I’ve was hit by a car at work. I haven’t received any compensatIon. I did get a attorney. But it’s now been 3 months and I’m struggling to hold on to my vehicle. I lost my home sold items. I’m not sure what to do. The job isn’t responding to me nor workers comp. I just got the cast removed but I’m told if I go back to work that I’ll lose my case. If I don’t I’m in high debt.

If the worker reaches MMI and is not fit to carry out his duties without modifications, doesn't this render that employee partially or totally disabled and is entitled to a disability settlement based on percentage of disability based on his last weekly wages?

very educational video. Are we the injure worker only entitle to the weekly benefit from workers comp or something bigger at the end? What if someone that has a lumbar fusion and has some permanent disability? Are the weekly benefit that they were receiving count towards the settlement? Sorry I'm just confuse because some say only weekly benefits, then others get settlements? Are we entitle to both? thanks

Thank you for your comment and questions. Every state has its own laws and regulations about compensation an injured worker may be entitled to. You should consult with an attorney who is experienced in these matters from your home state. We practice in Alabama and can answer those questions pertaining to Alabama law.

My question is (which always gets a mixed bag answer) how long can I be out on workers comp before a company is allowed terminate me? And if the company has a policy, say 90 days, shouldn’t it be written in a contract that’s available for the employee to see? Can it be the case that a doctor puts you out for 4 months but at the 3 month mark they fire you?

Hmmm...no. You are not even mentioning mandated money settlements for permanent partial and total disabilities!
