- Art Theft & Inspiration? What to do if someone steals your work... This week I am shedding some light on a darker issue. It's something I think, as creatives we need to air, we need to talk about. Yes, it happens and yes, it's tricky to talk about. But creatives do get copied. Unfortunately, there are copycats out there ready to steal all your good ideas and plagiarise your work. This is one of the major negatives of putting yourself and your creativity out there on social media, Instagram and RUclips. So, how to deal with it then? I'm sharing what I do and what happened to me when I was copied. It's happened a few times! I also talk about how I deal with bad comments, finding our art style and finding our branding style.

I have been making art for over 60 years. I have worked in this world as an artist and this was my living. Few things I have learned thru the years: Be careful if you claim a style or an idea. Someone has already done it. 1000's of people have already done it. We live a life being inspired and as artists we translate that into something we want to express. I like your channel because you create little lovely things that are in my wheel house. I relate to the colors and style. Over 50 years ago i filled journals with similar faces and flowers, text mixed media etc etc. To make a living as an artist it will involve you being inspired by others and they by you, thats the way it is. Be prolific and keep creating. If someone uses your photo image of a design you have done as a tag then thats a HUGE NO, but even on RUclips i have watched talented scrapbookers, painters, journalists etc using this same form of creative delivery. I had a friend that was upset a few years ago that someone else did an old truck filled with pumpkins and she did it with flowers. I had to remind her a million trucks were done before she did it and head down, do art..keep creating, evolve and make art. You are a lovely sweet lady and I enjoy your channel btw :)
I love your comment. For an artist it's very grounding to hear. Artists can be egocentric and possessive of their ideas and work. Yet we are constantly gaining knowledge, inspiration etc all our lives, and as you say, it's been done before. Art evolves and revolves. 💌

Yes! Everything you said! Nothing is new and not to be insensitive but most mixed media art, esp girls & flowers all look the same! So its very hard to be “original”!
Ive already commented to another comment, but I wanted to add something here - you're right, it's hard to be original in art because even if you think you've invented an idea, there's no way of knowing if someone hasn't thought of it before you. And you'd be safer to assume they have, given the probability....
But I don't think that's what's important. To me, the meaningful difference is between *Originality* and *Authenticity* - make what is true to you, and comes from your heart and soul. It may be similar to other people's art, but its Authentic to you. Real art will have the spirit of authenticity to it.
Styles of art are always shared, there wasn't only ONE cubist artist, nor should there be ONE art journaler. And when more people engage in a genre of art, it develops and grows, it benefits all of us artists....that's how art works.
Directly copying someone's art and selling it/claiming it as your own, is obviously wrong. But you can't copyright a genre of art, hashtags or subject matter.

***After reading your wonderful conversations in the comments I’m just adding this too… That I completely agree - 'nothing new under the sun,’ or nothing is original, in that sense. So, it's not original but is it authentic? If it's not the ‘ideas’ feeding the inspiration to create from our hearts, but, instead, it is truly stolen if it's someone trying to copy directly and claim it as their own. Or, repeatedly copying every little thing another creator does. If that makes sense? Grey areas… Loving this conversation, thanks for comments!*
For a long time, I let the fear of getting negative comments stop me from starting my RUclips channel. I’ve been very surprised at how few negative comments I’ve gotten and I don’t see those on other people’s channels much either. I rarely respond to comments in any social media on any platforms. Sometimes you get trolls, rage baiters. I have social anxiety caused by past experiences with racism, horrible rude customers and chavs. About few weeks ago I was walking my sister's semi wild dog, this chav turned around and stared at us like we were freaks. Incidents like this plus pandemic turns me in shut in. I don't feel like going out because verbal abuse, funny stares.
I once had an Etsy silver jewellery shop and someone copied my shop name and style. I opened another Etsy shop. Again someone copied the name and even opened a physical shop with my shop name. I now create handmade artist teddies and someone has started using my shop name. It's depressing 😞
Copyright law does not cover an idea or a style. It only covers a specific expression of the idea or style. You cannot copyright an idea.
Absolutely Bonnie, I completely agree. It only becomes relevant if someone copies every little thing another artist/creator does for a long period of time and that's when the grey areas become darker... if that makes sense.

