The real problem is not that the ATF keeps making rules. The problem is we don't make them stop we don't stand up for ourselves we just sit here and complain like little cowards.

There's a lot of cases coming in June from the Supreme Court in regard to firearms. But moreso, the court is ruling on Chevron Deference which addresses Administrative law, created by agencies. So the Chevron vs. EPA case would affect gun rulings too.

The registry has been around for decades. I'm not speculating. They used it to contact me about a stolen gun.
@zacharymorris9917 it's not a registry. They just happened to have a 4473 that still had current information for your firearms serial #. It works when you are the original purchaser. It doesn't work if you bought your firearm used.

When is the ATF gonna learn they can't make laws or change the rules as they see fit.
How no one could see the error in allowing agencies to make "rules" in order to "enforce" laws is beyond me. How could people not understand that it would simply be a means to create any "rules" the agency would claim it "needed" in order to enforce the law, thus bypassing Congress in law making.
It was the 1940's I believe, when this came to pass. It was a different time. Politics weren't yet weaponized, or at least not to the extent they are today.
What we really need is every law should have an automatic sunset provision, and it should have to be reviewed and renewed every so often and maybe, MAYBE, made permanent after X number of renewals. Chances are this would have been made permanent anyway, but maybe it wouldn't have who knows?
And it should be mandatory that ALL of these 'extralegal' agency rules-that-are-totally-not-laws-we-swear be temporary until they can be voted on by Congress.
I know, I know, this is more work for Congress. I honestly don't care if they have to pull 12-16 hour shifts to do their job. Time to make them start earning that pay. Maybe it would inspire them to make less stupid laws.

This won't stop someone selling their neighbor a gun. It will however curb gun show private sales where there is always a police presence. And we all know they will help enforce this "rule".

No sane person would prosecute someone for selling property.
Let's do a reality check here. A "collection" is comprised of "onesy" ownership of a variety of calibers and makes and models. They are usually kept for a period of time until either someone figures out they are qrap and no longer wants them (who wants a firearm that jams or has some other chronic problem - or the caliber or function of the gun is too extreme to be handled by the collector - for example owning a .45 or .50 caliber handgun you don't have the hand strength to control and that is painful to fire) and the collector tries to get rid of it without taking a bath. The intention of making a "profit" is a pipe dream. If you sell a firearm through an auction or consignment agreement, the fees are going to take 20-30% of the sale price. Lets factor in if a firearm is "used" and condition becomes an issue (a fairly subjective issue at that) the firearm is further devalued from what the collector paid for it. If you are an average consumer and make all your purchases at full retail YOU CAN NEVER EXPECT TO PROFIT FROM THAT POINT FORWARD. The glut of everyday modern firearms and their availability through so many sources, make profitability literally impossible. The exception here are "antique" firearms. Firearms manufactured before 1898 are not subject to any of the modern gun law regulations and rules promulgated by the ATF and DOJ.
The way a "collector" of these class of firearm make a profit is they find someone who doesn't know what they have and buy it "on the cheap" and then turn around and sell it to a knowledgeable collector for its real value. Collector to collector sales are governed by perceptions of condition and desirability. All very subjective and a matter of opinion. Dealers who are skilled in the market and are in the loop about other collectors looking for certain things and have the ability to find those "in the wild", can make a profit. But again none of that is regulated by laws and usually this class of firearms by a collector is to look at and not shoot. So they pose no threat to public safety (which is the underlying theory/excuse of all regulatory efforts)
With modern firearms, the ONLY way I can see a profitability motive is you have the ability to make bulk purchases of new firearms at wholesale and then turn around and sell them at retail without having to resort to selling through an auction or dealer who will take fees. The margins on wholesale-retail sales are very thin and are quickly eaten up by middleman fees. Making a profitability motive a non starter.
Bottom line is COLLECTING MODERN FIREARMS COMES AT A COST - NOT A PROFIT!
It appears the ATF is attempting to word slice, obfuscate and wordsmith the 2nd Amendment in order to gain control and make an end run on the Constitution. Cause it doesn't bear out in reality.

You cant even sell your guns to a FFL with this ruling technically from what I understand. It can only be 1 or all of them at once. No longer can you use them as a way to pay for another purchase.
So when was the public comment period for this? If there was not one, it is a violation of the APA and thus should be thrown out immediately.
There was one, they got notified that there was thousands of spam comments from one source in the antigun lobby in support of it, the never removed them. Then they removed pro gun comments to make it look like nobody opposed it.

As long as you can determine the date of manufacture and know who owned in the past you can claim it must’ve been before the law went into affect.
Virginia already has had a law on the books that all private sales have to go through an FFL. Even passing a firearm to family members. Nothing new here in VA........
This is not an enforcable rule in VA. It is illegal in VA for the govermant to hold records of firearms background checks for more than 30 days. 12 months for mulihandgun purchases. This makes it impossible for a DA to use the lack of a background check as evidence against someone.

This is highly illegal. Its an infringement and a backdoor registry as well as trying to charge you money to eat up any money of even breaking even that most people do anyway. Its theft, and it infringes upon the 2A.

EPA,_ recent federal court battles in which Wacobois are currently enjoined, and the very real emergent and irreparable dangers this non-rule poses, gun rights groups can and ought to sue for an emergency injunction, after which they can obtain a preliminary injunction. There’s no way a multi-year wait will be tolerated. FPC and friends, please get this in court now and seek a nationwide injunction.
If they didn’t constantly say and do things to take more and more gun rights away, I honestly wouldn’t be against background checks on principle. It’s totally understandable why no one trusts them, based on their behavior.

Rules aren't laws
Their claim is the rules are needed to "enforce the laws". The mistake was allowing agencies to decide what constitutes a violation of a law. This should've been clearly defined by Congress and completely static.

The way how this made up rule is written, is just jaw dropping. Also, it's pretty obvious that "commenting" on any future proposed rules is simply worthless...they don't give a flying fk what people want.
I want to know how they think they are going to monitor a private sale anyway. Rediculous ATF rule.
Worst part is WA State gun owners will likely just ignore this, as we had a state law ban private sales in the state already, so this won't affect them.
I actually hope that the this will get overturned in court and may even benefit the gun owners in WA by prividing a clear legal precident on the legality of private sales. Bruen is a great example of a positve outcome of a tyrancial law.
