  • Roofer's News: Owner of Target Roofing in Jail for misuse of $2MM PPP loan
A federal jury convicted Casey David Crowther, 35, of Fort Myers, in a PPP loan fraud case where authorities alleged the roofing company executive bought a $700,000 boat, among other expenditures, with the ill-gotten gains.
The president of Fort Myers-based Target Roofing & Sheet Metal, Crowther was convicted of bank fraud, making a false statement to a lending institution and two counts of money laundering. Prior to that trial and March 26 conviction, Crowther plead guilty to one count of bank fraud and one count of making a false statement to a financial institution related to a mortgage fraud scheme. In that case, according to a statement from the U.S. Attorney’s office, Crowther created false bank statements to justify a loan he had used to purchase a nearly $1.3 million waterfront house in St. James City, on Pine Island in Lee County.
In the PPP loan case, Crowther, according to evidence presented at trial, obtained a $2.1 million Paycheck Protection Program loan by falsely stating he intended to use the money to make payroll and pay for rent and utilities for Target Roofing and Sheet Metal. Yet Crowther, authorities contended at trial, “intended to use the money to enrich himself and, once the loan was obtained, quickly used the proceeds to make a series of personal purchases including a nearly $700,000 boat and a $100,000 payment to a former business partner,” according to the statement.

@Mitch Batten the crime is a diversion of funds . In construction, all funds must be to direct costs ; labor , materials for each separate project . It would be illegal to “ front end” take funds and disperse without first paying all obligations.
Contractors know what this and will be Bankruptcy if caught in violation.

I may not be understanding the situation correctly, but did the guy just spend money on a boat and that's it or did he falsify payroll in order to get a larger loan? From my understanding, the 1st round PPP loans were not a "need based" loan and all you had to do was submit your payroll from 2019 to get an average 8 week rate. Provided you continued to carry a similar amount of payroll going forward then the loan is typically viewed as being used to cover payroll and is eligible for forgiveness.
Did he run the transaction as a business expense? I don't think it's a very smart move for him to buy a 700k boat, but provided he's still paying his employees with the PPP money and then taking an owners draw to buy the boat I'm not sure why it's illegal. I've kept all the PPP funds in my operating account I received and have used it for payroll and to try and grow the business.
Unless there is something in the PPP paperwork saying you cannot take an owner's draw until the loans are forgiven I believe you're going to see a lot of these types of arrests across many different industries.

News people always say that someone may get up to, let's say in this case, 50 to 100 years in prison. Knowing good and well if he does go to prison it won't anything close to that. But the government is irresponsible for the way they handed out the money, just like they are irresponsible on evictions. Not having any idea who truly can't pay rent and those who can.

The type of fraud here is tricky to prove yet prevalent. I’m sure he did use the PPP money to pay his employees but he probably took a year off work himself, did not push projects, and used money generated through normal operations to live beyond his means. No roofing company needed this money, everyone in the trades was slammed.