@@theunexpectedgypsyIn Australia, once your idea has been made (on paper, canvas or in 3D) then you automatically own the copyright (for free) and anyone who steals it can be sued. So, never TELL anyone your ideas until they are set in stone (so to speak).
One artist had her landscape paintings stolen, the perp took only cropped portions of her paintings and sold them as prints, pillows, mugs - the works. The guts some people have is astounding. Another artist had her painting stolen by some big shot in China and it was reproduces en masse. They made millions off of her work. There is/was a group lawsuit happening with over 20 artist because they do this all the time apparently but the artist could not afford the legal fees. She got nothing, she sold the original once and someone else bought a house with her work. 🤯
It’s a shame that the lawyers didn’t offer her a percentage fee at least. I have heard about Chinese theft of artwork before, but I suppose it could be any country where unscrupulous people would steal from artists.
The saying, "There's nothing new under the sun", feels very relevant here. Outside of blatant plagiarism or copying someone's work, it's hard to claim copyright over ideas or style. Sometimes the same idea comes to various people. One person runs with the idea whilst another takes their time getting there. Just as our fingerprints are unique to us, so will the creative interpretation of that idea. Unless, like you speak of, it's a blatant copying of someone's creative expression. Alphonso Dunn and the Inktober 'creator' had a disagreement about the similarities in books published by both men. Coincidence or plagiarism? Only the 'offending artist' will ever know. Protecting one's work matters but knowing whether or not one person is copying another is not always easy to discover.

That inktober thing was stupid. The page that Jake supposedly plagiarized was nothing new and there is crossover in all this stuff. I thought Alphonso was pretty childish about it.

Even though I won't comment on either party, what I learnt is to tread carefully when claiming 'ownership of art' and to be careful about 'calling people out'. I accepted one version of events until I read about how old some of the techniques were. These things/feuds can get unnecessarily ugly and intense. That said, I still think people should protect their art. Ideas are a different kettle of fish altogether.
@@TT-fn1xb If you've been to art school at all its obvious that those were classical techniques. Of course we need to protect our original artwork. Its difficult online but one artist never posts anything without including her name in the link so its obvious who created it.

RUclips is rife with copying. I’ve started changing my channel from embroidery to art and crafts now. But it’s one of those things, even I’ve done it. We follow suite like a tik tok trend. Obviously you wouldn’t want to copy every single thing someone does but we all take bits from others to help mould ourselves. I can understand copying a painting would be a no no but to take inspiration from it and making your own interpretation is ok. The trouble is that you’ve obviously done something right to achieve what you’ve achieved and I think people will try and take elements to help themselves achieve the same. But a sad story is when someone calls their business something so simple(a word) and they’re told they can’t use it because that particular word is copyrighted! Love your channel by the way 💖

I love your authenticity. I've been on tiktok for about a year now, and have been considering RUclips. Your vlog style has inspired me, and I've been considering doing a vlog style as well, rather than the top-down painting videos I had been considering. The next step is for me to find my own voice and own style of vloging. So much has already been done, we'll never be 100% unique, but there is also a very important line of taking that inspiration and making it your own, vs copying completely. As I dive into the world of sharing content I pull from multiple source of inspiration and find ways to put my own creative spins and add in my own unique ideas as they come to me. When you are just following one artist I think that's where it becomes too easy to cross a line.

