  • The plaintiff bought a new car and brought the car to the defendant’s business for a repair. She claims the mechanic broke her seatbelt while her car was in for a different reason. Then, someone stole her fuzzy pink dice from her rearview mirror. She’s suing for damages. The defendant argues the mechanic took the dice off the mirror because it’s illegal to have them on, then left them on the seat. She doesn’t think she owes anything.

Also this company has lost their mind for agreeing to go to court this way instead of proper court with the necessary documentation and a representative who is aware of the situation as a whole. The office manager is totally clueless as to this case, which may not be her fault but man the company shouldn’t have chosen to represent themselves through her due to that fact

@@mrshappilymarried1 because the owner decides who goes and they’re sketchy and don’t want to be there with the mechanic which is how it should be.
Why would they care to throw away someone’s dice? I don’t believe the “they placed them on the seat” bs, because I’m sure the mechanic didn’t care and just threw them aside in annoyance. But why would they go out of their way to take them or throw them away? They have no value. So throwing them away would be some petty action for some other reason

Her boss probably knew he couldn't get away with pretending to not know where the battery is and hoped the judge would believe that it's under the hood rather than research it.

The face the office manager made when she got caught lying about the battery is so funny to me lol. I get that she might not know since her work is clerical, but you don’t speak on something you don’t know except to say exactly that: “I apologize but I’m not certain.” ESPECIALLY in court, especially representing your company. This is why you inspect you car before leaving the lot. Once you drive it away, they'll say they didn't damage anything. I took my car to a dealership once to have some work done and get covers for my driving lights, and when I picked it up they had already put the covers on. I pulled them off and my driving lights had been smashed. I immediately went and got the service manager and pointed it out. They still asked if they were broken when I dropped it off and "That's why you wanted the covers". I told them that's absolutely ridiculous and to look at their video footage because they were not broken when I dropped it off. They ended up replacing them on their dime.

Sounds as if they did damage her car But, she took too long to seriously address the issue. And when she did address the issue, she asked for gas money too. They should correct the damage but they don’t owe her gas money. And with regard to the “fuzzy dice”, they have sentimental value to her…which is fine and dandy; courts don’t necessarily pay for sentiment although in some cases I suspects that courts do.

I always find it perplexing when owners or managers delegate representation to a third party who had no prior interaction with the plaintiff; it just doesn't add up to me. In this case, the defendant seemed abandoned, left to fend for herself as if she were thrown to the wolves without any protection. While the plaintiff presumably presented her case diligently, the judge couldn't properly question the defendant due to her complete lack of involvement. At the end, when asked by Doug what the owner/manager would think, she responds, 'He thinks it's wrong and they are not going to agree with it and they're going to be unhappy with it'. This begs the question: Why didn't he attend or send individuals who had interacted with the plaintiff? It's hard to complain when you fail to send the right representatives to defend your business in a favorable light.

Yeah no lol. He thought this was a wise decision, that turned out to be unwise, but yeah. lol.

The plaintiff wants $300 for gas? Seems to me each time she went she had something else that was fixed, so why does she want the $300 (which seems high for even a few 50-mile round trips -- what does she get, one mile per gallon?) back. That's gouging.

I understand sentimental value, but we can never put a price on that unfortunately. She didn't notice them missing for 2 weeks, someone could have just taken them out of her vehicle
As for the gas, it didn't sound like she drove to the shop repeatedly just to have the seat belt fixed. She was going there for different repairs assuming the seat belt would be fixed as well.

Manager, I don't know why he sent her/Defendant was worse, and sending basically this woman who didn't even know like something pre-k/kindergarten that some cars, (usually foreign cars, station wagons, minivans etc.) have the battery under the driver seat. Everyone knows that, I don't know anything about cars and knew that. I know dealerships sometimes hire eye candy receptionists, but at least these women know their cars. This woman is basically clueless and a model/there to look good smh lol.
