  • "Thousands of Germans are reported to have been sent letters asking them to pay a fee for porn they are alleged to have streamed illegally online.
    Law firm Urmann (U+C) is acting on behalf of Swiss copyright protection firm the Archive, and is asking for one-off payments of 250 euros (£210).
    It confirmed to the BBC that the letters have been sent but would not say how many.

Also a large percentage of porn these days are home made and submitted and uploaded for payment. It would be rare to find a porn video of individuals who just did not want to do it because they were threatned or blackmailed and even if they did a video they didnt prefer to do then they made a career option to do it anyways for advancement and continued work but just because they dont prefer something doesn't make it rape. They choose to which makes it consentual employment.

      We Deserve Better The problem is if we end Copyright then we destroy ability for people to be able to make enjoyable content because there's no protections. Music industry would die out, which means a lot of the music you probably love would die out.
      Someone could get to your next favorite Indie Band before you know of them and rip off their songs, and then you would end up liking that band possibly instead and the poor Indie guys who wrote it don't have any recourse.
      T.V. would pretty much die off same with movies. It would create another recession.
      Independent artists could have their material ripped off by bigger comic companies. Again no recourse. Most entertainment would most likely go down the shitter.
      The big money interests that DO survive would rip off the work of those who are trying. Don't get me started on how hard it would be to find things. People could name songs and CDs to look just like legitimate ones. How would you know which CD is the real CD?
      Copyright needs to be modified.
      What about someone trying to get published. Their books could just get stolen by the Publishing companies. No real recourse since there is no Copyright.
      That's a worse situation than what we have now.

      Joe Banana you're actually wrong too.
      It has NOTHING to do with making a profit. If I buy a CD and 100 blank cds and I make a hundred copies and I just leave them in mail boxes I am infringing on copyright and breaking the law. No money is being exchanged to me. It is the damage I am doing.
      At the absolute most the damages done by me streaming a video are equivalent to the value of the video I streamed no matter how many times I streamed it. Actually I think the best they could do is sue me for 1 months' subscription to a service they are part of because I could then download it legally.
      The whole argument is a false argument. They aren't actually trying to make streaming porn illegal they just want to scare people to send them money.

It's the producers who need to milk every cent out of a contract. Take a book for example, if you read a friends book is that copyright infringement, what about a TV show?

The recording companies put their music videos on there, and youtube gets millions of page views, and in return people will hear the music and go buy it.       Saucypants1000 They have no legal justification. It's not illegal to download illegal content (to receive) it is only illegal to share or upload the content. So on torrents that's one thing since you are redistributing it, but receiving a distributed copy would be another thing. They can't show that you did any harm to them and the few dollars they could get out of you if you purchased it wouldn't be enough to take you to court.
      That is my understanding of the legality. They just want to scare the money out of you.

    i live in germany and you guys should know that the case never came through. the german supreme court actually sentenced the law firm to a high money fine which resulted in the bancrupcy of that law firm.

    The lawyer who is sending out these letters has been convicted of improper/unethical conduct before, and will probably get convicted for this story again (some of the alleged offences where commited on the 20th of December 2013 according to the letters). A website has now discovered that users were automatically redirected to the specified content, and the copyright owners have made no efforts to have the content removed (which they are obliged to do by German law, otherwise claims of infringement are void). They fooled the court to get the IP owner's IDs by claiming they had been filesharing (which obviously is inaccurate if someone is using a stream), and a stupid/clueless judge gave them the desired warrant (this might come to haunt these lawyers as well). It's a total scam, they probably calculated that if they sent out 50.000 warnings and one fifth of people pay out of embarrassment, they'll make 2.5 million euros and then close down their offices.

    Not a RedTube user (much better places to get porn) but if you access it via http and not https then they could just be packet sniffing one of the nodes it goes via it to get all the basic user information then spam them with lawsuits. They could also be getting it from your ISP if your ISP has terrible security or was issued with a court order (although questionable how they would get said court order).

      shinmusashi44 I have not been to this particular porn site, but on the ones I have been on Xhamster, pornotube and so on there is allot of videos that are snippets from porn movies, it is impossible then to know which ones are released with the creators approval as advertisement and which ones are copyrighted, Also there is no way of knowing when you klick on a link if something is copyrighted or not so no I stand by what I said earlier these fines just can not be legal.

