  • "A Florida convenience store owner is preparing to file a federal civil rights lawsuit against local police after collecting more than two dozen videos detailing what he describes as regular harassment by officers against both customers and his employees.
The Miami Herald reported that since installing cameras at his store in June 2012, 207 Quickstop owner Alex Saleh has amassed footage of Miami Gardens police arresting people for trespassing despite them having permission to be at the store, as well as conducting searches without a warrant and in at least one instance, reporting a trespassing arrest saying one of Saleh's employees was loitering outside the business when video of the arrest showed him being taken into custody while he was working inside.
The employee, Earl Sampson, has reportedly been put in jail 56 times, searched more than 100 times and questioned more than 250 times over the past four years, despite Saleh informing police on several occasions that he worked at the establishment."* The Young Turks hosts Cenk Uygur and Ana Kasparian break it down.

This guy is an awesome boss, and an upstanding member of his community. Because he is protecting his community from the police. Much respect.
And Earl you have an awesome constitution for being harassed and not lassing out. If all people were like you there would be no war or hate.

It's basically why dash cams became standard in Moscow years before it was commonplace in the US. Sure the traffic is a mess so accidents are frequent but without those cams those Russian cops under Putin will either arbitrarily assign blame or extort bribes. So. Yeah. Not to minimize the fairly obvious racial motive here but it's not so novel to have to protect yourself from the forces of supposed law and order.

Funny thing is that I was constantly harassed by the police where I grew up from the age of 13 to about 21. When I was 16 the cops could now pull me over and they did, the harassment was constant. One month I just documented every time I was pulled over. I wrote down, where I was stopped, why I was stopped, who was with me, if I was issued a ticket, the officers name, the date and time and a brief description of the events. I was pulled over 26 times in 30 days, and issued 3 tickets. This is just the thirty days I documented, but for years before this is how I lived. Knowing that if the police saw me, no matter what I was doing, I was going to be stopped, searched, and harassed illegally. Especially from 15 on. You see when I was 15 my dad suddenly died, he used to be the one who would go in and stand up for my rights and teach me to do the same. One day I was stopped by an especially awful officer here in my hometown, officer McIntyre. We were heading opposite directions on a side street. I didn't even wait for him to initiate the stop, I knew it was going to happen. So I just jumped out of the car threw up my hands and said "what now, what do you want this time?" The cop says license and insurance, I give him the info he wants. I asked why did you stop me. He said you were speeding in that parking lot. I say OK what's the speed limit and how fast was I going? Of course he had no answer because he was just making shit up like they always did, and had never clocked me. I was just so frustrated, I mean this was the 26th time in 30 days I was stopped and harassed like this, I started to cry. This piece of shit cop looks up to me and says, and I quote verbatim, "Your not so tough now that your dad's not around to protect you" In that moment I wanted to kill him. I took the list to the city attorney and when he realized that documentation existed and that there was approximately 40 different people as passengers that would tell the same story I would he called the police chief and ripped him a new asshole. The city attorney demanded action against the officers. I believe officer McIntyre was demoted from a detective to a beat cop because of this. You just have to carefully build a case against them, while trying your best to be lawful at all times and respectful of the police that are harassing you so they don't get you locked up on some manufactured bullshit in the meantime. It's like a dance, don't insult them, but also stand your ground, refuse to cooperate as much as possible while NEVER ignoring lawful orders. Build the case they can't beat and document EVERYTHING just like I did on paper but also use cell phones, back then we didn't have them. It's your only chance against crooked cops.

    • @andiidoode
      @andiidoode 5 лет назад +24

Didn't read all the comments, just gonna put this out there.. But how can the cops arrest the guy for trespassing? In order to do that, the owner of the property would have to make the complaint. Considering that it's a place of business that is generally open to everyone (with possible exception of people banned by the owner), there isn't really any trespassing unless it's in an area that the person isn't authorized to go in. So arresting him for trespassing is just utter bullshit.

I have a friend who got a job in a little podunk town called Woodland in CA, and he is black and worked at the local bank. He would go to work and get stopped every other day for "hanging around the bank." Then after they all figured out that he worked there, he would then get stopped with regularity for phony driving infractions. He finally had to quit the job because it was such a hassle to try to get to work on time. Profiling is a serious issue in this country.

They leave out some of the worst details.
    - Earl was mentally handicapped.
    - He also was forced to plead guilty to trespassing every time he was arrested because he couldn't make bail and would have had to stay in jail until a trial date, and pay court costs he couldn't afford. The one time he did try to fight the charge, he spent 20 days in jail awaiting a trial, and even though he beat the charge, the judge still issued a stay-away warning, so it wasn't just the cops, even the local court system was in on this.
    - The cameras were specifically installed after 4 years of harassment, specifically to catch the cops doing it - they weren't security cameras he already had to deter thieves, they were anti-cop cameras.
    - Before resorting to installing the cameras, the store owner invited Earl to come live in the store, meaning that he was getting arrested hundreds of times for trespassing not just at his workplace, but _in his own home_
    - The police also arrested many customers (all black people) in the store for trespassing over several years, often while they were waiting in line at the checkout, so it wasn't just this person that they had some personal beef with.
    - None of the police involved ever received any disciplinary action whatsoever.