Lots of varied thoughts and ideas on this one. Everyone is different and is inspired by so many different images, thoughts and flashes of insight often by viewing a piece of art. We can't really claim an idea is all our own because other things have influenced us and caused that idea to form. Being yourself means whatever you create will have that essence so it will always look different except if you blantantly copy a piece from someones art. That I feel, is the only real issue. Copying exactly someones art and passing it off as yours and profiting from it is not cool. Being inspired by another to create a new piece of art is adding to this great huge pool of light and joy in the world! We can't stop that. We can't stop sharing our work out of fear of people imitating us. Do your thing, live your life and leave beautiful things out there for people to enjoy I say. Great thoughtful video, Wendy. I highly urge every artist to read a book by Elizabeth Gilbert called "Big Magic" about creativity it is very enlightening about creative process and about creatives ideas finding a place to come to fruition ❤️ Great video Wendy as usual 👏👏
THIS. Unfortunately, her explanation is often an unpopular opinion, but one I have fully embraced multiple times in life. There's really no sense holding onto something somebody else can do better. I make what I make when I can/have time, but love when others take it further.

According to an article by the Smithsonian all major artistic representational techniques had been developed 17,000 years ago. There are currently 7.9 Billion humans on the planet. Humanity is too old, there are too many of us, everything has been done before thousands of times and will be repeated thousands of times again, each time with the creator thinking that they were the first. As an artist myself, I do love your work and will continue to enjoy your work. For you to believe that anything you or I or anyone else creates is truly unique, new and fully yours is naive at best and egotistical at worst. Have some humility and be grateful that you are a working artist, making a living doing what you love. That in itself is the truest validation that you are a good artist.
I used to wonder about how to find my own style. I read somewhere that it’s a great idea to keep a list of all the artists and creatives you admire and whose work you follow and then write down what it is you are drawn to about their work, eg I love the whimsy in your work, I love the way you layer and your use of colour. I can incorporate more whimsy into my own work then without it looking like your work. Another favourite artist has a clean clear way of using colour that I deeply admire. Maybe I could combine whimsy with a clean clear focus on colour but in my own way of working? Maybe that would be awful, but by experimenting I will eventually find something that is my own. Anyway, I find that by identifying exactly what it is that I like about a piece of art work I’m drawn to (pardon the pun), it helps me understand what I like, and helps me identify my own style.

I could never be on social media like y'all. Once, I had my work blatantly stolen and had to go to small claims court. It was awful. I only won because of the way I wrapped the jewelry I used to make. I had a certain thumb print in my wire work. People wise, I went through a very heart breaking situation with a supposed friend, in 2020. It broke my heart and soul to the point I was depressed for almost a year over it. It was truly tragic. I am an empath and I tend to share too much (this message for instance LOL), I could never put myself out there for EVERYONE to see and know. You are brave and speak from your heart.

There is a wealth of difference between someone copying your art for the pleasure of personal learning and development - a compliment.... and someone 'stealing' your art and passing it off as their own in order to benefit from your originality and creativity - underhand infringement of copyright.

It's one thing to attempt to imitate or replicate something someone else does as experimentation , for your own experience, but too many people are doing this to fill their you tube content, and use it as "click bait" to attract others. I do see this as I view various channels. I'm glad you are talking about this.

I can speak from my own experience...and that is that as an artist I have always given credit or said "inspired by" if I post something, even if it doesn't even look anything like the other artist's work! I also write it on the back of the piece of art. I think it helps grow a community when you share with others that somebody inspired you... it's just a kind way to acknowledge someone else!😍 It is said that when someone copies you it is the ultimate compliment, however plagiarism is another thing and I think your suggested approach, if it happens to you, is the best advise! The only thing I think about copy writing and have often wondered about is so another person doesn't get me in trouble /accusing me falsely of copying them! Thats why I would do copy writing on my art, other then that they can copy all they want im really free and sharing and I encourage people to copy my handmade rugs and viking ladies in a row garden posts and teach others my really unique and beautiful technique that I invented of hand stitching art with wood and help them with learning what they like and getting their own style by trying out what they like through what I do, im so unique in my art I don't think anybody could do what I do/ im to way off unique, thanks for the discussion on this needed topic, as I don't have a single artist friend to talk to this about who understands this questioning. In the past famous artist that lived at the same time often knew each other and when one of the did a painting that they liked they would all go off and paint a painting inspired by them -they where always doing that and saying good artists copy great artist steal, so you do steal what you like but you you use it in your own style which takes authenticity to find!, love to you on your majestic art journey, your giving good advice here/love to you!