      Nope. Servers typically log your ip address and what requests you've made. The only way to get around it is to use an anonymizing proxy service.

    Copyright laws are so out of date and only benefit the rich. I small time content creator cannot protect their `property` at all. You have to have a lot of money in the first place to even attempt to stop anyone from `breaking` copyright law. I think Creative Commons really is the way to go these days.

      Yeah, just recently my internet was temporarily shut down on copyright grounds because someone from the record company LOOKED AT THE FILES ON MY COMPUTER and found that I torrented a Katy Perry cd for my sister (something I did like FOUR MONTHS ago.). They're just lucky that I hate Katy Perry and had absolutely no qualms about deleting the album to get my service back. But it's the fact that the record company was snooping around my files and has the authority to bully my internet provider into shutting down my service that pisses me off.

    I think they obtained the IP-addresses in the ads on the site.
    Besides, no one can be accused for piracy from this, because the site is responsible for the content, the majority of the site is perfectly legal to stream, which means that you cannot know if it's legal or not legal, not from any common sense etc.
    What I'd do if this happened was to tell them to fuck off. If they didn't do that, I'd ask one of the biker gangs to "visit" the person responsible for the letters. I sure hope someone does that, these people are maggots that should be crushed. :)

    If you don't live in Germany you have nothing to worry about. Germany has very unique copyright statues that can be applied to streaming content over the internet. for example if you live the USA you can watch all kinds of music videos or free on RUclips; many of these same videos will be blocked in Germany because of their copyright laws.

      The funny thing: streaming this content is very likey legal in Germany, while aquiring the ip-adresses of the users probably was illegal. Criminal complaint has been filed against the law firm, and they might get in trouble for this.

    I presume these films are being streamed without the copyright warnings that you normally get bombarded with before a feature starts when people "stream" these porn films?
    If that's the case, how can someone who unwittingly watches it in this manner without knowledge of the copyright violation be prosecuted for it?

    To give you guys and girls an update from Germany on this issue. Several State Attorneys in several german countries go now after the law firm U+C. When they asked the courts to get the permission to get the real names to IP-adresses, they give the false impression that it was collected from a P2P network - they made false affidavit statements (I hope that was nearly correct english?)
    And now to a completely different thing: Seriously (and that not only about TYT thing). Do you get your "german language skills" only from WW2 comedy TV series?

    nobody really knows how U&C got the ip adresses, but they probably did it via phishing websites (fake websites), or via malware (a very high number of those who got the notice, had the exact same virus on their pcs).
    those are all illegal hacking methods so my hopes are pretty high that this lawfirm will get buttraped in the not to distant future.

    Thats a old practice here in Germany, law firms sending letters because you watched porn/movies/TV series online.
    Heres the thing, you dont want to go court because its embarrassing, but the law firm also wont press any charges, because they know its not against the law and they would lose if it went to court.
    So all you german porn site watchers, if you get a letter, ignore it. They are fishing for scared guys who pay them.
    You will get maybe 2-3 additional letters telling you to pay up or it will go to court. But nothing will happen.
    It happened to me, i supposedly subed to a magazine and after a while a law firm started sending me letters telling me to pay up. I ignored it and they stoped.
    Like I said, its a old practice to pray on the uninformed and mostly old people.

    Undercover "corporate filesharers" have been known for a while, especially on PirateBay.
    Although in that instance it is about mainstream hollywood movies I am not surprised this tactic has spread to the porn industry.

    I've never used Red Tube, but I know with some other sites; like Pornhub and Tube8 certain companies post clips themselves. I'm assuming it's in an effort to lure a person to their sites or whatever.

    The idea that "watch porn" necessarily equals streaming it illegally is ridiculous. There's plenty of porn that's completely free anyway, and some of it is the stuff I prefer. (Hentai, rule 34, etc...)

    Not everyone respects the fair use clause. Alot of anittubers (youtubers thst do videos on anime) often get hammered hard on this due to Japan's lack of this calause. I did a book review video 2 years ago on o e of the books based on the Predator Franchise so used copious amounts of clips from the movies while saying buy this book and directing viewers to check out two other books in said franchise that have their own trilegies. Still got a copyright strike for a six second scene of the kid from the last pred film trick or treeting. Not the others. Talk to Stephanie Sterling of the Jimquisition, Nash Bozen of Radio Dead Air or any of the other reviewers and commentstors on the web and they will tell you the same thing.