I'm white, 26 years old. I live in the Chicago metro area, the police have prolly stopped me 100+ times in the quarter century I've been alive, they actually hit me with a sqaud car and shattered my wrist when I was 12 bc of a clear airsoft gun. I'm not saying racism doesn't exist. But I think when you get down to the fundamental truth of what's actually going on, that not even 50% of it has to do with race. We have a very bad problem with the police in America, and I think it's MOSTLY a lack of accountability and oversight

    • @mattvaluch1452

Sgt. Arnez Well the people need to make their own system to police them. The bloods have the crips but who does the cops have as an opposing force know what I mean? It's nothing more than people putting you in a building and stopping you with force cause theyre armed. If someone else locked someone in a building against their will and red them itd be kidnapping to the law but they do it to people they deem evil. If the people deem a cop unjustified they should lock the cop up even If their teammates deem them justified which naturally, as we see all the time is the case. There needs to be a rational and reasonable discussion about power distribution we the people put cops on this non existent pedestal of oh no we can't gang up on him even If he's in the wrong ideology. If more people were armed and we created an understanding with the police like if 3 cops are beating someone senseless and the crowd just watches like Wtf beat those cops asses if it's justified. If a cop is going to shoot someone who isn't a threat and they're running for their life a bystander should shoot the cop to save someone's life. Its all about force. United the people are powerful more people should own guns. Not SJWs but reasonable rational people. We need to create an equally powerful police force to oppose the police and be real about right and wrong but it's almost impossible to pull off

And some courts have even up held that you can not be trespassed from the only hospital in your town or from a bank that you have an active account at if that is the only branch in your town. As well as from any government buildings.
This is 100% illegal and this needs to be released to all local and state media and yes, they need to file civil action against the police.

Just a follow up to this story, in June 2015 Sampson and several other unfairly persecuted men in the area won a court settlement against the MGPD. The chief of MGPD resigned a month later. The police officers had been given a quota to search/detain black males from ages 15-30 regardless of probable cause. Sampson had been stopped and detained multiple times, but it exponentially increased when his boss complained to the City about the cops behavior, that is when they started showing up every day and arresting Sampson, basically to try and drive him out of the area and to punish the store owner. They used the fact that Sampson has plead guilty to trespassing on the stores property on one occasion, which he only did because it meant they would release him and he wouldn't have to go to court, to arrest him time and again instead of just searching him.

It's not only black people that get harassed.
I lived in Kissimmee over ten years ago and would go to the store late on my days off because I worked overnight. I was stopped twice and both times they claimed my license plate lights were out. The first time they let me go and I headed straight to the store to get replacement bulbs. In the parking lot I looked at my lights, and they were all working.
The second time I was stopped, the cop gave me the same excuse, and I told him I just replaced the bulbs. H walked over to his car and immediately walked back and gave me back my ID.
A year before that, I was dating a girl that was going to a cooking school in Kissimmee. I used my sister's car, dropped her off, made a right on 192, changed lanes and drove under a traffic light. A cop stopped me.
He told me that I blew past the stop sign before 192. I told him there is no stop sign there. He told me that I cut someone off when I turned onto 192. I told him as soon as I realized I cut them off (the road has a curve), I changed lanes. He THEN told me I ran a red light. I told him the light was just turning yellow when I went under it.
He walked around the car and said the license plate was a couple days expired. He HAS to give me a ticket for something if he stops me.
Many cops in Florida are dicks.

From the "Alex Saleh" name I guess he's of, maybe, Christian Arab extraction. "Arab". I wonder if the harassment wasn't against HIM. He looses money, work time, he must have had one hell of a turnover in employees. Plus, the cops surely arrested costumers too the times they couldn't nab an employee. If I were arrested for no reason going to a store twice, I wouldn't step near it again, nor would my friends and family.

yea it is bad for business, and that's the key to business that a lot of wealthy corporations forgot. It's about taking care of your people. That includes: your employees and customers. and if cops are harassing both and you aren't doing anything, it's gonna bite you in the ass. and fortunately this business owner knew well to record this on his property and file suit.

writerconsidered That problem hooks into what Cenk said, which is they don't have the money to hire a team of lawyers. The business owner did the best thing he thought he could to prove there was something actually occurring by setting up the cameras, seeing as his word only against the police, who do you think a jury would believe? I mean fuck, that part where the cop just waltzes right in and pulls aside the man who took out the trash... who would believe that without the footage? I still don't even know how or why with that, he didn't look suspicious at all to me. Not even a little bit. It's just a black guy taking out the trash, why is that so terrifying? Ooooh nooooooo he didn't separate the metals and the plastics! He's going to be the downfall of our country!

He probably isn't even getting paid much anyway. This is the result if making cops super citizens. 1) They are armed, and trained to use their guns, 24 hours a day, yet it is a greater crime to kill one if them than an unarmed citizen. 2) It is a felony to physically attack these armed people. 3) According to the Supreme Court these people don't have to know what they are doing. They are not required to know what law they are hassling or arresting you for. They can decide that what you are doing should be illegal and arrest you. 4) A
lot of them are criminals in sales is pay attention to the news watch them on the street. The blue wall of Silence: when cops do this how doesn't that make them accessories after the fact?
When they themselves are venal why are people surprised when the cops show that, I've had off duty cops tell me this, they believe that the regular law abiding citizen is just a criminal that hasn't been caught yet.

It seems like some of you don't wanna don't look for a solution to racial profiling instead some of you wanna keep it going and make all black men suffer for what a few have done. When police write a "trespass warning" for a person and a location, then they can charge the person with trespassing if they go to that spot. I was once given a trespass warning for 23rd St in Austin, TX. I thought the trespass warning was nullified when I was not indicted for the charge that went with the warning. I later was arrested while playing chess on 23rd St.

For the longest time I believed that racial profiling was more of a subconscious thing, the existence of which only becomes obvious from statistical analysis of large sets of crime data, but for the most part couldn't necessarily be proven in the case of a specific individual.
This story completely throws that out the window though. I mean for fucks sake there is *NO WAY* you can honestly rationalize this kind of egregious discrimination.

Once she wore his sweatshirt to the convenience store and they grabbed her by the back of her neck. When they pulled down her hood, they literally said, "Sorry, we thought you were your son." She has sued the police department numerous times, won, and it's still happening!