I started watching your channel during lockdown here in the US when stumbling across your page while searching "art studio tour". You were and are a BIG inspiration to me starting my own channel last year. My only desire to copy was in how genuine and true to yourself and your art that you are and I wish to show that of myself in my own videos. I am inspired by you to look deep within myself and show people some of what I find in my search. I'm finding it takes a lot of bravery to do what you do and I want to thank you for sharing that and inspiring me to be brave and do the same. 🥰
Thank you for this video. I appreciate it so much. I have been hesitant to show any of my new artwork across social media, after I saw one of my pieces on someone else's page several years ago. It is soooooo annoying to see something you created from your imagination stolen and claimed by another.
This is why I do my research for ideas but use them in a new way. What helps is to always give the creators of those ideas credit for inspiring you.
I've just been amazed at the tsunami of ideas out in cyberspace. I really only started looking at youtube during lockdown. Everytime I think I'm onto something new and perhaps could make some pin money from it I RUclips the idea and someone else is doing it. So it must be really hard trying to make a living from your art and seeing it possibly being ripped off. However, that being said from what I see in your niche that you and James are projecting an authenticity that rings true for many people. So many people are just so slick on youtube that you both are very refreshing to follow!
You spoke about these sensitive topics in such a kind and gentle way. At the same time, you clearly showed where you draw the line. I think they copy you because they admire you, and they'd like to have some of your success - which is never going to work because you are inimitable and irreplaceable.

I've used it as educational purposes something I've learned from art school. The professors often took us to the art museum, which was connected to the school. Part of the assignment was to copy the masters to learn. Plus as artists we are inspired by others just as we inspire. But copying an exact image to claim as your own then no.
Thanks for sharing Wendy and this is important. no body likes to be copied because it's like having your signature snatched from under your nose most artist would have enough self belief self esteem self worth ideas and inspiration of their own to explore and express while appreciating the works of other artists and not copying I'm sure. like you said its in the minority... Three years ago I was at an exhibition by my favourite artist who I am acquainted with. I had just arrived and had taken my mobile phone out of my handbag to switch it off. Her partner rushed over and knocked it out of my hand, spilling wine over me and into my handbag. He shouted at me accusing me of taking photos to copy her work! Everybody was looking at me and a few made comments to suggest I was taking photos when I shouldn’t be. I felt so embarrassed and sad. The artist came over and apologised sincerely for her partner’s behaviour, she was obviously embarrassed by it. This did give me food for thought about copyright issues though. You raised some very good points Wendy.

Such an appropriate topic for this New Moon in Scorpio... Courageous Truth looks very good on you Wendy! I do aspire to video document my artistic process and you inspire me toward that very much. I have yet to make public any of my art processes... I think a part of my hesitation is that I am aware that my personal creative process is still in discovery. It is quite a treat to be invited into yours and others creative processes via the web... If only to inspire ones own authentic expression. Why else create art than to expression ones unique truth!?

Great subject, as an artist I worry about art theft as I have seen it increasing over the past years. In my college art classes we painted studies of many famous art works with the understanding of the importance of copy write laws. It's good colleges are teaching Copyright Infringement laws - reminds me of Jeff Koons how he's been successfully sued for use of pictures/photographers/postcard and advertisement materials for his art.

