I don't understand how you can be caught inside of a house *without the owner's permission* and not end the day in handcuffs... How is this not, at bare minimum, trespassing???
Because a judge has to decide if is a legal tenancy or not. Squatters have more rights than property owners.
What scammers are doing is finding empty homes and pretending to be the owners, having people sign a BS contract then letting the people I'm the house pay them for like a full year. This lady didn't get caught up in that scam. She just pretending too.
This scam became huge after the mortgage bubble of 2008, pandemic just feed the flames, even more. In Miami actual real estate agents got caught selling addresses of empty for sale home to scammers. They were part of the fraud. People go as far as to case empty homes, overgrown grass, ask neighbors, mark for sale signs for length of time vacant, move right in. Property owners have to create their own system to prevent squatting. Starting with the power company, you can talk to them, then send a notarized statement, nobody can start services without written consent. Every time a property is vacant, you call to make sure is flagged. I had to do this for every company, after a tenant made claims with Fema, without living in my property.

A house cannot be left vacant anymore without basic internet and a security system. I bought my mother a house to live in when she became vulnerable, and after she died I listed it. While on market, I kept the internet on and got a basic alarm system and a couple cameras. One of her caregivers and her friends tried this, and was trying to move boxes in while the alarm was blaring! Fortunately, this was nipped in the bud, and the group was sent on their way. Having an alarm system in place keeps squatters from making these false claims.

She couldn't produce any emails. Who did she pay rent to? You should have basic contact info for your landlord. People who lack integrity have no ounce of shame, and that's scary. Even if she was a victim of a scam it does not give you the right to mess up someone's house. They should press charges. People like this should never be able to rent another house. Squatters need to go to jail. New laws need to be put in place.

Same thing happened with my crazy aunts ex bf. Never paid rent or a bill in his life. Was never invited to live there only to stay the night when he drove up north to visit my aunt. Soon as my grandparents passed away and the house was put in my name. he got abusive and rampant in his addiction and refused to leave. Cops wouldnt do anything when i showed them my name on the home and that he never even had permission to stay there long term let alone live there as a tenant. Took me 3 months of serving papers and going back in fourth in court to get him out all on my dime. They wonder why theres a shortage in rentals when the laws never help the landlords providing properties.

In Florida, a lawyer found a law that people didn’t know about, that was amended recently. The police can actually remove squatters out of homes as long as they have an affidavit from the owner. I think that all states need to do this!!

I read a story about a landlord who had some squatters with paperwork saying they rented. So the landlord signed a lease with another one of her family members who moved in on top of the squatters. Squatters called the cops, cops told them to "file a complaint". Squatters moved out a couple of days later.
So, her relative who is a real estate agent told her she could stay. What do you want to bet he’s in on it and looking up listings for her on the MLS? Criminal conspiracy…that’s definitely a crime.
She is lying her daddy is not a realator. If he was why would he allow his daughter to live in a shelter for months instead of finding her a rental property. And how tf did she get $3100 for first and lasts months rent if she was so destitute beforehand. They are all scammers.

@@culcune it's only against the law if it is enforced. When you have no police, bleeding heart politicians and weak willed prosecutors nothing gets enforced. In some states, you go on vacation for a week and come back to someone squatting in your house. THEY own it for the foreseeable future while you spend months going through eviction proceedings.

@@culcune Depending on where it is, they won't be prosecuted for anything. A friend of mine in Seattle called the police when he caught the thief in his house. The police told him they were not coming unless someone was shot and that he needed to get a restraining order against the burglar. I think it was Portland, I could be wrong about the city, that just passed an ordinance giving the homeless more rights to your property than you the owner have. I didn't make the liberal logic, I just have to suffer it.
If you have enough money to have a spare home to rent out to someone else, you need to set aside some money for an alarm system and cameras outside. It's far cheaper than court costs to get squatters out and then repairs when they destroy your house.

You need to have a security alarm and a security company monitor your property. You also may want to put a tenant at will in the property until you sell it. If you can't get a tenant shut off all the utilities.

A friend of mine had this happen . Courts were on squatters side . She waited for them to leave and squatted on the squatters . Cost her a PI to know their schedule and she contacted police when they came "home" . Funny thing is the squatters tried to sue for loss of their property . Owner text them told them it was put on curb and they had 48 hours to get it . They did not and it went to dump .

I'm not for people being homeless by a long shot but basically trying to steal someones home then destroying the property should be considered a felony charge.If it's abandoned being neglected that's one thing but in situations like this the police should be able to put them out of the home after ownership is established.

My suggestion to anyone who owns a vacant house for whatever reason, put security cameras all around the place. That way, you can record them illegally entering the house and now it's a crime (breaking and entering) where the cops can arrest them. Otherwise, it's a civil matter and many times those squatters are printing up fake documents and fake leases with fake receipts. There's nothing a cop ca do in the moment. He doesn't have the ability to determine if those docs are fake on the spot. It has to go through a civil court. They need some type of expedited process to provide the paperwork on the spot and have the courts check it within 2-3 days or something cause it's taking months now to get to the courts and costing homeowners thousands of dollars..

That squatter could have wrote that receipt out herself, what trash to leave this womans property like that, to be honest the way they left it tells me they were lying and squatting, also if she didnt have extra ins that covers when your selling and the house gets damaged they wont pay, hope people know about this.
That was a females handwriting, not a man named "Christopher", who doesn't actually exist. They made that receipt, they made the lease, plain and simple.

Its not the polices fault in this matter. Its the local city governance. This is why local elections are so important. If you vote for Democrats and Republicans who dont protect homeowners, but squatters and the homeless, then this is what you get. This is prevalent in blue and purple states, but it happens in red states because our laws are still hundreds of years old when it comes to property rights.
JSO: Pull you over, pull you out of your car and pummel you like a red headed step child for no reason.
Also JSO: Yeah, we cannot do anything about someone squatting in your house and we cannot do anything about it when they destroy your property even though that makes it a criminal offense.

I don't get the difference between "First Degree Criminal Trespass" ( a Crime) and the Eviction Process (a Civil Matter) of a Squatter?
If you’re selling your Home nowadays ALWAYS have a friend/friend of family living there. Install RING inside and out so there is evidence of them breaking in the Home to claim inhabiting it by a fake lease.

@@teresasmith533 nothing records inside the House. Only camera at front door, basement doors, driveway/garage area and back deck entry. We get alert if there’s anyone or movement at the door. But at no time is there a camera inside the Home. An alert can allow you to get police there immediately and will show them “breaking-in” is what I’m saying. Time is of the essence to get them in the act.
