'Why was the Just Stop Oil founder imprisoned when Boris Johnson wasn't?' | LBC opinion

  • James O'Brien gives his opinion as five Just Stop Oil members - including one of its co-founders, Roger Hallam, - have been jailed for between four and five years for conspiring to organise protests that blocked the M25.
Hallam - who also co-founded Extinction Rebellion - was sentenced to five years' imprisonment while the other four defendants were each handed four years' imprisonment.
The environmental group have described the sentences as a "obscene perversion of justice".
Prosecutors alleged the protests, which saw 45 people climb up the gantries, led to an economic cost of at least £765,000, while the cost to the Metropolitan Police was more than £1.1 million.
James O'Brien insists that 'you need to do something significant to draw the attention that the emergency demands', but also finds Stonehenge 'ridiculous', and stresses the need for 'peaceful' protest.
James O'Brien also compares Just Stop Oil's jail sentences to the consequences of Boris Johnson's premiership.
'An ex-PM, who caused countless unnecessary deaths by transferring resources from pandemic response to preparation for his lunatic no-deal Brexit, gets no punishment at all', says James O'Brien

In law 'conspiracy' or 'joint enterprise' is a charge which is treated with much more severity in the courts. Now of course - with the Post Office inquiry it is blindingly obvious to anyone who has followed the proceedings that 'conspiracy' should be right at the top of any future charge sheet. However that seems unlikely - given the massive extent of the conspiracy and the involvement of 'establishment' figures, such as government ministers and senior civil servants. Direct action pressure groups have no such protection and therefore the individuals concerned are subject to the full force of the law. Is this right - clearly not - but it comes with a constitution of 'entitlement' which means that the prosecution system and the courts will always give the 'high and mighty' much more latitude than the ordinary man or woman on the street.

It’s not only that but “obstruction of a highway” wasn’t a criminal offence before the 2022 law changes that also brought in the idea of conspiracy to cause a public nuisance aka the anti-protesting law. I believe previously obstructing a highway was treated as a civil matter where you could get fined for doing it but not much more unless I am mistaken. Then they updated it to a criminal offence and brought in potential jail sentence up to 51 weeks. 🤔🤷