I remember one of my tutors explaining this to the class. Thank you for your clarification. I am still finding my style although 3D and mixed media are my first love. I cannot draw,is that negative thought that always comes up because I compare all the time thank you for sharing that. Most of my days are in my daily care of 14 independent elderly as I run the house and listen to what is happening in their daily lives. Taking time for me the last 10 days I have enjoyed your videos, seeing how you take time for you. My go to is my morning pages and Julia Cameron's artist way books my audible go to everyday. I love this discussion! I am very mindful with having a very distinctive visual language, and I use themes that I can't find others using ... so when followers on IG, for example, suddenly start doing the same thing, then I just unfollow them and try to ignore it. I find that if that's not their natural art style, then they tend to move onto something else pretty quickly ...
Thank you for sharing this video. I recently came across someone who does pyrography on wood. Sometimes using art created by a different artist not just using the picture as a reference but tracing/transferring the image on to the wood not free hand. Only filling in the details free hand so to me the work is partly the pyrgraphers and partly the artists. I felt quite wound up discussing this an made at point that the artists name should always be mentioned. You've helped me clarify this as I thought I was being over sensitive. I love all your videos by the way.
The Sunday Stylist (not an artist but another RUclipsr) had a similar problem. She tried the gentle nudging approach but it didn't work. In the end she did a video calling the two RUclipsrs out. They had blatantly copied one of her videos using the same format and the same words. One was literally word for word. Sometimes we have to call people out publicly. It is a shame. Great video Wendy and love your message of being our authentic self. ❤
Well said and great topic to address. One important aspect is that artists who work in their craft everyday are trying to make a living. Selling their work contributes to their ability to make a living. Hard work, dedication, love, to do their own work, everyday.
I'm an avid art you tube channel follower and to be honest, many of the channels pretty much have the same formats and use the same sentences and styles of presentation. I've also noticed quite a lot of creatives using bought stencils as a basis for their paintings too. It's pretty difficult to reinvent the wheel when the market is soo very flooded with similar things. How many ways can one paint a flower? Interesting vlog, thank you.
Yes, Wendy uses stencils, if somebody uses the same stencils, and blending, but not seen Wendy's work? Are they copying? I don't think they are? I'm a little confused about this video. Some of it I agree with, and some of it concerns me.

Yes I agree with you both, I have mixed feelings about this video. She did preface it by saying its a 'grey' area, but actually I think it's more a case of - some things are clearly wrong, and others are not. It's not grey, there are separate categories.
Of course the example of someone using her artwork to make clothes labels, obviously that's wrong and a clear example of stealing artwork. If someone started selling prints of her artwork, that's obviously wrong.
But what about a *style* of artwork/journaling/hashtags.....? I love Wendy's work and have followed her for a long time, but I was a bit surprised by the way she phrased this. It's not like she invented writing phrases next to fairies in a journal, I remember having books exactly like that when I was a kid, years ago... And I had how-to-craft books with that *exact* same typewriter font and directions on how to *stamp words next to collages* (of fairies...)
Also, she said someone copied her flower-power project.....well, I know she didn't invent the phrase Flower Power, or the idea of painting flowers. Sure, she decided to concentrate on painting them at night, which is more unusual but definitely not original.
But it's hard (if not impossible) to be completely original in art, because we are all inspired by what we've seen and experienced. I think as artists we have to accept people might start with the same raw materials and come to a similar conclusion.....
In terms of copying hashtags, I thought the more people that use your hashtag, the better..? Isn't that how it works? If more people use the same hashtag, your art will be seen by more people - and the whole point of hashtags is to link you to posts of the same theme, it's basically an index for themes.
I've watched a video where Wendy copied an Art Deco paining from a book, and that inspired her to try a new style, to get out of a rut, which flowed into her flower power series. This is copying, and developing into your own style. If other people are doing the same with her style of journaling, I don't really see how that's any different. Of course they should credit her if they've directly copied her work, and they shouldn't sell it without permission because that's against copyright - but you can copy what you want for your own personal artwork.
Imagine if Picasso said: 'Right, nobody copy me, I'm the only one allowed to be a Cubist'
And if Dali said: 'Nobody copy me, I'm the only one allowed to do Surrealsim'
And Leonardo Da Vinci....and the first Cave-man to stamp his handprint on the wall of a cave....✋🏼✋🏼🎨🎨
We would have a whole lot less art in the world. Same with music, artists inspire eachother. Direct copying is stealing. Being inspired by a GENRE of art, or using similar materials, or subject matter.....to me, that's just art, we share those things.
@@tigs6639 of course, you are spot on with the clear divide Tigs. Blatant copying without credit is just definitely wrong. Also passing off someone else's work as your own, is just plain wrong too. I often go onto Pinterest to look for inspiration when I am having a block and end up seeing hundreds of similar pieces of work by different artists, but I think to myself that it must be pretty difficult to change what is essentially a vase of flowers into something new (hope that makes sense, hehe). I truly believe, like you, that authenticity is very rarely achieved in a world where almost everything has already been done in some form or fashion.

