do you mean the word you want to trademark is included in someones trademark? For example you want to trademark the word 'jet' and someone has trademarked 'inkjet'?
Also, is their trademark in the same class as the one you want to trademark?
The Holistic Hustle yes sort of, for example somebody has trademarked “Game of Thrones” and I want to trademark “Thrones”, and yes in the same class also.