The timing of this is really good. And I agree with many who have hit it bang on. We learn from one another so styles can be similar, even content. What I think key is intent. Is someone learning to draw? Learning color combinations? Learning the what and the how’s? Or are their intentions altogether nefarious in origin. I have not shared my artwork, yet, because of this very fear. But I think it’s getting time I just swim because I don’t want to sink…
Well said. Image stealing happens far too often. Blanket sellers steal quilt images all the time. Recently it’s been decal companies. Scammers about. Stay the course. As an off side...love your knit wear. Beautiful and cozy!

This happened to me in art school. I was crushed but my art professor reminded me that I should be flattered that someone liked my work enough to copy it. I was young and didn’t quite understand. Now I have to remind myself of that. People definitely should not copy and make money duplicating your work. But there are so many techniques and ideas out there it seems hard to do something totally original. Even the masters copied each other. Being aware of this and talking about is a positive step. Sometimes we just have to keep on creating otherwise paralysis can kick in. I’m the master of overthinking so quietening my mind and being a little blinkered to things such as social media comments etc really helps! I haven’t been brave enough to embark on a RUclips journey yet. Maybe next year 😊🦋✨
Coming from a tangent here; I'm a knitter/designer/maker and I have been asked many times to copy other peoples' work as a commission - as in "OOh! Could you make me one of those?" I can assure you they get very short shrift from me; as a maker, I realise how much work and effort goes into creating a garment/pattern before the wool actually meets the needles - I'm never going to knowingly bypass all that by copying someone else's work. It's one of my (many) soapbox subjects. I've had my writing and other things plagiarised on the net, and people passing off my work as theirs. I'm all for sharing, but at the very least an acknowledgement would be good.
I think for most people the line between inspiration and outright copying is very fine viewed from the outside. For me as a maker, viewing from the inside, it's a lot clearer.
Yes, this!!! I'm a jewellery maker and silversmith and I have in the past had people approach me with commissions, wanting me to make another artist work. For example "I saw this ring in a gallery but I thought you would be able to make this for me but cheaper". This was actually a great lesson for me, firstly in learning to say NO to commissions, but also made me revaluate my pricing as a creative, seeing as people thought they could come to me for a handmade bargain!!! xx

Thank you for mentioning this ...so much happened a few years ago really has put things on hold however I switched back to doing my journals and hand drawing rather than my digital work cus I couldnt afford the stockphoto purchases any more and health got rough so selling kinda stuck cus I'm centered on healing on so much but I have found that some of the positives even if it's just a few comments the positive stuff helps alot so I just kinda have been on hiatus and working my journey to be more just for me there was so much that it was just overwhelming yet I do hope to have a local show when I can cus my canvas work kinda boomed during covid beginning and hopefully I can start something back cus this is my life and I been drawing and doing whether it was graphics or fine art for most of I have learned what to let bug me and what not to...for the most part you are correct it's our journey our way and so with that said have a great week and I know I'm not the only one that's dealt with that kinda of stuff

This is a great discussion on a really tricky area. I have no idea why anyone would want to copy someone else's ideas, aesthetic or identity as they'll always get found out? There's no definitive answer to any of this, I guess, other than keep on keeping on.
Interesting topic, I’m currently working on finding my art style and it’s interesting to see it develop naturally. I will have to do research on copyrights in my state I live in California. I am not quite savvy with doing art prints right now so I plan on selling my originals for now until I figure out how to make prints.

I also deleted the blog from my studio site and stopped using online stores & merchandising. If someone wants my work they must get it directly from me. Re copyright: Someone copied one of my blogs (the whole site, not just a post) to a foreign-based site and I've hesitated to pursue it, bc I didn't know if it was worth all the work that might be involved, or how to go about it.
